The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process.
Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process.
The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

On 13.01.2025 the Appeal Chamber held the public hearing of case (JR) 26/2022, dated 16.06.2022, pertaining to the appeal of the assessee Eriselda Bala against decision no. 523, dated 07.04.2022 of the Independent Qualification Commission.
In order to accurately and completely ascertain the factual situation related to the payment of the price of the apartment owned by the assessee, located in the city of Tirana, the assessee and her legal representative presented their submissions on the method of making payments and the time of their making for the apartment in question, submitting as well written acts which the legal representative of the assessee requested to be collected as evidence.
Subsequently, the assessee and her legal representative responded the questions of the International Observer of the International Monitoring Operation, regarding the relations of the assessee with the apartment construction company, and a second-tier bank, in order to clarify the circumstances of the case.
After being consulted, the trial panel decided to open the judicial investigation of the case and to accept the acts identified in this judicial hearing by the legal representative of assessee. Afterwards, the trial panel decided to close the judicial investigation of the case, requesting the assessee to provide her final position on the case.
The assessee Eriselda Bala, at the conclusion of the hearing, requested the amendment of the decision no. 523, dated 07.04.2022 of the Independent Qualification Commission, and confirmation in the office of prosecutor at the Prosecution Office at the First Instance Court of General Jurisdiction in Tirana.
The trial panel withdrew in chambers to make the final decision on the case, to be announced on 16.01.2025, at 15:00.

On 14.01.2025, at 10:00, the Appeal Chamber held the public hearing of case (JR) 10/2022, dated 15.02.2022, pertaining to the appeal of the Public Commissioner against decision no. 479, dated 03.12.2021 of the Independent Qualification Commission, related to the assessee Arben Dosti.
The presiding judge informed that the constitutional term of the Public Commissioners has ended and under such circumstances, pursuant to Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199, paragraph 2 of the Civil Procedure Code, the trial panel decided to transfer the procedural transfer of the party at trial from the “Public Commissioner” to the “Head of the Special Prosecution Office”, for the further continuation of the trial of the case.
The presiding judge informed that the trial panel had been acquainted with the information of the law enforcement agencies, which was also notified to the Independent Qualification Commission in the framework of the vetting process for the assessee Arben Dosti.
In accordance with the tasks assigned by the trial panel with the interim decision of the hearing dated 19.12.2024, the assessee had filed documentation with the Chamber with regard to the three denunciations, forwarded to the Head of the Special Prosecution Office, who confirmed their receipt. Also, a new denunciation, received by the Chamber a day before, was forwarded to the parties.
Referring to the acts, the assessee challenged the claims raised in the denunciations, while his legal representative requested the Chamber that, if the explanations of the assessee are considered insufficient, to invest in obtaining the files of the cases under review with the High Court and in two Courts of Appeal of General Jurisdiction, related to the denunciations.
Subsequently, the assessee responded to several questions of the rapporteur, to the purpose of the consideration of the case.
With regard to the new denunciations, the Head of the Special Prosecution office held that it contain no sufficient facts or circumstances for further investigations or that may affect the appeal grounds for the proficiency assessment criterion.
After being consulted, the trial panel decided:
• To accept as evidence the documents filed by the assessee related to the denunciations.
• To dismiss the request of the assessee to address the High Court and the two Courts of Appeal of General Jurisdiction, since the documents that could be forwarded are considered unnecessary in the context of the further examination of this case.
The assessee submitted, in the form required by law, a document from Greece on his judicial status, regarding which the Head of the Special Prosecution Office stated that it appears correct from a formal point of view.
The trial panel decided to administer this document as evidence as well.
The assessee repeated his requests submitted in previous hearings, related to the background assessment criterion: acquaintance with the CISD report to express his position regarding the information contained therein and the verification of his fingerprints. With respect to these requests, the Head of the Special Prosecution Office stated that they should be dismissed, as the trial panel expressed its opinion in their regard in the hearing dated 19.12.2024 and there were no new circumstances to reconsider them.
The presiding judge stated that the trial panel maintains the same position previously expressed regarding these requests.
Subsequently, the trial panel decided to close the judicial investigation of the case and invited the parties to submit their final conclusions in the next hearing to be held on 27.01.2025, at 11:00.

On 21.01.2025, at 10:00, the Appeal Chambe held the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi.
During the verification of the presence of the parties, the presiding judge announced the attendance of the Head of the Special Prosecution Office, whose presence in this trial was legitimized under Article 179/b, paragraph 8 of the Constitution of the Republic of Albania, a provision that determined the transfer of competences from the Public Commissioner to the Head of the Special Prosecution Office.
The Head of the Special Prosecution Office submitted the appeal grounds for all three assessment criteria: Mr. Altin Dumani held that the assessee has failed to dispel the burden of proof for the asset assessment criterion, as has made an incorrect and insufficient declaration and lacks legitimate sources to create his assets; with respect to the background assessment, he maintained that the assessee has failed to correctly complete the background declaration form and has made an insufficient declaration with this regard, and he also requested the trial panel to take into consideration in the overall evaluation of the case certain circumstances described in the appeal grounds that could lead to a potential conflict of interest of the assessee during the exercise of his office and a jeopardizing of the public trust.
The Head of the Special Prosecution Office, referring to the denunciations filed against assessee, requested the Chamber the consideration of certain circumstances that affect the conduct of the magistrate and the professional assessment criteria. The Head of the Special Prosecution Office requested the amendment of decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, and the dismissal from office of the assessee Valentin Preçi.
The legal representative and the assessee submitted in detail their objections regarding the appeal grounds for the three assessment criteria, considering them unfounded in law and evidence, unfair and guided by an erroneous logic. In support of their claims, the assessee and the legal representative lodged also several acts, which they requested the trial panel to collect them as evidence.
The Head of the Special Prosecution Office stated that from a formal point of view, the acts meet the legal criteria to be admitted as evidence.
The trial panel, after being consulted, decided to open the judicial investigation to allow the admission as evidence of all acts submitted by the assessee.
Subsequently, the assessee responded to several questions of the Head of the Special Prosecution Office and the observer of the International Monitoring Operation to the purpose of the consideration of the case.
The presiding judge informed that during today’s hearing, a new denunciation against the assessee had been filed with the Chamber and that it would be made available to the parties. During the
next hearing to be held on 05.02.2025, at 09:00, the parties shall have a stand with respect to this denunciation, and shall need to be prepared for the final conclusions of the case.

