The trial panel of the Special Appeal Chamber, consisting of judges Natasha Mulaj, presiding, Rezarta Schuetz, rapporteur, Albana Shtylla, Ina Rama, Sokol Çomo, members, announced the decision on case no. 60/2021, dated 20.10.2021, pertaining to the appeal of the assessee Durim Hasa against decision no. 399, dated 14.06.2021 of the Independent Qualification Commission.

At the conclusion of the trial in chambers, the trial panel, pursuant to Article 66, paragraph 1 (a) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a unanimous vote, decided:

– Upholding decision no. 399, dated 14.06.2021 of the Independent Qualification Commission, related to the assessee Durim Hasa.

– This decision is final and effective immediately.

Announced today, on 05.11.2024, in Tirana.

    Duke i qëndruar shkaqeve të ankimit dhe qëndrimit të mbajtur në seancën e datës 02.12.2024, Komisioneri Publik i kërkoi përfundimisht Kolegjit ndryshimin e vendimit nr. 537, datë 02.6.2022, të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra e subjektit të rivlerësimit Florian Bonjaku.
    Gjatë paraqitjes së konkluzioneve përfundimtare, referuar kriterit të pasurisë, përfaqësuesi ligjor i subjektit të rivlerësimit deklaroi se Komisioneri Publik ka ngritur pretendimet e tij në ankim, pa vlerësuar objektivisht rrethanat, në të cilat janë bërë deklarimet e subjektit të rivlerësimit për pasurinë. Përfaqësuesi ligjor dha shpjegime për të gjitha çështjet e referuara në ankim edhe për dy kriteret e tjera, atë figurës dhe të aftësive profesionale, duke i kërkuar përfundimisht Kolegjit lënien në fuqi të vendimit nr. 537, datë 2.6.2022, të Komisionit të Pavarur të Kualifikimit.
    Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues u tërhoq në dhomë këshillimi për marrjen e vendimit përfundimtar, të cilin do ta shpallë më datë 19.12.2024, ora 15:00.
    Seanca gjyqësore publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3, Tiranë.

    Today, on 06.12.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 35/2022, dated 25.07.2022, pertaining to the appeal of the Public Commissioner against decision no. 537, dated 02.06.2022 of the Independent Qualification Commission, related to the assessee Florian Bonjaku.

    The Public Commissioner, standing by the appeal grounds and the position held in the hearing dated 02.12.2024, finally requested the trial panel the amendment of decision no. 537, dated 02.06.2022, of the Independent Qualification Commission and the dismissal from office of the assessee Florian Bonjaku.

    During the submission of the final conclusions, referring to the asset assessment criterion, the legal representative of the assessee stated that the Public Commissioner raised his claims in the appeal failing to objectively assess the circumstances in which the assessee’s declarations about the asset assessment were made. The legal representative provided explanations for all the issues referred to in the appeal as well as for the other two criteria, background and proficiency assessment, ultimately requesting the trial panel to uphold decision no. 537, dated 02.06.2022, of the Independent Qualification Commission.

    After hearing the final conclusions of the parties, the panel withdrew to make the final decision, to be announced on 19.12.2024, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
