The Appeal Chamber held on 14.09.2020, at 10:00, the public hearing on the case (JR) no. 23/2019, dated 08.05.2019, corresponding to the appeal filed by the Public Commissioner against decision no. 112, dated 04.03.2019, of the Independent Qualification Commission related to the transitional re-evaluation process of the assessee Dritan Peka.

In the framework of fulfilling the tasks set in the preceding hearing, the Public Commissioner stated his opinion with regard to the three acts, as well submitted in the quality of evidence in the preceding hearing, by the assessee: – the letter from the National Housing Authority; the letter from the Prosecution General Office for the disciplinary investigation on the assessee and the financial analysis submitted by the assessee. When asked by the case rapporteur whether after reviewing the above three acts, he still wants the Appeal Chamber to carry out a new financial analysis, the Public Commissioner said that it is the jurisdiction of the Appeal Chamber to decide whatsoever.

Based on 10 new acts, introduced and submitted during today’s hearing, the assessee objected all the denunciations addressed to him, considering them as malicious and unfounded.

After withdrawing for consultation, upon an interim decision, the adjudication panel decided to:

  1. Allow to take as evidence the 10 acts submitted by the assessee in today’s hearing.
  2. Accept the request of the Public Commissioner upon which the Appeal Chamber is asked to carry out a financial analysis for the years 2003 – 2016, highlighted in submissions of the Public Commissioner in the hearing of 22 July 2020.
  3. Adjourn the public hearing on 02.10. 2020, at 10:00, in order to enable the submission in advance, of the financial analysis that will be carried out by the Appeal Chamber, to the Public Commissioner and to the assessee not later than 24 September 2020, so that they get acquainted with it.
  4. The adjudication panel reminds the litigants that in order to ensure the efficiency of the judicial process, it would be preferable that the claims of the litigants, if they have any, be submitted in writing to the Appeal Chamber, via e-mail, prior the next public hearing.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3 Tirana.
