Today, on 02.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of the case (JR) no.41/2019, dated 06.09.2019, corresponding to the appeal of the assessee Eugen Beçi against decision no. 171, dated 26.06.2019 of the Independent Qualification Commission.

The assessee Eugen Beçi was heard by the trial panel as he filed his submissions related to the background and assets criteria, requesting the trial panel to re-evaluate once again the evidence in the administrative investigation file and their probative value.

In view of the consideration of the case, the assessee submitted several new acts, which the trial panel, upon an intermediate decision, decided to collect as evidence, pursuant to Article F, paragraph 3 of the Annex to the Constitution and Article 45 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

Once the assessee stated that he had no additional requests, the presiding judge declared the closure of the judicial review of the case.

In the final conclusions, the assessee requested the trial panel his confirmation in office and the overruling of decision no. 171, dated 26.06.2019 of the Independent Qualification Commission.

The trial panel, consulted on the spot, decided to adjourn the hearing in order to announce the final decision of the case, on 09.02.2021, at 15:00 h.

The Appeal Chamber has registered the case (JR) no. 6/2021, dated 26.01.2021, corresponding to the appeal of the Public Commissioner and assessee Irena Brahimi against decision no. 276 dated 21.07.2020 of the Independent Qualification Commission.

Today, on 03.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.39/2019, dated 04.09.2019, corresponding to the appeal of the assessee Evelina Qirjako against decision no. 178, dated 08.07.2019, of the Independent Qualification Commission.

The assessee Mrs. Evelina Qirjako made available to the trial panel the decision no. 6, dated 26.01.2021, of Tirana Administrative Court of Appeal, related to her lawsuit before this court.

After withdrawing for consultation and being acquainted with the content of the decision in question, the trial panel, upon a majority vote, decided to collect this decision as evidence in the adjudication in the Appeal Chamber.

Following this procedural instance, the assessee Mrs. Evelina Qirjako declared the waiver from the request for the suspension of the trial in the Appeal Chamber and requested the continuation of the review of her appeal against the IQC decision no. 178, dated 08.07.2019.

The trial panel decided to continue the trial of the case, inviting the assessee, Mrs. Qirjako, to submit her claims with regard to the appeal filed with the AC.

The hearing continued with the submission of the assessee, Mrs. Evelina Qirjako, after which the trial panel decided to close the judicial review. Ms. Qirjako requested in her final conclusions the overruling of paragraph 2 of the IQC decision no. 178, dated 08.07.2019, taking into account the decision of Tirana Administrative Court of Appeal.

The presiding judge declared the adjourning of the hearing to the purpose of announcing the final decision, to be held on 12.02.2021, at 13:00h.

Today, on 09.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

During the verification of the presence of the parties, the presiding judge noticed the absence of the assessee, Mr. Alaudin Malak and informed that Mr. Malaj had addressed a written request to the Appeal Chamber, accompanied by a medical report, requesting the postponement of the hearing for objective impossibility due to health reasons.

Pursuant to Article 175, second paragraph, of the Civil Procedures Code, the panel decided to adjourn the hearing of the case on 17.02.2021, at 1:00 h.

Today, on 11.02.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

After verifying the presence of the parties, the assessee Artan Madani submitted as a preliminary request before the trial panel the postponement of the hearing for a period of 2 weeks, for objective impossibility of his legal representative to assist him in the hearing, due to health reasons.

Once the Public Commissioner agreed with this request of the assessee and after the trial panel legitimized the legal representative as a party at trial, based on Article 175, second paragraph, of the Civil Procedure Code, the trial panel decided to postpone the hearing on 23.02.2021, at 10:00 h.

Today, on 17.02.2021, at 13:00h, the Appeal Chamber held the public hearing of case (JR) 51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

The assessee, based on Article 145, para 2 of the Constitution, submitted a request to the trial panel for the suspension of the trial, in order for the Panel to send to the Constitutional Court for consideration the case raised in the request by the assessee, Mr. Malaj.

After withdrawing for consultation, the trial panel rejected the request of the assessee, arguing that it is not found in terms of Article 145, para 2 of the Constitution, as it is not considered that any of the laws of the re-evaluation process is contrary to the Constitution.

Also, the trial panel, after considering all the requests and evidence filed by the assessee, declared the closure of the judicial investigation of the case and invited the assesse to submit the final conclusions.

Taking into account the request of the assessee for a reasonable time for the preparation of the final conclusions, the trial panel decided to adjourn the hearing until 23.02.2021, at 09:00 h.

Today, on 19.02.2021, the Appeal Chamber draw the lot for the replacement of Judge Luan Daci, appointed as member of the trial panel of the case (JR) no. 46/2019, dated 25.09.2019, related to the appeal of the Public Commissioner against the decision no. 161, dated 18.06.2019 of the Independent Qualification Commission related to the assessee Kastriot Selita.

Following the draw, Judge Luan Daci was replaced by Judge Rezarta Schuetz.

The replacement of Judge Luan Daci was made due to his suspension from office upon decision no. 14, dated 24.07.2020 of the Meeting of Judges.

Today, on 23.02.2021, at 10:00h, the Appeal Chamber held the public hearing of the case (JR) 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against the decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

During the verification of the presence of the parties, the presiding judge noticed the absence of the Public Commissioner Mr. Florian Ballhysa, the one that filed the appeal of the case (JR) no. 55/2019, dated 29.10.2019.

In his absence, the Public Commissioner Mr. Darjel Sina was present at the hearing to inform that Mr. Ballhysa had officially notified the Appeal Chamber that, due to health reasons, he was unable to attend this hearing and requested its adjournment to an appropriate date.

After the presiding judge confirmed the official receipt of the notice sent by the Public Commissioner and after the assessee expressed his consent to the request of the Public Commissioner, the trial panel, based on Article 175, para 2, of the Civil Procedure Code, decided to adjourn the public hearing on 11.03.2021, at 10:00h.

Today, on 23.02.2021, at 09:00, the Appeal Chamber held the public hearing of case (JR) 51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

During the verification of the presence of the parties, the presiding judge noticed the absence of the assessee and informed that the latter had submitted to the trial panel the final conclusions, in a written form, requesting the panel their acceptance and consideration.

The trial panel decided to accept the final conclusion of the assessee and withdrew to make the final decision, to be announced today, on 23.02.2021, at 15:00h.
