All day 2025.05.05 The Appeal Chamber held on 09.04.2025, at 10:00, the public hearing of case (JR) 25/2024, dated 03.07.2024, pertaining to the appeal of the Public Commissioner against decision no. 760, dated 26.04.2024 of the Independent Qualification Commission, related to the assessee Ardiana Bera. The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199 of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office, Mr. Adnan Xholi, present at the hearing. During the submission of the appeal grounds for the asset and proficiency assessment criteria, the representative of the Special Prosecution Office stated that he shares an opposite opinion with the Independent Qualification Commission that has confirmed in office the assessee. He considered that the assessee fails to prove the legitimacy of the sources of creation of the assets, and requested the Chamber to take into consideration in the overall evaluation of the case the way in which the assessee handled a case during the exercise of his office, which the Independent Qualification Commission did not consider during the administrative process, as it considered the case still pending. Mr. Xholi requested the Chamber that, after taking into consideration the appeal grounds, decides the amendment of decision no. 760, dated 26.4.2024, of the Independent Qualification Commission and the dismissal from office of the assessee Ardiana Bera. The legal representative and the assessee objected to the appeal grounds and in support of their claims submitted additional documents, which they requested the trial panel to accept them as evidence. With respect to the proficiency assessment, the assessee stated that the request of the representative of the Special Prosecution Office should not be part of the examination of the case, since there is no inherent appeal ground in this context. Nevertheless, the assessee, Ms. Bera, provided explanations regarding her position on the judicial case. The presiding judge announced that there are several complaints filed with the Chamber, which had been forwarded to the parties. The representative of the Special Prosecution Office considered that these complaints contain no grounds for further investigation. The assessee, being in agreement with the aforementioned position, submitted additional evidence to prove the contrary of the claims raised in these complaints. Subsequently, to the purpose of the examination of the case, the representative of the Special Prosecution Office and the assessee responded to several questions of the rapporteur of the case. After being consulted, the trial panel decided: – to accept as evidence the information and its accompanying document issued by the construction company of the apartment owned by the assessee; – to not accept as evidence the documentation of the income of the brother of the assessee in UK, as it is not in the form required by law; – to not investigate further the complaints, as they fail to meet the criteria of Article 53 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, after hearing as well the position of the representative of the Special Prosecution Office with their regard. Given that the parties had no procedural requests, the trial panel decided to close the judicial investigation and invited the parties to submit their final conclusions at the next hearing, which will be held on 05.05.2025, at 12:30. All day 2025.05.06 The Appeal Chamber held on 06.05.2025, at 10:00, the public hearing of case (JR) 24/2024, dated 01.07.2024, pertaining to the appeal of the Public Commissioner against decision no. 744, dated 19.03.2024 of the Independent Qualification Commission, related to the assessee Artan Hajredinaj. The presiding judge informed that during the period between the previous hearing, dated 28.04.2025 and today’s hearing, two denunciations had been registered with the Chamber, already forwarded to the parties. In their regard, the representative of the Special Prosecution Office, Mr. Klodian Braho, stated that they are reiterations and do not contain any relevant data for the vetting process. The assessee also shared the same position. During the submission of the final conclusions, the representative of the Special Prosecution Office stated that he stands by the appeal grounds for the asset assessment and that he partially stands by the appeal grounds for the proficiency assessment criterion. Mr. Klodian Braho stated that the assessee is found in terms of inaccurate and insufficient declaration and fails to justify his assets with legal sources. With regard to the proficiency assessment criterion, the representative of the Special Prosecution Office maintained that for three out of seven complaints, the assessee failed to prove the opposite of the complaints and that the cases’ circumstances remain the same. Meanwhile, for the two cases referred to by the law enforcement agencies and one case with a potential conflict of interest, the representative of the Special Prosecution Office assessed that no issues were found in the decision-making of the assessee. Finally, Mr. Klodian Braho requested the amendment of decision no. 744, dated 19.03.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Artan Hajredinaj. The legal representative of the assessee opposed the appeal, considering it unfair in relation to the investigated facts and unsupported by facts and law. The legal representative of the assessee requested the Chamber to take into account the fact that the inaccuracies in the declaration of assets and the cases addressed within the framework of the proficiency criteria in reference to the denunciations, based also on the principle of proportionality, contain no such elements that could affect the positive assessment of the assessee and his confirmation in office. The legal representative finally requested the Appeal Chamber the upholding of decision no. 744, dated 19.03.2024, which confirmed in office the assessee Artan Hajredinaj. After hearing the final conclusions of the parties, the trial panel withdrew in chambers to make the final decision, which it will announce on 14.05.2025, at 15:00. All day 2025.05.20 The Appeal Chamber held on 05.05.2025, at 12:30, the public hearing of case (JR) 25/2024, dated 03.07.2024, pertaining to the appeal of the Public Commissioner against decision no. 760, dated 26.04.2024 of the Independent Qualification Commission, related to the assessee Ardiana Bera. The presiding judge informed that in the period between the previous hearing dated 09.04.2025 and today’s hearing, namely, on 30.04.2025, the assessee, Ms. Ardiana Bera has forwarded to the Chamber several new documents related to her brother’s income from his employment in UK and requested the reopening of the investigation, with the aim of their administration. The representative of the Special Prosecution Office, Mr. Adnan Xholi, after confirming his acquaintance with them, submitted his stand on accepting the request of the assessee for reopening the investigation and accepting as evidence the lodged documents that, according to him, are in the form required by law. After being consulted, the trial panel decided to reopen the judicial investigation and accept as evidence the new documents. After closing the judicial investigation, the trial panel invited the parties to file their final conclusions. The representative of the Special Prosecution Office stated that even after the submission of the new evidence, the assessee failed to prove the opposite of the appeal regarding the asset assessment criterion, whereas with regard to the proficiency assessment, he maintained that the manner in which the assessee has managed a judicial case during the exercise of her office and the deficiencies in legal knowledge affect public confidence in the justice system. Finally, the representative of the Special Prosecution Office requested the Chamber the amendment of decision no. 760, dated 26.04.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Ardiana Bera. The legal representative of the assessee stated that the representative of the Special Prosecution Office, during the submission of the final conclusions, brought additional arguments, deviating from the previous position regarding both asset and proficiency assessment criteria. The legal representative requested additional time to restructure the position, a request that was not accepted by the trial panel, arguing that each of the parties may present a position unconditional from the position of the other party. In continuation of the final conclusions, the legal representative of the assessee requested the Chamber the dismissal of the appeal, as it was made on a subjective assessment, and it is unfounded in evidence and law. The legal representative held that the new evidence lodged during the AC proceedings proves that the assessee reaches a reliable level in the asset assessment, while according to her, the case taken as a reference in the context of the proficiency assessment contains no concrete, factual circumstances or errors that could influence a negative assessment in this criterion, much less the violation of trust in the justice system. Finally, the assessee requested the Chamber the upholding of decision no. 760, dated 26.04.2024 of the Independent Qualification Commission. After hearing the final conclusions of the parties, the panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 20.05.2025, at 13:00.
