Today on 13.04.2021, at 10:00, the Appeal Chamber held the public hearing on the case (JR) 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner filed against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

Pursuant to the tasks assigned by the trial panel in the hearing of March 18, 2021, the legal representative of the assessee submitted in the form required by law the acts that were not accepted as evidence in that hearing. Based on Article F, paragraph 3 of the Annex of the Constitution and Article 45 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, in today’s hearing the trial panel decided to accept these acts in the quality of evidence.

When asked by the presiding judge whether the Public Commissioner would be able to answer in today’s hearing about the content of the acts filed by the assessee, the Public Commissioner asked for some time within reasonable limits, as he considered that these acts affect some appeal grounds and therefore should be reviewed, specifically in relation to each one of them. Also, the Public Commissioner requested from the Appeal Chamber that all the acts accepted as evidence be made officially available in the form required by law.

Upon consultation on the spot, in response to the request of the Public Commissioner, the trial panel decided to adjourn the public hearing on 22.04.2021, at 10:30. On this hearing, the Public Commissioner shall state his position regarding the evidence administered during the hearing of 18 March 2021 and 13 April 2021, which shall be officially made available to the Appeal Chamber. Until the next hearing, the assessee shall have the opportunity to submit with an Apostille stamp some acts that are expected to come from Greece for the purpose of the case review.

The public hearing shall take place at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3 Tirana.
