10:00 -16:00 2023.06.05 Today, on 11.05.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 6/2021, dated 26.01.2021, pertaining to the appeal of the Public Commissioner and the appeal of the assessee Irena Brahimi against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission. The Public Commissioner submitted the appeal grounds in relation to the asset and proficiency assessment criteria, requesting the upholding, or alternatively, the amendment of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission. The assessee, Ms. Brahimi, provided explanations with regard to her appeal against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission, and filed as well objections against to the Public Commissioner’s appeal grounds. The assessee requested the Chamber the upholding of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission and confirmation in office. Following the court debate, in the context of the respective requests of the Public Commissioner and the assessee addressed to the AC in view of the examination of the case, after being consulted, the panel decided: – opening the judicial investigation of the case, accepting as evidence all the documents filed by the assessee attached to the submissions filed in today’s hearing; – by a majority vote, the conduct of a preliminary financial analysis related to the Public Commissioner’s appeal grounds and assessee’s claims related to the asset assessment. 10:00 -16:00 2023.06.12 Today, on 12.06.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 16/2023, dated 24.04.2023, pertaining to the appeal of the Public Commissioner against decision no. 629, dated 03.03.2023, of the Independent Qualification Commission, related to the assessee Besnik Cengu. The Public Commissioner, during the submission of the appeal grounds, assessed that the IQC decision no. 629, dated 03.03.2023, which ruled the termination of the transitional re-evaluation process for Mr. Besnik Cengu without a final decision on the case, must be amended, deciding the termination of the vetting process for the assessee and the application of the legal consequence provided for in Article G, paragraph 2, of the Annex to the Constitution. The assessee contested the appeal grounds of the Public Commissioner, assessing them as unsubstantiated and without legal cause. The assessee stated that his request for early retirement benefits was due to health reasons, so his case should not be examined in reference to Article G, paragraph 2, of the Annex to the Constitution. In support of his claims, the assessee filed several documents, accepted as evidence by the court. Following several questions of the rapporteur addressed to the assessee in view of the examination of the case and after the parties declared that they had no other procedural requests, the trial panel decided to close the judicial examination of the case and invited the parties to file their final conclusions of the case. Holding that the new evidence does not affect the appeal, the Public Commissioner ultimately requested the amendment of decision no. 629, dated 03.03.2023, of the Independent Qualification Commission, deciding the termination of the transitional vetting process for the assessee Mr. Besnik Cengu and in the application of Article G, paragraph 2, of the Annex to the Constitution, the prohibition of the assessee Mr. Besnik Cengu to be appointed judge or prosecutor of any level, member of the High Judicial Council or the High Prosecutorial Council, High Inspector of Justice or Prosecutor General for a period of 15 years. The assessee requested ultimately the upholding of decision no. 629, dated 03.03.2023, of the Independent Qualification Commission, stating that it is a fair decision, supported on Article 4, paragraph 6 of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, Article 64, paragraph 1 (c) of Law no. 96/2016, “On the status of judges and prosecutors in the Republic of Albania”, as amended, as well as Article 95 of the Administrative Procedure Code. The assessee requested the AC to declare the re-evaluation process complete, without a final decision on the case, as the object for which the procedure has started has become impossible. After hearing the final submissions of the parties, the panel decided to withdrew to make the final decision of the case, to be announced on June 13, 2023, at 13:00. 10:00 -16:00 2023.06.19 Today, on 19.06.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 37/2022, dated 01.09.2022, pertaining to the appeal of the Public Commissioner against decision no. 535, dated 26.05.2022, of the Independent Qualification Commission related to the assessee Bledar Bejko. The presiding judge asked about and the parties confirmed that the Chamber had forwarded to them the additional documentation received by the Prosecution Office at Durrës First Instance Court, in view of the further investigations related to three public denunciations. The Public Commissioner stated that the documentation forwarded by the Prosecution Office at Durrës First Instance Court had no influence on her final requests, therefore, she left their evaluation to the discretion of the court. The assessee stated that, not only the denunciations, which are being examined by the AC, are not part of the appeal, but they are also unfounded. With regard to the documentation forwarded by the Prosecution Office at Durrës First Instance Court, the assessee claimed that no findings were found therein, on the basis of which the need for further examinations could arise in the context of his proficiency assessment. In support of these claims, the assessee filed several documents, which were accepted as evidence by the court, which then declared the investigation closed. Once the parties stated that they had no other procedural requests, the trial panel decided to close the judicial review of the case and invited the parties to submit their final conclusions. At the request of the Public Commissioner for sufficient time for the preparation of the final conclusions, the court decided to postpone the court session to June 22 at 10:00. 10:00 -16:00 2023.06.22 Today, on 22.06.2023, at 10:00h, the Appeal Chamber held the public hearing of case (JR) 37/2022, dated 01.09.2022, corresponding to the appeal of the Public Commissioner filed against decision no. 535, dated 26.05.2022, of the Independent Qualification Commission related to the assessee Bledar Bejko. During the submission of the final conclusions, the Public Commissioner stated that the acts accepted as evidence by the Appeal Chamber, sent by the Prosecutor’s Office at the First Instance Court Durrës, as well as those submitted by the assessee, do not affect the appeal grounds filed for the three assessment criteria, that of assets, background and proficiency assessment. 26 - Announcement of decision
14:00 -16:00 2023.06.26 Today, on 22.06.2023, at 10:00h, the Appeal Chamber held the public hearing of case (JR) 37/2022, dated 01.09.2022, corresponding to the appeal of the Public Commissioner filed against decision no. 535, dated 26.05.2022, of the Independent Qualification Commission related to the assessee Bledar Bejko. During the submission of the final conclusions, the Public Commissioner stated that the acts accepted as evidence by the Appeal Chamber, sent by the Prosecutor’s Office at the First Instance Court Durrës, as well as those submitted by the assessee, do not affect the appeal grounds filed for the three assessment criteria, that of assets, background and proficiency assessment. Standing by all the filed appeal ground, the Public Commissioner in conclusion requested the Appeal Chamber to amend decision no. 535, dated 26.05.2022, of the Independent Qualification Commission and the dismissal of the assessee from office. The assessee objected the appeal grounds of the Public Commissioner filed for the three assessment criteria and in conclusion requested the Appeal Chamber to not accept the appeal, as lodged outside the legal time limits, not based on evidence and the law, and to rule on upholding of decision no. 535, dated 26.05.2022, of the Independent Qualification Commission. After listening to the final requests of the parties, the trial panel decided to withdraw to make the final decision of the case, which shall be delivered on 26.06.2023, at 14:00h. The public hearing shall take place in the premises of the Special Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tirana.

10:00 -11:00 2023.06.27 Case (RJ – re-evaluation jurisdiction) no. 25/2023, dated 20.06.2023, has been registered with the Appeal Chamber, concerning the appeal filed by the Public Commissioner against decision no. 651, dated 27.04.2023, of the Independent Qualification Commission, about assessee Urim Buci.
