Today, on 19.12.2024, at 12:30, the Appeal Chamber held the public hearing of case (JR) 10/2022, dated 15.02.2022, pertaining to the appeal of the Public Commissioner against decision no. 479, dated 03.12.2021 of the Independent Qualification Commission, related to the assessee Arben Dosti.

With regard to the public denunciations, the Public Commissioner maintained that he had included in the appeal grounds his position regarding the denunciation filed before the submission of the appeal, while regarding the denunciations filed afterwards, he left the need to any further investigation with the court’s discretion.

The assessee contested the claims raised in the appeal, submitting several documents, which he requested to be accepted as evidence by the trial panel.

Next, he responded to several questions from the international observer to the purpose of the consideration of the case.

With regard to the requests submitted and debated in the hearing dated 13.12.2024, formally filed during today’s hearing by the legal representative of the assessee, the trial panel decided:

– To administer as evidence the acts filed attached to the submissions, except for two documents that were not submitted in the form required by law. The assessee was invited until the next hearing to forward them in the form required by law.

– To administer the acts filed in the hearing dated 13.12.2024 and the ones of today’s hearing.

– To dismiss the request of the assessee to order the National Authority for the Classified Information Security to declassify the background report, as unfounded in law.

– To dismiss the request to provide time to the assessee to submit banking documentation of Alfa Bank of Greece, as the assessee has had sufficient time to obtain them, since the moment he was informed of the appeal grounds until today’s hearing.

– To dismiss the request of the assessee to obtain information from the Ministry of Justice of Greece on the judicial status of the assessee.

– To dismiss the request of the assessee to verify the judicial status through the comparison and verification of the fingerprints, deposited in one of the forms described in his request.

The trial panel decided to open the judicial investigation for three denunciations and invited the assessee to forward the acts from the case files, which prove his position regarding these cases, as well as the relevant decisions issued by him regarding these cases. These acts must be submitted with the AC, at least 5 days before the next hearing.

The trial panel decided to address the law enforcement agencies to be acquainted with the same information which the Independent Qualification Commission was also acquainted in the context of the vetting process, for the assessee Arben Dosti.

The date and time of the next hearing shall be announced by the judicial secretariat, once the AC is enabled the acquaintance with the information of the law enforcement agencies.
