The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

    Today, on 15.01.2024, at 09:00, the Appeal Chamber held the public hearing of case (JR) 33/2023, dated 20.07.2023, pertaining to the appeal of the Public Commissioner against decision no. 671, dated 14.06.2023, of the Independent Qualification Commission, related to the assessee Ylli Bashaj.

    With regard to the findings and opinion of the International Monitoring Operation (IMO), the Public Commissioner held that they should be collected as evidence in the proceedings and should be considered and evaluated by the Chamber. The Public Commissioner stated that she will state her position with their regard in the final conclusions of the case.

    The Public Commissioner submitted the appeal grounds for the asset assessment criterion, assessing that the circumstances resulting from the administrative investigation of the Independent Qualification Commission should be re-evaluated by the Chamber in order to reach a conclusion on the accuracy and truthfulness of the declarations of the assessee about the assets. The Public Commissioner evaluated that the appeal grounds shall have to be resolved during the evaluation of the case with the Chamber, on the basis of a complete investigation process, on the accurate and exhaustive analysis of the collected evidence and in the application of the principles of fair trial. The Public Commissioner requested the amendment of decision no. 671, dated 14.06.2023, of the Independent Qualification Commission, or its upholding.

    The assessee disputed the findings of the International Monitoring Operation, stating that they exceed the appeal and are supported on circumstances that do not exist and did not occur. The assessee requested the Chamber to dismiss the findings of the International Monitoring Operation.

    In addition to responding to some questions of the rapporteur of the case and the international observer with respect to the findings, the assessee submitted also his objections with regard to the appeal ground related to the asset assessment. The assessee requested the Appeal Chamber the upholding of decision no. 671, dated 14.06.2023, of the Independent Qualification Commission.

    The trial panel, after being consulted, decided to accept as evidence the findings and the opinion of the International Monitoring Operation, and requested the Public Commissioner to take a position regarding the IMO findings, the concrete factual situation to which they refer, as well as addressing them in the appeal grounds. The trial panel assessed that this position is relevant to be maintained at this stage of the trial, not only to become part of the judicial debate, but also in compliance with the principle of due process of law.

    Given that the Public Commissioner requested a reasonable time to maintain her position, the panel decided to postpone the hearing to January 19, 2024, at 10:00.

    Today, on 16.01.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 12/2023, dated 15.03.2023, pertaining to the appeal of the Public Commissioner against decision no. 606, dated 21.12.2022, of the Independent Qualification Commission, related to the assessee Mariola Mërtiri.

    During the submission of the appeal grounds, the Public Commissioner stated that she shares an opinion contrary to the one of the Independent Qualification Commission that decided the confirmation in office of the assessee. The Public Commissioner held that the assessee has failed to prove the opposite of the burden of proof for any of the three vetting criteria, asset, background and proficiency assessment. In conclusion of the submissions, the Public Commissioner requested the Appeal Chamber the consideration of the appeal grounds and at the conclusion of the comprehensive investigation of the case, to decide on the amendment of decision no. 606, dated 21.12.2022, of the Independent Qualification Commission, and the dismissal from office of the assessee, Ms. Mariola Mërtiri.

    The assessee and her legal representative disputed the appeal grounds, maintaining that they do not stand and that they contradict the principles of lawfulness, objectivity and proportionality. In support of her claims, the assessee, Ms. Mariola Mërtiri, filed several documents, which she requested the panel to collect them as evidence. The assessee requested the upholding of decision no. 606, dated 21.12.2022, of the Independent Qualification Commission.

    The Public Commissioner, when questioned by the presiding judge regarding some public denunciations, held that they do not contain circumstances or facts for further investigation.

    After being consulted, the trial panel decided to reopen the judicial investigation of the case, accepting as evidence the documents filed by the assessee. The trial panel decided not to undertake further investigations into the denunciations, as they do not meet the requirements of Article 53 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    Once the assessee responded to the detailed questions about the case of the international observer of the International Monitoring Operation, the trial panel decided to close the judicial investigation and invited the parties to submit their final conclusions.

    In response to the parties’ request for sufficient time to submit the final conclusions, the trial panel decided to postpone the hearing to January 23, 2024, at 09:00.

    Today, on 18.01.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 72/2021, dated 23.11.2021, pertaining to the appeal of the Public Commissioner against decision no. 442, dated 14.09.2021, of the Independent Qualification Commission, related to the assessee Juljan Çafka.

    During the submission of the appeal ground concerning the proficiency assessment criteria, in reference to a public denunciation, the Public Commissioner requested the Chamber the opening of the judicial investigation of the case, requesting the administration of the criminal case files the administered by the assessee, as well as the conducting of any further evaluation with respect to the case.