On 27.01.2025, at 09:00, the Appeal Chamber held the public hearing of case (JR) 23/2022, dated 30.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 524, dated 08.04.2022 of the Independent Qualification Commission, related to the assessee Elfrida Bregova.
During the verification of the presence of the parties, the presiding judge announced the attendance of the Head of the Special Prosecution Office, whose presence in this proceedings was legitimated under Article 179/b, paragraph 8 of the Constitution of the Republic of Albania, a provision that determined the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office.
During the submission of the appeal grounds, the Head of the Special Prosecution Office requested the Chamber to open the judicial investigation of the case, to request and administer additional documents from the construction company of the apartment declared by the assessee and the person related to her, as well as an updated report from AKSIK regarding the background assessment criteria.
The assessee and the legal representative submitted objections regarding the appeal grounds and in support of their claims, filed acts, which they requested the trial panel to collect them as evidence.
Following several questions from the international observer of the International Monitoring Operation, in terms of the consideration the case, and the respective responses of the assessee and her legal representative, the trial panel decided:
– To accept as evidence the acts submitted by the assessee;
– To administer information from the construction company, regarding the actions carried out by the company for the apartment declared by the assessee and the person related to her, as well as to clarify the payment method, the time the payments were made, the respective amounts and the persons who have made them;
– To request from AKSIK the update of the report dated 02.11.2017, in order to administer the information from the verification institution whose data were not taken into consideration during the drafting of the first report.
Pending the arrival of the information at the Special Appeals Chamber and its forwarding to the parties, the trial panel decided to postpone the next hearing to 19.02.2025, at 10:00.
The presiding judge announced that the parties will be forwarded a denunciation received by the Chamber in August 2024, regarding which they must take a position at the next hearing.

On 27.01.2025, at 11:00, the Appeal Chamber held the public hearing of case (JR) 10/2022, dated 15.02.2022, pertaining the appeal of the Public Commissioner against decision no. 479, dated 03.12.2021 of the Independent Qualification Commission, related to the assessee Arben Dosti.
The assessee, at the initiation of today’s hearing scheduled for the submission of the final conclusions, requested the trial panel the reopening of the judicial investigation of the case, to the purpose of accepting as evidence certain documents which, he had not managed to obtain in a timely manner due to the objective impossibility.
With regard this request of the assessee, the Head of the Special Prosecution Office held that we are not found in circumstances to reopen the investigation and requested its dismissal.
The trial panel decided to revoke the decision to close the judicial investigation of the case and reopen it, accepting as evidence the acts filed by the assessee.
Following the closure of the judicial investigation, the parties were invited to submit their final conclusions.
The Head of the Special Prosecution Office, Mr. Altin Dumani, stated that the assessee has made an incorrect and insufficient declaration and failed to prove the legal source of the creation of his assets. With regard to the background assessment criterion, the Head of the Special Prosecution Office assessed that even during the judicial process held at the Chamber, the AKSIK report on the background assessment for the assessee remains the referred act, insofar as it contains a finding. Requesting that the circumstances debated during this proceedings regarding the proficiency assessment be taken into consideration by the Chamber in the context of the assessment of the three criteria, the Head of the Special Prosecution Office finally requested the amendment of decision no. 479, dated 03.12.2021, of the Independent Qualification Commission and the dismissal from office of the assessee Arben Dosti.
The assessee provided explanations on the issues referred to in the appeal grounds for the three vetting criteria, claiming their opposite. In conclusion of his objections, the assessee finally requested his confirmation in office.
After hearing the final conclusions of the parties, the trial panel decided to withdrew in chambers to make the final decision, to be announced on 13.02.2025, at 15:00.

Today, on 30.06.2023, at 11 h, was held the session for the election of the President of the Special Appeal Chamber, who shall exercise this office for a 3-year mandate, as of 27.07.2023.
Upon the secret ballot procedure, which took place in the presence of the international observers of the International Monitoring Operation, the candidate Mr. Sokol Çomo was unanimously elected.
This result was approved upon the decision of the Meeting of Judges no.60, dated 30.06.2023.
Mr. Sokol Çomo shall take the office of the President of the Appeal Chamber on 27.07.2023, when the term of the incumbent President Mrs. Albana Shtylla shall terminate.
