The Appeal Chamber held today on March 5, 2019, the consequent public hearing of case (JR) no.9/2018, dated 19.07.2018, corresponding to the appeal of the Public Commissioner against decision no.22, dated 07.06.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Edmond Islamaj.
The assessee filed his submissions and his claims with regard to the financial analysis for the time period 2004-2016, drafted by the Legal Service Unit at the Appeal Chamber.
In order to justify the expenses of his private travels abroad, the assessee provided the adjudication panel with an explanatory financial report, as well as accompanying acts issued by different individuals and associations. The assessee requested that the adjudication panel collects this documentation as evidence.
The Public Commissioner submitted his position with regard to the financial analysis of the Legal Service Unit at the Appeal Chamber, both in legal and economic terms.
The adjudication panel decided that it would make a statement whether to collect the declarations issued on 05.03.2019 by “MeEduSa” and “Instituti për marrëdhëniet italo – shqiptaro” associations, once the assessee Mr. Edmond Islamaj submits the original certified documents, as well as official documentation issued by Italian state authorities that prove that these associations are registered with the respective authorities, as well as, establish the status that the persons signing these acts have in their respective associations.
The adjudication panel decided that with regard to the collection as evidence of the notarial declarations of the hosts of the assessee in Italy, it would make a statement once the latter certifies that these declarants were residents in Italy at the time periods mentioned in their declarations.
In the meantime, the adjudication panel decided to allow the collection as evidence of other acts submitted at the hearing by the assessee, according to the minutes of the hearing, cited specifically by the assessee and the chairperson.
The next hearing shall be held on Tuesday, on 26.03.2019, at 11.00 h.
