The adjudication panel of the Appeal Chamber, chaired by Natasha Mulaj, case rapporteur Rezarta Schuetz, and members Albana Shtylla, Ina Rama and Luan Daci, announced today the decision of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

Following the financial analysis carried out by the Appeal Chamber, the adjudication panel concluded that the assessee did not justify upon lawful sources the expenditures and savings stated during the time period 2007 – 2016, comprising in the calculations all Public Commissioner’s requests.

Finally, on the basis of the above conclusions, pursuant to Article D, paragraphs 1, 3 and 5 of the Annex to the Constitution, Article 33, paragraph 5, item ’b’, and Article 61, paragraph 3, of Law no. 84/2016, it considers that decision no. 32, dated 05.07.2018 of the Independent Qualification Commission must be amended.

For these reasons, the adjudication panel of the Appeal Chamber, based on the facts proven at trial and law applicable to the case, under Article 66, paragraph 1, item ‘b’, of Law no. 84/2016, unanimously decided:

  1. Amendment of decision no. 32, dated 05.07.2018 of the Independent Qualification Commission, deciding the dismissal from office of the assessee Alma Brati, judge at Tirana Judicial District Court.
  2. This decision is final and effective immediately.
