Today, on 29.03.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 7/2022, dated 03.02.2022, pertaining to the appeal of the assessee Rexhep Karaj against decision no. 478, dated 25.11.2021, of the Independent Qualification Commission.
The trial panel heard the assessee as he submitted in detail his objections against decision no. 478, dated 25.11.2021 of the Independent Qualification Commission, stating that this decision, making conclusions only on the asset assessment, was made as a result of an incomplete investigation, as well as in serious violation of the due process of law.
To support his claims on the asset assessment, the assessee, Mr. Rexhep Karaj filed several documents along with the submissions of today’s hearing, which he requested the panel to accept them as evidence.
After being consulted and following some clarifying questions by the case rapporteur and the presiding judge in view of the examination of the case, the panel decided to accept as evidence only a part of the documents filed by the assessee.
The court decided to not accept as evidence one of the acts, but it would consider the legal presumptions under Article 49, paragraph 6 (a) and (b) of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”; it did not collect as evidence two other acts, as they lacked the appropriate legal form; while it agreed to consider one other act, but accessing it from open sources of information.
Once the assessee stated he had no other procedural requests, the trial panel decided to close the judicial review and invited the assessee to submit the final conclusion on the case.
The assessee requested finally the overruling of decision no. 478, dated 25.11.2021, of the Independent Qualification Commission, remitting the case for review with the Independent Qualification Commission for the evaluation of the two other criteria not reviewed by this commission, the background and proficiency assessment.
After hearing the final request of the assessee, the panel withdrew to make the final decision of the case, which it will announce on April 7, 2023, at 11.00.
The public hearing will take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
