The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process.
Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process.
The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

The Appeal Chamber held on 03.03.2020, at 11:30 h, the public hearing of case (JR) no.13/2019, dated 27.02.2019 corresponding to the appeal of the Public Commissioner against decision no. 90, dated 20.12.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Adnand Kosova.
During the submission of the final conclusions, the Public Commissioner stood by the request for the amendment of the decision no. 90, date 20.12.2018 and dismissal from office of the assessee Adnand Kosova.

The Appeal Chamber held on 05.03.2020, at 08.30 h, the public hearing of case (JR) no. 40/2018, dated 18.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 63 dated 06.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Arben Dollapaj.
During the submission of the closing conclusions, the Public Commissioner stated that considering even the new evidences, the assessee did not manage to prove the contrary of the appeal grounds. The Public Commissioner stood by his request for the amendment of decision no. 63 dated 06.08.2018 of the Independent Qualification Commission and dismissal from office of the assessee Arben Dollapaj.
Responding to the submission of the Public Commissioner, the assessee, through his defense counsel, contradicted each appeal ground and requested the upholding of decision no. 63, dated 06.08.2018 of the Independent Qualification Commission.
After hearing the final conclusions of the parties, the adjudication panel withdrew to make the final decision, to be announced on 12.03.2020, at 10:00 h.

The Public Commissioner, during the submission of the appeal grounds, requested the Appeal Chamber the opening of judicial investigation and collection of respective evidences in support of the appeal. The Public Commissioner requested the amendment or upholding of decision no. 162 dated 19.06.2019 of the Independent Qualification Commission.
The assessee, Ms. Kajana, submitted her objections to each appeal ground, requesting the Chamber the opening of the judicial investigation and collection in the capacity of evidence of some acts filed by her during this hearing.
Following the submissions of the parties, the adjudication panel decided to open the judicial investigation of the case and allow the collection in the capacity of evidence of the acts filed by the assessee.
In view of the appeal grounds and judicial investigation of the case, the panel decided to request further information to the Fier District Court, Prosecution office at Fier District Court, General Prosecution office, Fier Municipality and Regional Tax Authority of Diber.

The Appeal Chamber held on 19.02.2020, at 10:00 h, the public hearing of case (JR) no. 10/2019, dated 29.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 86 dated 17.12.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Alma Kolgjoka.
During the submission of the grounds of the appeal related only to asset criteria, the Public Commissioner, through a preliminary request, required the Appeal Chamber to make a decision whether a family member of the assessee was to be qualified as other related person, and once the panel made a decision with regard to this qualification, he would comment on the request concerning investigations related to the case in question. The Public Commissioner requested the upholding or amendment of decision no. 86 dated 17.12.2018 of the Independent Qualification Commission.
The assessee rejected the appeal grounds of the Public Commissioner, considering them unfounded in law and evidences and required the upholding of IQC decision no. 46, dated 17.12.2018.
The Court held that with regard to the legal relationship between the assessee and her family member, and qualification of this person as other related person it cannot not make a statement at this stage of the trial, as this matter shall be considered in the final decision.
Subsequently, the Public Commissioner requested the panel to carry out a financial analysis to verify the legitimacy of the source of creation of property residential apartment in Tirana.
In view of the request of the Public Commissioner to conduct a financial analysis, in order to verify the relationship that the family members of the assessee had with property residential apartment in Tirana, the adjudication panel of the Chamber decided to open the investigation, seeking further information and submission of acts on concluded contracts and carried out payments to Water Supply Enterprise, Power Supply Enterprise, investing commercial and undertaking companies related to the construction of this apartment, as well as the National Notary Chamber, related to legal acts drafted in this respect.
As per above, the adjudication panel requested the assessee that if she considers necessary, she may submit possible arguments, evidences and explanations.
Pending the receipt of the above responses, the adjudication panel decided to adjourn the hearing on 25.03.2020, at 10:00 h.

Pursuant to the Meeting of Judges decision no. 6, dated 11.03.2020, paragraph 2, public hearing on case (JR) no. 10/2019, related to the assessee Alma Kolgjoka, scheduled to take place on Wednesday, 25.03.2020, at 10:00 am, shall be postponed until further notice.
The Appeal Chamber held on 06.03.2020, at 10:00 h, the public hearing of case (JR) no. 44/2019, dated 18.09.2019, corresponding to the appeal of the Public Commissioner against decision no. 162 dated 19.06.2019 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Manjola Kajana.
The Public Commissioner, during the submission of the appeal grounds, requested the Appeal Chamber the opening of judicial investigation and collection of respective evidences in support of the appeal. The Public Commissioner requested the amendment or upholding of decision no. 162 dated 19.06.2019 of the Independent Qualification Commission.
The assessee, Ms. Kajana, submitted her objections to each appeal ground, requesting the Chamber the opening of the judicial investigation and collection in the capacity of evidence of some acts filed by her during this hearing.
Following the submissions of the parties, the adjudication panel decided to open the judicial investigation of the case and allow the collection in the capacity of evidence of the acts filed by the assessee.
In view of the appeal grounds and judicial investigation of the case, the panel decided to request further information to the Fier District Court, Prosecution office at Fier District Court, General Prosecution office, Fier Municipality and Regional Tax Authority of Diber.
Pending the responses to the above requests, the adjudication panel decided to adjourn the hearing on 26.03.2020, at 09:30h.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.
Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.
This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.
Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
