The Appeal Chamber held on July 2, 2019 the next public hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

During today’s hearing, the chair of the panel announced that an adjudication panel assigned by lot, upon its decision no. 13/8, dated 02.07.2019, ruled to dismiss the request of the assessee for the recusal from the review of the case of the case rapporteur.

Following the final conclusions of the parties, the adjudication panel decided to announce the final decision on Tuesday, 09.07.2019, at 09.00 h.

The Appeal Chamber held on July 3, 2019 the public hearing of case (JR) no. 30/2018, dated 06.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 43 dated 18.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Nertina Kosova.

The assessee responded in detail to the questions addressed in the previous hearing by the case rapporteur related to her factual financial situation, even though she considered these questions beyond the grounds of appeal of the Public Commissioner.

Following a request of the assessee, Ms. Nertina Kosova, to take in the capacity of evidence various written acts lodged by her in today’s hearing, and following the opinion of the Public Commissioner with regard to these new acts, the adjudication panel, to the purpose of adjudication of the case, decided to collect them as evidence.

In order to provide the necessary time to the Legal Service Unit to prepare the financial analysis requested by the Public Commissioner based on the new evidences, the adjudication panel decided to adjourn the hearing on July 12, 2019, at 10:30 h.

On Wednesday, July 24, 2019, at 10:00 h, the Appeal Chamber shall review in a public hearing case (JR) no. 35/2018, dated 23.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 65 dated 13.09.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Valbona Bala (Pajo).

The Appeal Chamber held on Monday, 17.06.2019, at 10:00 h, the public hearing of case (JR) no. 29/2018, dated 05.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 60 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentian Medja.

During today’s hearing the Public Commissioner submitted the appeal grounds related to the proficiency criterion, requesting the Appeal Chamber to draft a methodology to carry out, upon measurable objective indicators, a complete proficiency assessment of the assessee.

The assessee, Mr. Medja, submitted his arguments with regards to the counter-appeal filed against the appeal of the Public Commissioner, alleging it in violation of the law.

The assessee, after stating that the request of the Public Commissioner for carrying out the proficiency assessment on the basis of a specific methodology is contrary to constitutional principles, requested the Appeal Chamber to uphold decision no. 60, dated 01.08.2018 of the Independent Qualification Commission.

Due to the complexity of the case and due to objective reasons, the holding of another already scheduled public hearing, the hearing related to the assessee Gentian Medja was adjourned on 09.07.2019, at 10:00 h.

The adjudication panel of the Appeal Chamber, chaired by Natasha Mulaj, case rapporteur Rezarta Schuetz, and members Albana Shtylla, Ina Rama and Luan Daci, announced today the decision of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

Following the financial analysis carried out by the Appeal Chamber, the adjudication panel concluded that the assessee did not justify upon lawful sources the expenditures and savings stated during the time period 2007 – 2016, comprising in the calculations all Public Commissioner’s requests.

Finally, on the basis of the above conclusions, pursuant to Article D, paragraphs 1, 3 and 5 of the Annex to the Constitution, Article 33, paragraph 5, item ’b’, and Article 61, paragraph 3, of Law no. 84/2016, it considers that decision no. 32, dated 05.07.2018 of the Independent Qualification Commission must be amended.

For these reasons, the adjudication panel of the Appeal Chamber, based on the facts proven at trial and law applicable to the case, under Article 66, paragraph 1, item ‘b’, of Law no. 84/2016, unanimously decided:

1. Amendment of decision no. 32, dated 05.07.2018 of the Independent Qualification Commission, deciding the dismissal from office of the assessee Alma Brati, judge at Tirana Judicial District Court.
2. This decision is final and effective immediately.

The Appeal Chamber held on July 10, 2019 the public hearing of case (JR) no. 23/2018, dated 19.10.2018, corresponding to the appeal of the Public Commissioner against decision no. 46 dated 24.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Xhezair Zaganjori.

During today’s hearing the Public Commissioner submitted his assessment with regard to the formal terms and content of evidences that the assessee Xhezair Zaganjori lodged with the Appeal Chamber in the hearing dated June 25, 2019, and stated that he continues to stand by the grounds of appeal, without changing any circumstance thereof.

The assessee submitted additional comments on the submissions of the Public Commissioner made in the previous hearing, and supported them with a few written acts, requesting the adjudication panel to obtain them as evidence.

Then, the Public Commissioner, following an assessment of the acts lodged by the assessee during today’s hearing and reiterating that he stood by the grounds of appeal, requested the Appeal Chamber to make a statement with this regard.

The Public Commissioner and the assessee Xhezair Zaganjori debated over the value of the new evidences, submitting their claims with their respect.

Following the withdrawal for making the decision on the administration of the acts, the adjudication panel ruled to allow the collection as evidence of the acts submitted by the assessee in the hearing dated June 25, 2019, as well as during today’s hearing, dated July 10, 2019.

The adjudication panel declared the judicial review closed and invited the parties to submit their final conclusions with regard to the case at trial at the hearing scheduled to be held on 17.07.2019, at 14:00 h.