    The assessee disputed the appeal as unsupported on law and due legal process, holding that it is ungrounded on the decision of the Independent Qualification Commission, but on new facts, not previously investigated. The assessee requested the Chamber that following the consideration of the issues raised by the Public Commissioner’s appeal, to decide the upholding of decision no. 442, dated 14.09.2021, of the Independent Qualification Commission.

    After being consulted, the trial panel decided to reopen the judicial investigation of the case, requesting the Prosecution office at Gjirokastra First Instance Court of General Jurisdiction to forward the files of certain criminal cases managed by the assessee, in order to administer them.

    The trial panel invited the parties at trial that in the next hearing, scheduled on 26.01.2024, at 09:00, to state their position regarding the public denunciations, including some denunciations delivered today at the Appeal Chamber, which shall be forwarded to the parties as soon as possible.

    The assessee, during the submission of her final conclusions, maintained her objections against all appeal grounds, stating that the acts and documentation made available to the trial panel and her explanations in the previous hearings prove that the appeal of the Public Commissioner is unsupported by evidence and acts and upon an erroneous interpretation of the legislation. In conclusion, the assessee, Mrs. Mariola Mërtiri, requested the upholding of decision no. 606, dated 21.12.2022, of the Independent Qualification Commission.

    Following the hearing the final conclusions of the parties, the trial panel closed the judicial review of the case and withdrew to take the final decision of the case, scheduled to be announced on 29.01.2024, at 15:00.

    Today, on 26.01.2024, at 09:00, the Appeal Chamber held the public hearing of the case (JR) 72/2021, dated 23.11.2021, which pertains to the appeal of the Public Commissioner against decision no. 442, dated 14.09.2021 of the Independent Qualification Commission, which is related to the assessee Juljan Çafka.

    Following the verification of the presence of the parties, the Presiding of the session announced that several denounciations were filed with the Chamber, the contents of which the jury was not yet been acquainted with, while she invited the parties to submit their positions on the denunciations filed before the initiatian of the judicial review of the case.

    The Public Commissioner assessed the need for further investigation for some of the aforementioned denunciations, clarifying that the ones submitted to the Chamber before filing the appeal, have been addressed during the administrative investigation at the Independent Qualification Commission. In conclusion of its position, the Public Commissioner submitted that for two of the denunciations of the public, it was unable to express on the need for further investigation.

    The assessee presented his position and the objections of the facts submited with the appeal, as well as requested the administration of a series of documents for review.

    The trial panel after considering the positions of the parties at this stage of the process regarding the denunciations filed with Chamber, analyzed and consulted the documents submitted by the assessee, decided the administration of the documents submitted by the assessee, the administration of the criminal files that belong to the criminal proceedings of the Prosecution Office at the First Instance Court of the General Jurisdiction of Gjirokastra, in terms of the investigation of the respective denunciations. It also decided to not further investigate the denunciations filed with the Chamber during the period of preparation of the case and those presented on 18.01. 2024, as it is assessed that they do not meet the criteria provided for by law 84/2016, article 53, as well as the forwarding of 3 (three) of the denunciations, recently filed with the Chamber, to the parties for their consideration.

    At the end of the session, the trial panel decided that the next hearing session be held on 02.02.2024, at 11:00, to give time to the parties to take their respective positions.

    Today, on 26.01.2024, 12:00h, the Appeal Chamber held the hearing session of the case (JR) 33/2023, dated 20.07.2023, which pertains to the appeal of the Public Commissioner against decision no. 671, dated 14.06.2023 of the Independent Qualification Commission, related to the assessee Ylli Bashaj.

    Following the verification of the presence of the parties, the Presiding judge asked the parties to submit their final conclusions.

    The Public Commissioner, holding on all the appeal grounds, submissions and position on the finding and opinion of the international observers, concluded that the assessee failed to reach a reliable level in the asset assessment criterion, as he has made an incorrect and insufficient declaration and he lacks legitimate financial sources. In conclusion, the Public Commissioner requested the modification of decision no. 671, dated 14.6.2023, of the Independent Qualification Commission, and dismissal from office of the assessee, Mr. Ylli Bashaj.

    The assessee, during the submission of final conclusions, claimed the opposite of the Public Commissioner’s conclusions, and requested the trial panel to uphold the decision no. 671, dated 14.06.2023 of the Independent Qualification Commission, for his confirmation in office.

    After hearing the final conclusions of the parties, the trial panel closed the judicial review and withdrew in Camera to take the final decision on the case, which shall be announced on 02.02.2024, 10:00h.

    At the conclusion of the adjudication, the trial panel, pursuant to Article 66, paragraph 1 (b) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, upon a majority vote, decided:

    – Amendment of decision no. 350, dated 23.02.2021 of the Independent Qualification Commission, and confirmation in office of the assessee, Ms. Mariana Shegani (Dedi).

    – This decision is final and effective immediately.

    Announced today, in Tirana, on 30.01.2024.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
