The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

    Today, on 01.11.2021, at 14:00, the Appeal Chamber held the public hearing of the case (JR) 43/2020, dated 30.09.2020 regarding the appeal of the Public Commissioner filed against decision no. 273, dated 10.07.2020 of the Independent Qualification Commission, corresponding to the assessee Alkelina Gazidedja.

    The Public Commissioner stated that the four decisions of the High Inspector of Justice on cases adjudicated by the assessee, do not affect the appeal grounds related to the proficiency assessment criterion of the assessee.

    The assessee, Mrs. Gazidedja, filed her submission regarding a denunciation made available to her by the Appeal Chamber, as well as new acts in function of the case review, which the trial panel decided to accept them as evidence.

    Following the statements of the parties that they had no additional requests, the trial panel decided to conclude the judicial investigation of the case and invited the parties to submit their final conclusions.

    Given that the Public Commissioner requested for a reasonable time to prepare for the final conclusions, the trial panel decided to adjourn the public hearing on 09.11.2021, at 10:00.

    The trial panel of the Appeal Chamber, composed of judges, Ina Rama, presiding, Albana Shtylla rapporteur, Ardian Hajdari, Natasha Mulaj, Sokol Çomo, members, announced the decision on case (JR) no.2/2020, dated 09.01.2020, corresponding to the appeal of the assessee Ndini Tavani against decision no. 199, dated 11.10.2019 of the Independent Qualification Commission.

    At the conclusion of the hearing in chambers, the trial panel, pursuant to Article 66, para 1/b, of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, unanimously decided:

    1. Amendment of decision no. 199, dated 11.10.2019 of the Independent Qualification Commission, related to the assessee Ndini Tavani and his confirmation as prosecutor at the Prosecution office at Tirana Judicial District Court.
    1. This decision is final and effective immediately.

    Today, on 08.11.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 12/2021, dated 03.03.2021, corresponding to the appeal of the Public Commissioner against decision no. 324, dated 11.12.2020, of the Independent Qualification Commission related to the assessee Sokol Ngresi.

    Following the previous hearing, regarding the graphical examination of the documents subject to expertise, the presiding judge informed that on 04.11.2021 the Institute of the Scientific Police Directorate filed with the Appeal Chamber the expertise report and it was accordingly forwarded to IMO, the Public Commissioner and the assessee.

    The graphical experts of the Institute of the Directorate of Scientific Police, present at the hearing, made their statements with regard to the expertise act, confirming the falsification of signatures and relevant acts.

    The trial panel decided to administer the expertise act dated 04.11.2021.

    Then, the presiding judge announced that there are three new denunciations submitted with the Appeal Chamber, inviting the parties to comment on them.

    After being consulted, the trial panel decided:

    – To declare falsified the acts subject to the expertise and pursuant to Article 280/1 of the Civil Procedure Code, it decided to exclude them from consideration as evidence in this proceedings.

    – Pursuant to Article 275/2 of the Civil Procedure Code, these acts should be marked as falsified and held in the court’s archive along with this decision.

    – Pursuant to Articles 281/3 of the Criminal Procedure Code and Articles 245 and 271 of the Civil Procedure Code, the trial panel decided to file a criminal report with the Prosecution office at Tirana First Instance Court for the citizen F. K. for committing the criminal offenses of false testimony, provided for in Article 306 of the Criminal Code, and use of falsification of documents, provided for in Article 186 of the Criminal Code.

    – To not investigate further into the three newly filed denunciations to the Chamber.

    Once the parties stated that they had no additional requests, the trial panel decided to close the judicial review of the case and invited the parties to submit their final conclusions at the next hearing to be held on 16.11.2021, at 10.00.

    – Taking of disciplinary, criminal, civil, administrative measures by the Appeal Chamber, pursuant to article 128 paragraph 1; paragraph 2 letter a); paragraph 3 letter c; of the Constitution of the Republic of Albania against the serious violation by the members of the Constitutional Court of the Republic of Albania, who have issued decisions: No. 86, dated 22 June 2021; No. 86/1, dated 28 September 2021 and decision No. 111, dated 28 September 2021 of the Constitutional Court.

    – Declaring unconstitutional the decision no. 86, dated 22 June 2021; decision no. 111, dated 28 September 2021 of the Constitutional Court of the Republic of Albania.

    – Fair trial by the Appeal Chamber, in accordance with the requirements of the Constitution of the Republic of Albania, the European Convention on Human Rights and the law on the organization and functioning of the Constitutional Court, of the six requests submitted by the petitioner on March 25, 2021, before the Constitutional Court of the Republic of Albania, according to the interested entities and object where there is included the damage compensation and the legal basis accompanied by its respective probative documentation.

