Today, on 31.03.2021, at 12:30, the Appeal Chamber held the public hearing of case (JR) 42/2021, dated 27.07.2021, pertaining to the appeal of the Public Commissioner against decision no. 363, dated 01.04.2021, of the Independent Qualification Commission, related to the assessee Elizabeta Imeraj.

The lawyer of the assessee submitted his position regarding the findings of the International Observers, claiming that they do not meet the criteria to be accepted as evidence by the trial panel.

The assessee, Mrs. Elizabeta Imeraj continued with the objections to the three evaluation criteria, referring to the appeal grounds of the Public Commissioner, requesting the Chamber to accept as evidence all the acts referred by her in support of the raised claims.

Subsequently, the Public Commissioner responded to some questions of the lawyer of the assessee with respect to the findings of the International Observers, stating that the inclusion of the findings as evidence in the appeal is founded in Article “B” of the Annex to the Constitution, as well as Article 49, paragraph 10 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

The trial continued with a series of questions and responses between the International Observer of the International Monitoring Operation and the assessee regarding the asset and background assessment criteria.

Due to the duration of the hearing, the trial panel decided to postpone it to the next day, on April 1, 2022, at 11:00, to follow with the responses of the Public Commissioner to the questions that the assessee and her lawyer submitted before the closure of today’s hearing.

The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
