Today, on 16.01.2025, the Appeal Chamber opened the public hearing of case (JR) 74/2021, dated 26.11.2021, pertaining to the appeal of the assessee Ken Dhima against decision no. 428, dated 29.07.2021 of the Independent Qualification Commission.
During the verification of the presence of the parties, the presiding judge noted the absence of the assessee and reported all the acts that verify the repeated notifications of the Chamber’s judicial secretariat addressed to the assessee, to inform him of the decision of the trial panel on the consideration of the case in a public hearing, as well as the date and time of it taking place.
The presiding judge reported that, although the Chamber exhaustively used all notification forms specified in Law no. 84/2026 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania” and Civil Procedure Code, electronic, postal, telephone and public notification, it failed to receive any expressed confirmation from Mr. Ken Dhima that he had been notified about the holding of the public hearing. The presiding judge informed that the AC did not receive a response from the assessee even from his electronic address, which he had accessed before the hearing in chambers.
In circumstances where no reasonable grounds for the failure of attendance was notified by the assessee, and the notifications are considered to have been made in accordance with the law, the trial panel decided to hold the hearing in absentia.
Under these terms, the trial panel decided to close the judicial review of the case and to withdraw in chambers to make the final decision, which it shall announce on 16.01.2025, at 13:00.
The public hearing shall take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3. Tirana.