    – A decision that supports illegal actions, corrupt justice in a seized state and, in the most arbitrary manner by openly violating the Constitution of the Republic of Albania, articles 6.1; 8; 13; 14; 41 of the European Convention on Human Rights, as well as the law on the organization and functioning of the Constitutional Court, where the Albanian High Contracting Authority as part of the European Convention on Human Rights, has established disappointment, despair and has caused serious state of shock to the victims of the Roqi family, whose apartment was robbed by the state’s criminal violence, in violation of decision 76/2000 of the Constitutional Court and a special law. Faced with public discrimination, political re-persecution, violation of equality before the law, social exclusion, actions which are supported by decision no. 86, dated 22 June 2021 and no. 111, dated 28 September 2021 of the Constitutional Court, we request:

    Compensation for psycho-moral damage to the amount of 5 monthly salaries by each of the members of the Constitutional Court, on behalf of the victims of the Roqi family.

    – Given that this is the second time that the Constitutional Court has taken responsibility for the flagrant violation of Article 6.1; article 8; article 13; article 14; Article 41, European Convention on Human Rights, I request that the moral and material damage of 118 months from being criminally and violently evicted by the state from the apartment, payment for the privatization of an apartment on equal terms with members of the Constitutional Court, government official and parliament members, payment for the deliberate delay in the execution of the decision 76/2000 of the Constitutional Court, to be done straight from the ‘pockets’ of the members of the Constitutional Court and not from the Albanian taxpayers.

    – Taking security measures to protect the lives of the victims of the Roqi family, H. R., L. R., S. R., K. R. from violators of the Constitution of the Republic of Albania, the European Convention on Human Rights and the organic law of the Constitutional Court.

    Today, on 16.11.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 12/2021, dated 03.03.2021, corresponding to the appeal of the Public Commissioner against decision no. 324, dated 11.12.2020, of the Independent Qualification Commission related to the assessee Sokol Ngresi.

    When questioned by the presiding judge if there were any procedural requests with regard to the submitted acts, the Public Commissioner clarified that he had made this statement only in the context of transparency with the public and that he left the decision regarding them at the court appreciation.

    Once the presiding judge confirmed that the AC was notified and had administered the submitted acts, the trial panel decided to proceed with the submission of the final conclusions, assessing that the administered practice does not affect the proceedings at the Appeal Chamber and they shall be subject to verification/investigation and evaluation by the competent bodies.

    During the submission of the final conclusions, the Public Commissioner stated that the assessee had failed to prove the opposite of the appeal grounds and that he had made an inaccurate, insufficient declaration and lacked legitimate sources for the creation of his assets. The Public Commissioner requested the amendment of decision no. 324, dated 11.12.2020, of the Independent Qualification Commission and dismissal from office of the assessee Sokol Ngresi.

    The assessee contradicted the appeal grounds of the Public Commissioner and stated that through evidence and arguments he has managed to prove all his claims. The assessee requested the Chamber to rebut the appeal of the Public Commissioner, claiming that it was filed beyond the legal time limits and, alternatively, the upholding of decision no. 324, dated 11.12.2020, of the Independent Qualification Commission.

    The trial panel, after hearing the final conclusion of the parties, withdrew to make the final decision, to be announced on 24.11.2021, at 15:00 h.

    Today, on 18.11.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) 21/2021, dated 29.04.2021, corresponding to the appeal of the Public Commissioner against decision no. 332, dated 12.01.2021, of the Independent Qualification Commission, related to the assessee Lindita Male (Ziguri).

    The presiding judge announced that in response to the request of the Appeal Chamber for documentation and additional information for the assessee, the person related to her, F.M., as well as the other related person, A.GJ, there were several letters received, from the Prosecution office at Tirana First Instance Court, Tirana Judicial District Court, the Credit Processing Agency, the Civil Status General Directorate, several companies, as well as from a level second bank.

    Once the parties confirmed the acquaintance with the above responses, the assessee filed various new acts in order to the further investigation of the case, which she requested to be accepted as evidence by the trial panel. These acts were also forwarded to the Public Commissioner.

    After being consulted, the trial panel decided to allow the taking as evidence of acts received from institutions, as well as the acts filed by the assessee.

    Following this procedural moment, the Public Commissioner maintained a preliminary position on the evidence in their entirety, clarifying that the final position with their regard shall be submitted during the final conclusions.

    After the assessee answered certain questions of the case rapporteur, the trial panel decided to close the judicial investigation and invited the parties to submit their final conclusions, in the next hearing, to be held on 02.12.2021, at 09:00 h.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
