Today, on 01.04.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 46/2019, dated 25.09.2019, corresponding to the appeal of the Public Commissioner against decision no. 161, dated 18.06.2019, of the Independent Qualification Commission related to the assessee Kastriot Selita.

Pursuant to the tasks assigned by the Appeal Chamber trial panel in the previous hearing, the Public Commissioner stated his submissions regarding the content of new acts filed by the assessee and the public denunciations submitted with the Appeal Chamber. The Public Commissioner deemed that even after the new acts, the assessee fails to be convincing regarding the assets assessment and proficiency assessment criteria. He asked the Appeal Chamber to conduct further investigations for the purpose of the appeal grounds, and specifically he requested that the public denunciations be taken into consideration while assessing the proficiency criterion.

The assessee stated that regarding the claims stated by the Public Commissioner, he shall state his position in the next hearing and submitted two new acts and asked the trial panel of the Appeal Chamber to collect them as evidence.

After hearing the submission of the Public Commissioner and of the assessee, upon an interim decision, the trial panel decided:

– To declare the opening of the judicial investigation of the case pursuant to Article F, paragraph 3 of the Annex to the Constitution and Article 45 of law 84/2016.

– Pursuant to Article 53 of Law 84/2016, to investigate and verify some of the public denunciations submitted with the Appeal Chamber.

– To accept and collect the new evidence submitted by the assessee in the hearing of 17 March 2021 and in today’s hearing, dated April 1, 2021.

The presiding judge informed that the subsequent public hearing shall take place on 28.04.2021, at 10:00 and that the Appeal Chamber shall inform the litigants in the process regarding any further communications with the aforementioned institutions.

When asked by the presiding judge, the assessee explained the fact that some of the acts filed by him in the previous hearing, were not in the form required by law.

Then, the Public Commissioner stated his objections regarding the claim of the assessee that the Public Commissioner had lodged his appeal outside the legal time limit of 15 days and as such, it should not be accepted. In conclusion of his reasoning, the Public Commissioner stated that he exercised the right to appeal within the legal deadlines, according to Article 63, paragraph 1, of Law 84/2016.

After the parties confirmed having received the denunciations made available by the Appeal Chamber and after withdrawing for consultation, the trial panel, upon an interim decision, decided to open the judicial investigation of the case and allowed to collect as evidence the acts filed by the assessee.

The trial panel decided to adjourn the public hearing on 19.04.2021, at 11:00 to give the parties the opportunity to state their position regarding the new denunciations and evidence.

Today on 13.04.2021, at 10:00, the Appeal Chamber held the public hearing on the case (JR) 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner filed against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

Pursuant to the tasks assigned by the trial panel in the hearing of March 18, 2021, the legal representative of the assessee submitted in the form required by law the acts that were not accepted as evidence in that hearing. Based on Article F, paragraph 3 of the Annex of the Constitution and Article 45 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, in today’s hearing the trial panel decided to accept these acts in the quality of evidence.

The Appeal Chamber held today on 22.04.2021, at 10:30, the public hearing of the case (JR) no. 55/2019, dated 29.10.2019 corresponding to the appeal of the Public Commissioner filed against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

After the Public Commissioner confirmed that he had formally received all evidence forwarded by the Appeal Chamber and administered for the purpose of the case review, the Public Commissioner stated his position regarding this evidence. The Public Commissioner considered that the new evidence do not prove a different circumstance from what was held by him in the appeal grounds.

The legal representative and the assessee objected the position of the Public Commissioner, asking the Appeal Chamber to take into consideration the new evidence submitted by them, due to the probative value they represent.

Today, on 27.04.2021, at 10:00, The Appeal Chamber held the public hearing of the case (JR) 53/2019, dated 25.10.2019, related to the appeal of the Public Commissioner against decision no. 183, dated 19.07.2019 of the Independent Qualification Commission, corresponding to the assessee Petrit Çano.

Following the verification of litigants’ presence, the legal representative of the assesse, when asked by the presiding judge, submitted a preliminary request, upon which he asked the trial panel to not accept the appeal of the Public Commissioner because in his assessment, the Public Commissioner has lodged the appeal outside the legal time limits.

After withdrawing for consultation, the trial panel held that the request of the assessee to not accept the appeal, shall be treated in the framework of the overall assessment of the appeal of the Public Commissioner, based on the requirements of Article 450, paragraph 3, of the Code of Civil Procedure.

Through the submission of the appeal grounds, the Public Commissioner asked the Appeal Chamber to open the judicial investigation and to administer additional documentation and information in order to carry out this investigation for the three criteria, assets, background and proficiency assessment.

The legal representative and the assessee submitted their objections regarding the appeal grounds raised by the Public Commissioner related to the asset and background criteria, considering them unfounded and asked the Appeal Chamber to obtain new evidence to oppose them. Regarding the proficiency criterion, the legal representative stated that the Public Commissioner has not raised any claims in his appeal for this criterion and since these claims exceed the appeal and have been subject to verification by High Judicial Council, they should not be reviewed by the Appeal Chamber.

In response to the appeal grounds and the two denunciations delivered at the Appeal Chamber, the assesse submitted new acts and asked the trial panel to accept them in the quality of evidence.

The trial panel decided to adjourn the public hearing on 14.05.2021, at 10:30, in order to make a decision on the request of the Public Commissioner to open an investigation and the request of the assessee to collect new evidence.

While stating his position regarding the acts received from Greece as required by the law, accepted in the quality of evidence by the trial panel in the anterior hearing, the Public Commissioner held that they do not prove any circumstances different from the circumstances portrayed in the appeal grounds filed by him and do not affect his position on the case.

After the litigants confirmed that they had no additional requests, the presiding judge declared the conclusion of the judicial investigation of the case and invited the parties to state their final conclusions.

During the submission of the final conclusions, the Public Commissioner stated that even after the filing of new evidence, the assessee failed to prove the contrary of the appeal grounds regarding the asset assessment pillar. The Public Commissioner requested the amendment of decision no. 173, dated 01.07.2019, of the Independent Qualification Commission and dismissal from office of the assessee Artan Madani.

The legal representative of the assessee objected the conclusions of the Public Commissioner, stating that the evidence submitted by the assessee during the entire process, clearly show the lawful source of the creation of his assets. The Appeal Chamber has registered the case (JR) no 20/2021, dated 21.04.2021 corresponding to the appeal of the assessee Bib Ndreca against decision no. 337, dated 18.01.2021 of the Independent Qualification Commission.
