Announcement of decision

Today, on 16.06.2023, at 10:00, the Appeal Chamber opened the public hearing for the announcement of the decision in case (JR) 36/2023, dated 26.07.2023, pertaining to the appeal of the assessee Hyrjet Lamaj against decision no. 668, dated 26.05.2023, of the Independent Qualification Commission.

Before the announcement of the decision, the presiding judge, on behalf of the trial panel, informed the court as follows:

On 15.06.2025, the assessee forwarded electronically to the AC a request, through which he demanded the reopening of the judicial investigation of the case in order to submit some new evidence attached to the request, of direct relevance to the re-evaluation of the legitimacy of the source of income of his related person. This request of the assessee was also filed with the AC via post mail.

In the previous hearing dated 11.06.2025, it was announced that the decision on the case was taken on 09.06.2025, consequently this request will not be subject to consideration in this judicial proceedings, but the assessee will receive an administrative response with its regard.

Subsequently, the trial panel announced the decision taken on 09.06.2025, regarding the case (JR) 36/2023, dated 26.07.2023, pertaining to the assessee Hyrjet Lamaj:

The trial panel of the Appeal Chamber, consisting of judges Albana Shtylla, presiding, Natasha Mulaj, rapporteur, Mimoza Tasi, Rezarta Schuetz, Sokol Çomo, members, announced the decision on case (JR) no. 36/2023, dated 26.07.2023, pertaining to the appeal of the assessee Hyrjet Lamaj against decision no. 668, dated 26.05.2023 of the Independent Qualification Commission.

At the conclusion of the trial, the trial panel, pursuant to Article 66, paragraph 1 (a) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a majority vote, decided:

1. Upholding decision no. 668, dated 26.05.2023, of the Independent Qualification Commission, related to the assessee Hyrjet Lamaj.

2. This decision is final and effective immediately.
