The Appeal Chamber held on 17 June 2019 the next public hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.
During today’s hearing, the adjudication panel dismissed the request of the assessee to determine the standard of proof of all deposited acts, in terms of Articles 32/2 and 52/2 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, stating that following their analysis in details it shall make a statement with their respect in the final decision.
The assessee stated that she has noticed bias of the adjudication panel during the trial and consequently, she shall file a request for the recusal of its panel members. The chair of the hearing stated that until this request be formalized in the form required by law, the review of the case shall not be suspended but, under Article 75, last paragraph, of the Civil Procedure Code, its examination shall continue.
With regard to the financial analysis conducted by the Appeal Chamber, the assessee held that besides the fact that it contains inaccuracies, it exceeds even the appeal of the Public Commissioner, whereas the latter considered that the results of this analysis indicate the lack of lawful resources of the income of the assessee.
The adjudication panel concluded the judicial review and invited the parties to submit their final conclusions with regard to the case at trial in the hearing to be held on 02.07.2019, at 13:30 h.
