The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Appeal Chamber held today, on 12.12.2018, the public hearing of case (JR) no. 10/2018, dated 31.07.2018, corresponding to the appeal of the Public Commissioner against decision no. 24, dated 13.06.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Bashkim Dedja.

    During the hearing the Public Commissioner submitted the appeal grounds whereas the assessee submitted his objections to the appeal filed by the Public Commissioner and requested the Appeal Chamber to review in the capacity of evidences several documents that he filed with the adjudication panel.

    Following the deliberations, the adjudication panel considered the evidences as not necessary and returned them back to the assessee.     The Appeal Chamber held on 17.12.2018, the public hearing of case (JR) no.9/2018, dated 19.07.2018, corresponding to the appeal of the Public Commissioner against decision no.22, dated 07.06.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Edmond Islamaj.

    The Public Commissioner and the assessee reviewed in this hearing the evidentiary value of the evidences that the adjudication panel had decided to be collected upon its interim decision dated 17.12.2018.

    The Public Commissioner requested the investigation of some other facts and obtaining some other evidences, which the adjudication panel rejected, pursuant to Article 49, paragraph 6, items ‘a’ and ‘b’, of Law no. 84/2016.

    In order to provide the assessee the necessary time to explain and prove the acquisition manner of the sale price of vehicle “Range Rover”, license plate AA…, the adjudication panel decided to adjourn the hearing on Thursday, 20.12.2018, at 09:30 hrs.

    The adjudication panel of the Appeal Chamber, chaired by Mr. Ardian Hajdari, rapporteur  Mr. Luan Daci and members Ms. Albana Shtylla, Ms. Natasha Mulaj, and Ms. Rezarta Schuetz, pursuant to Article 59, paragraph 1, item ‘a’, and Article 61, paragraph 3, of Law no. 84/2016, considers that the assessee Bashkim Dedja did not achieve a trustable level of asset assessment.

    For this reason, the adjudication panel of the Appeal Chamber, pursuant to Article D, paragraphs 1, 3 and 5, of the Annex to the Constitution, Article 61, paragraph 3, and Article 66, paragraph 1, item ‘b’, of Law no. 84/2016, on the basis of the facts proved in trial and applicable law on the case, decided:

    1. Modification of decision no. 24 dated 13.06.2018 of the Independent Qualification Commission;
    2. Dismissal from office of the assessee, Mr. Bashkim Dedja, judge of the Constitutional Court.
    3. This decision is final and enters into force immediately.

    The Appeal Chamber held today, on 18.12. 2018, the public hearing of case (JR) no.13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

    Upon acquaintance with the written acts submitted by the assessee, the Public Commissioner specified his request: to open the judicial investigation and in view of the investigation to re-administer the evidentiary documentation from state institutions.

    Following the deliberations, the adjudication panel decided to open the judicial investigation, under Article F, paragraph 3, of the Annex to the Constitution and Article 45 of Law no. 84/2016, and administration of some documents from the state institutions with the purpose of clarification of information. Likewise, the adjudication panel decided to accept obtaining as evidence the documents submitted by the assessee.

    The next hearing shall be held on 31.01.2019, at 10:00 hrs.

    The assessee explained during the hearing the acquisition manner of the sale price of vehicle “Range Rover”, license plate AA…, submitting a notarial declaration of the seller, accepted as evidence by the adjudication panel.

    In order to provide the necessary time to the Legal Service Unit of the Appeal Chamber to assess the effect of the new evidences obtained until this stage of the proceedings to the financial analysis of the assessee, the adjudication panel decided to adjourn the hearing on Tuesday, 15.01.2019, at 12:00 hrs.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
