The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

4 Public hearing Public hearing 00:00 2019.11.04 The Appeal Chamber held on 16.10.2019, at 12:00 h, the public hearing of case (JR) no. 33/2018, dated 12.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 58 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Besnik Muçi. During this hearing the parties debated with regard to the probative value of a declassified communication, decided to be collected as evidence in the preceding hearing. Following several questions to the assessee, the adjudication panel decided to request additional information to the Prosecution office at Serious Crimes First Instance Court, Tirana, and Prosecution office at the First Instance Court, Tirana, which it considered necessary for the case. Considering the time required to the respective institutions to respond to the requests, the adjudication panel decided to adjourn the hearing on 04.11.2019, at 10:00 h. During this hearing the parties made their respective observations on the responses of the Prosecution office at Serious Crimes First Instance Court, Tirana, and Prosecution office at the First Instance Court, Tirana with regard to the additional information considered necessary for the case, requested by the adjudication panel at the previous hearing. The assessee, after submitting a few submissions, requested the adjudication panel the collection of some new evidences, to the purpose of the review of the case. The panel decided to not allow the collection as evidence of the acts in Greek and Turkish languages, as they were not legalized diplomatically or having an apostille, whereas it allowed the collection as evidence of the other written acts.With regard to the acts collected as evidence, the adjudication panel requested the Public Commissioner to submit an assessment of them in the next hearing, scheduled to be held on 07.11.2019, at 09:30 h. During today’s hearing the Public Commissioner stated his position with regard to the evidences submitted by the assessee at the previous hearing.
