Pursuant to Article 24 of Law no. 119/2014 “On the right to information, steps to be followed file a complaint to the Commissioner are:

  1. Every person, when he/she deems that his/her rights provided by this law have been violated, has the right to file an administrative complaint to the Commissioner for the Right to Information and Personal Data Protection, in accordance with this law and the Code of Administrative Procedures.
  2. The administrative complaint to the Commissioner for the Right to Information and Personal Data Protection is made within 30 working days from the day when: a) the complainant’s request for information has been refused; b) the deadline provided in this law for providing information has passed.
  3. Once receiving the complaint, the Commissioner for the Right to Information and Personal Data Protection forwards it to the structure dealing with the right to information, which verifies the facts and the legal basis of the complaint. Based on this, he may request the applicant and the public authority against which the complaint has been lodged to submit written submissions, as well as to be informed by any other person or source. When deemed necessary, the Commissioner holds a public hearing with the participation of the parties.
  4. The Commissioner for the Right to Information and Personal Data Protection makes a decision on the complaint within 15 working days from the day the complaint was submitted.
