The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

    On 05.02.2025, at 09:00, the Appeal Chamber held the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024, of the Independent Qualification Commission, related to the assessee Valentin Preçi.

    The presiding judge informed that yesterday, the parties had been informed of a finding submitted with the Appeal Chamber by the Observer of the International Monitoring Operation, as well as a new public denunciation, on which they were requested to make a stand. The Head of the Special Prosecution Office and the legal representative representing the assessee in today’s hearing confirmed the receipt of the acts.

    The legal representative of the assessee stated that the assessee and herself had been notified with the above-mentioned acts, but requested time to be acquainted with their content and to take a position.

    The parties continued with the submission of their positions on another denunciation, in continuation of the task assigned by the trial panel during the previous hearing.

    The Head of the Special Prosecution office stated that he had been acquainted with both denunciations, for which he assessed that they contain no grounds for further investigations.

    The legal representative of the assessee submitted her position only on the first denunciation, underlining that the assessee had previously provided explanations with the Independent Qualification Commission, and that this denunciation did not contain elements for the need for further investigation.

    In order to provide the assessee and the legal representative sufficient time to be acquainted with and take a position regarding the finding of the International Monitoring Operation and the new denunciation, the trial panel decided to postpone the hearing to 13.02.2025, at 13:00.

    The Appeal Chamber held on 13.02.2025, at 13:00, the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi.

    The legal representative of the assessee submitted several new acts to challenge the appeal grounds related to the potential conflict of interest of the assessee during the exercise of his office. With regard to the denunciations, she held that she shares the same position with the Head of the Special Prosecution Office during the previous hearing, that they contain no sufficient grounds for further investigations.

    With respect to the finding of the observer of the International Monitoring Operation, the legal representative requested the Chamber to consider inapplicable the written acts referred to as the basis for this finding, since according to her, they were administered beyond the powers provided for a subject not sanctioned in the Constitution and law. Consequently, she also assessed the finding as an opinion raised in the capacity of evidence under this sanction, requesting that the finding be excluded from the evaluation and judicial debate at this stage of the trial.

    With regard to the substantive part of the finding, the legal representative claimed the opposite of the circumstances described therein, submitting several new acts in support of her claims.

    Questioned by the presiding judge, the Head of the Special Prosecution Office, Mr. Altin Dumani, took a stand in favor of the admission as evidence of the acts related to the potential conflict of interest, while assessing the administration of acts related to the finding as unnecessary. As for the latter, the Head of the Special Prosecution Office maintained that the evidence shows circumstances different from those described by the assessee and that the trial panel should considered it as evidence that proves a behavior of the assessee contrary to the ethics of a magistrate.

    After being consulted, the trial panel decided:

    – To accept as evidence the finding of the observer of the International Monitoring Operation and its accompanying documentation;

    – to accept as evidence the acts filed during this hearing by the legal representative of the assessee;

    – to not investigate the public’s complaints, as they contain no sufficient circumstances for further investigation.

    Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to submit their final conclusions at the next hearing, to be held on 18.02.2025, at 09:00.

    The Appeal Chamber held on 18.02.2025, at 09:00, the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi.

    During the submission of the final conclusions, the Head of the Special Prosecution office stated that during the trial held at the Appeal Chamber, the assessee failed to prove the opposite of the appeal grounds for all three vetting criteria. Mr. Dumani held that the assessee has made an incorrect and insufficient declaration and failed to prove the legitimate source of creation of his assets. With regard to the background assessment criterion, the Head of the Special Prosecution office maintained that the assessee has made an insufficient declaration, while regarding the proficiency assessment criterion, namely the conflict of interest, he stated that there are circumstances that affect the behavior of the assessee during the exercise of his office and that are contrary to the conduct and ethics of the magistrate.

    Finally, the Head of the Special Prosecution office requested the Chamber the amendment of decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, and the dismissal from office of the assessee Valentin Preçi.

    The legal representative of the assessee challenged the appeal and finally requested the Appeal Chamber its dismissal, upholding decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi, as a decision supported entirely on law and evidence and on the principle of objectivity, proportionality and impartiality.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, to be announced on 26.02.2025, at 15:00.

    On 19.02.2025, at 10:00, the Appeal Chamber held the public hearing of case (JR) 23/2022, dated 30.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 524, dated 08.04.2022 of the Independent Qualification Commission, related to the assessee Elfrida Bregova.

    The presiding judge informed the parties that following the previous hearing, additional information and documentation were requested to the construction company of the apartment declared by the assessee and the person related to her, but there was no response provided, even though all available forms of communication were used.

    The presiding judge also announced that following the request of the Appeal Chamber to the AKSIK to forward the updated report regarding the background assessment criteria of the assessee, this authority has forwarded it, but as a classified document. The Chamber has reiterated the request that for purposes of the judicial process, AKSIK makes available the declassified report, so that it may be forwarded for acquaintance to the assessee.

    When questioned about his position regarding this situation, the Head of the Special Prosecution office stated that taking into account that the information and documentation requested by the construction company, but also from the AKSIK, are considered necessary for the case, the court should wait for the respective responses.

    The assessee also shared the same position with the Head of the Special Prosecution office.

    With regard to a public denunciation, the Head of the Special Prosecution Office maintained that it contains no circumstances that could affect the case under trial and, consequently, further investigations are not necessary. After hearing the position of the assessee on this denunciation, the trial panel decided not to investigate further, as it contains no grounds for further investigations, according to Article 53 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    After being consulted, the trial panel decided to adjourn the hearing on 05.03.2025, at 13:00, pending responses from the construction company and AKSIK. During this hearing, if the requested documents have been forwarded to them, the parties should also be prepared for the final conclusions.

    The Appeal Chamber held on 18.02.2025, at 09:00, the public hearing of case (JR) 19/2024, dated 29.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi.

    During the submission of the final conclusions, the Head of the Special Prosecution office stated that during the trial held at the Appeal Chamber, the assessee failed to prove the opposite of the appeal grounds for all three vetting criteria. Mr. Dumani held that the assessee has made an incorrect and insufficient declaration and failed to prove the legitimate source of creation of his assets. With regard to the background assessment criterion, the Head of the Special Prosecution office maintained that the assessee has made an insufficient declaration, while regarding the proficiency assessment criterion, namely the conflict of interest, he stated that there are circumstances that affect the behavior of the assessee during the exercise of his office and that are contrary to the conduct and ethics of the magistrate.

    Finally, the Head of the Special Prosecution office requested the Chamber the amendment of decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, and the dismissal from office of the assessee Valentin Preçi.

    The legal representative of the assessee challenged the appeal and finally requested the Appeal Chamber its dismissal, upholding decision no. 730, dated 10.01.2024 of the Independent Qualification Commission, related to the assessee Valentin Preçi, as a decision supported entirely on law and evidence and on the principle of objectivity, proportionality and impartiality.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, to be announced on 26.02.2025, at 15:00.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