The Appeal Chamber held on July 11, 2019, at 10:00 h, the public hearing of case (JR) no. 36/2018, dated 04.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 61 dated 02.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentjan Osmani.

During today’s hearing the Public Commissioner submitted the appeal grounds, whereas the assessee submitted his objections to the appeal of the Public Commissioner and requested the adjudication panel to open the judicial review of the case and administer in the capacity of evidence a few new acts lodged by him during today’s hearing. The Public Commissioner requested the adjudication panel to take into consideration a new denunciation on the account of the assessee that the International Monitoring Operation has forwarded to the Public Commissioner and the latter included in the appeal grounds. Upon request of the case rapporteur, the Public Commissioner clarified the main elements of the denunciation, which the Chamber is requested to conduct a thorough investigation.

The adjudication panel, having withdrawn for decision-making, ruled to open the judicial investigation for the adjudication of the case and allow the collection as evidence of the acts filed by the assessee during today’s hearing. Also, in response to the requests for investigation of the Public Commissioner, to the purpose of investigation on this denunciation, the adjudication panel decided to request information from the General Prosecution office and data from TIMS system. As per above and to provide the necessary time to the Public Commissioner to make a statement with regard to the content of the evidences, the adjudication panel decided to adjourn the hearing on 15.07.2019, at 13:30 h. The Appeal Chamber held on July 12, 2019 the public hearing of case (JR) no. 30/2018, dated 06.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 43 dated 18.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Nertina Kosova.

During today’s hearing the adjudication panel made available to the assessee and Public Commissioner the financial analysis drafted by the Legal Service Unit of the Appeal Chamber upon request of the Public Commissioner. In order to provide the necessary time to the assessee and Public Commissioner to make a statement with regard to this analysis, the adjudication panel decided to adjourn the hearing on 19.07.2019, at 08:00 h.

The Appeal Chamber held on July 17, 2019 the public hearing of case (JR) no. 23/2018, dated 19.10.2018, corresponding to the appeal of the Public Commissioner against decision no. 46 dated 24.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Xhezair Zaganjori.

During today’s hearing the parties submitted their final conclusions with regard to the case under review. The Public Commissioner held that even after the examination of the new acts submitted during these proceedings, the assessee did not manage to reliably explain the lawful source of his assets and that his statements remained at declarative level.

The Public Commissioner requested the amendment of decision no. 46, dated 24.07.2018 of the Independent Qualification Commission and dismissal from office of the assessee, Mr. Xhezair Zaganjori.

The assessee Xhezair Zaganjori objected the conclusions of the Public Commissioner stating that all the data, facts, circumstances and the new evidences submitted by him during this process respond to all Public Commissioner’s appeal grounds.

The adjudication panel, following the final conclusions of the parties, decided to announce the final decision on Friday, July 26, 2019, at 11:00 h.

The Appeal Chamber held on July 17, 2019, at 10:00 h, the public hearing of case (JR) no. 29/2018, dated 05.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 60 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentian Medja.

During today’s hearing the Public Commissioner submitted his opinion on the draft-methodology drafted by the Appeal Chamber, considering it structurally complete, however, in order to consider it applicable in terms of appropriate investigation of the case, the following three assessment sources should be obtained in the capacity of evidence:

• the personal file of the magistrate, Mr. Gentian Medja;
• the opinion of the Chair of the First Instance Administrative Court of Tirana;
• written information from the School of Magistrates.

On the other hand, the assessee stated his objection to the usage of this draft – methodology for conducting the re-evaluation process with regard to the proficiency assessment, considering its elements as exceeding the Appeal Chamber powers, and appeal grounds.

Following withdrawal to make the decision, the adjudication panel decided to examine according to the request of the Public Commissioner, requesting the High Judicial Council to provide the following documentation:

• The personal file of the magistrate, Mr. Gentian Medja and the opinion of the Chair of the First Instance Administrative Court of Tirana;

And request to the School of Magistrates written information on the magistrate, the assessee Gentian Medja.

As per above, the adjudication panel decided to adjourn the hearing on July 26, 2019, at 13:00 h.

The Appeal Chamber held on 06.09.2019, at 10:00 h, the public hearing of case (JR) no. 34/2018, dated 13.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 62 dated 03.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Artur Malaj.

During this hearing the assessee stated his objections to the appeal of the Public Commissioner and requested the re-opening of the judicial investigation to collect as evidence several written documents submitted by him with the adjudication panel. The panel decided to re-open the judicial investigation and decided to collect as evidence the documents submitted by the assessee.

The panel ruled that the Chamber carries out a complete analysis related to the financial situation of the assessee from 2003 to 2016. Such analysis shall be forwarded to the parties within a due time, to enable the preparation of respective arguments for the next hearing scheduled to be held on September 25, 2019, at 10:00 h.

The Appeal Chamber held on July 24, 2019, at 10:00 h, the public hearing of case (JR) no. 35/2018, dated 23.11.2018, corresponding to the appeals of the Public Commissioner and assessee Valbona Bala (Pajo) against decision no. 65 dated 13.09.2018 of the Independent Qualification Commission that has ruled the termination of the transitional re-evaluation of the assessee Valbona Bala (Pajo).

During this hearing the adjudication panel decided to review both appeals simultaneously, the parties submitted their respective appeal grounds.

The Public Commissioner claimed that the IQC decision on the termination of the transitional re-evaluation of the assessee Valbona Bala (Pajo) is not fair, it does not exhaustively reason the specific nature of the legal status of the assessee, and it is made without verifying the free will to resignation of the assessee. Nevertheless, despite these claims, in view of the requests of the assessee in the appeal, the Public Commissioner requested the amendment of decision no. 65, dated 13.09.2018 of the Independent Qualification Commission, completing its enacting clause with the prohibition provided for in Article G, second paragraph, of the Annex to the Constitution.

The assessee stated that decision no. 65, dated 13.09.2018 of the Independent Qualification Commission on the termination of the re-evaluation is not reasoned, is not founded in evidences and it exceeds the legal powers of the Commission. Ms. Bala requested the Appeal Chamber the amendment of the decision no. 65, dated 13.09.2018 of the Independent Qualification Commission in its reasoning part, thereby removing the prohibition provided for in Article G, second paragraph, of the Annex to the Constitution.

Having decided to close the judicial review and following the submission of the final conclusions of the parties at trial, the adjudication panel withdrew to make the decision on the case, to be announced on 25.07.2019, at 13:30 h.

The Appeal Chamber held on July 24, 2019, at 13:30 h, the public hearing of case (JR) no. 36/2018, dated 04.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 61 dated 02.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Gentjan Osmani.

During the submission of the final conclusions the Public Commissioner stood by his request on the amendment of decision no. 61 dated 02.08.2018 of the Independent Qualification Commission and dismissal from office of the assessee Gentjan Osmani.

The assessee objected each appeal ground submitted by the Public Commissioner, based on all pieces of evidence filed by him during the trial, and requested the upholding of decision no. 61 dated 02.08.2018 of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the adjudication panel withdrew to make the decision, to be announced on 31.07.2019, at 10.00 h.

The adjudication panel of the Appeal Chamber, chaired by Ms. Ina Rama, case rapporteur Mr. Sokol Çomo, and members, Ms. Albana Shtylla, Mr. Luan Daci and Ms. Natasha Mulaj, announced today the decision on case (JR) 35/2018, dated 23.11.2018, corresponding to the appeals of the Public Commissioner and assessee Valbona Bala (Pajo) against decision no. 65 dated 13.09.2018 of the Independent Qualification Commission related to the re-evaluation of the assessee Valbona Bala (Pajo).

At the end of the adjudication, pursuant to Article G of the Annex to the Constitution, Article 66, paragraph 1, item ‘a’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously, decided:

1. To amend decision no. 65, dated 13.09.2018, of the Independent Qualification Commission, as follows:

Termination of the re-evaluation of the assessee Valbona Bala (Pajo).

The assessee Valbona Bala (Pajo) cannot be appointed judge or prosecutor at any level, as a member of the High Judicial Council or High Prosecutorial Council, High Justice Inspector or Prosecutor General for a duration of fifteen years.

2. This decision is final and effective immediately.

The Appeal Chamber held on July 26, 2019, at 13:00 h, the public hearing of case (JR) no. 29/2018, dated 05.11.2018, corresponding to the appeal of the Public Commissioner against decision no. 60 dated 01.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Gentian Medja.

During today’s hearing the chairperson of the adjudication panel introduced the documentation filed by the High Judicial Council and School of Magistrates in response to the request of the Chamber to these institutions.

In addition to these acts, the assessee requested the adjudication panel to collect in the capacity of evidence several acts filed by him, two of which, decisions of the High Council of Justice and High Judicial Council on the methodology of professional assessment, in the framework of the re-evaluation process.

The adjudication panel, to the purpose of case examination, decided to collect in the capacity of evidence all the acts filed during today’s hearing and take into consideration the above two decisions.

The Public Commissioner requested the Appeal Chamber to carry out a preliminary proficiency assessment of the assessee, based on the proposed methodology.

The adjudication panel decided to dismiss the request of the Public Commissioner and close the judicial review, inviting the parties to submit their final conclusions in the hearing dated 09.09.2019, at 10:00 h.

The adjudication panel of the Appeal Chamber, chaired by Ms. Natasha Mulaj, case rapporteur Ms. Ina Rama, and members, Ms. Albana Shtylla, Mr. Ardian Hajdari and Ms. Rezarta Schuetz, announced today the decision on case (JR) no. 36/2018, dated 04.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 61 dated 02.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Gentjan Osmani.

At the end of the adjudication, pursuant to Article 66, paragraph 1, item ‘b’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously, decided:

1. To amend decision no. 61, dated 08.2018, of the Independent Qualification Commission, dismissing from office the assessee Mr. Gentjan Osmani.
2. This decision is final and effective immediately.
