The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    At the conclusion of the trial, the trial panel, pursuant to Article 66, paragraph 1 (a) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, upon a majority vote, decided:

    – Upholding decision no. 681, dated 07.07.2023 of the Independent Qualification Commission, related to the assessee Artur Ismajlukaj.

    – This decision is final and effective immediately.

    Today, on 04.04.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 3/2023, dated 17.01.2023, pertaining to the appeal of the Public Commissioner against decision no. 592, dated 24.11.2022, of the Independent Qualification Commission, related to the assessee Erion Pano.

    During the submission of the final conclusions, the Public Commissioner assessed that even during the trial of the case at the Chamber, the assessee failed to prove the truthfulness of his statements regarding the legitimacy of the sources of the creation of the assets. The Public Commissioner requested the amendment of decision no. 592, dated 24.11.2022, of the Independent Qualification Commission and the dismissal from office of the assessee Erion Pano.

    The assessee, through his legal representative, held that the claims raised in the appeal by the Public Commissioner do not stand, are unsupported on law, evidence and factual circumstances, and requested finally the upholding of decision no. 592, dated 24.11.2022, of the Independent Qualification Commission.

    After hearing the final conclusions of the parties, the trial panel withdrew to take the final decision, to be announced on 15.04.2024, at 15:00.

    Today, on 04.04.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 3/2023, dated 17.01.2023, pertaining to the appeal of the Public Commissioner against decision no. 592, dated 24.11.2022, of the Independent Qualification Commission, related to the assessee Erion Pano.

    During the submission of the final conclusions, the Public Commissioner assessed that even during the trial of the case at the Chamber, the assessee failed to prove the truthfulness of his statements regarding the legitimacy of the sources of the creation of the assets. The Public Commissioner requested the amendment of decision no. 592, dated 24.11.2022, of the Independent Qualification Commission and the dismissal from office of the assessee Erion Pano.

    Today, on 17.04.2024, at 10:00 a.m., the Appeal Chamber held the public hearing of the case no. (JR) 42 -17/2018, dated 11.04.2023, pertaining to the request of the former assessee, Mrs. Antoneta Sevdari for the review of the decision of the Special Appeal Chamber (JR) no. 6, dated 28.02.2019.

    With regard to the retrial of the case and the continuation of its trial on the merits, the Public Commissioner pointed out that the ground presented in the appeal dated 29.8.2018 of the Public Commissioner, filed against the decision of the Commission no. 42/2018, based on the state of the acts in the file of the administrative investigation of the Independent Qualification Commission remain as such, even after the administration of the decision of the European Court of Human Rights (ECHR), “Sevdari vs. Albania”. At the end of the presentation of these appeal grounds for the asset and proficiency assessment criteria, the Public Commissioner requested the amendment of decision no. 42, dated 18.07.2018 of the Independent Qualification Commission and the dismissal from office of the applicant Antoneta Sevdari.

    The legal representative of the applicant, Antoneta Sevdari, stated that presenting the same appeal grounds as those that led to the dismissal of the assessee, without re-evaluating them following the decision of the European Court of Human Rights, is a deviation from this decision-making, according to which the dismissal of Ms. Sevdari is disproportionate and in violation of Article 8 of the European Convention on Human Rights. The applicant asked the Appeal Chamber not to accept the appeal and to uphold decision no. 42, dated 18.07.2018 of the Independent Qualification Commission regarding her confirmation in office.

    By objecting the position held by the applicant, the Public Commissioner emphasized the enforcement power of the decision of the ECtHR and stated that in this decision-making are not overturned the appeal grounds of the Public Commissioner, but requests that be evaluated the proportionality of the measure of dismissal with regard to these appeal grounds, assessment which will be carried out by the court.

    Following their consultation, the trial panel decided to administer the acts of the file forwarded by the Independent Qualification Commission, which is the basis for the decision no. 42, dated 18.07.2018 of the Commission. With a majority of votes, the trial panel decided not to open an investigation regarding a complaint addressed by the Public Commissioner.

    After the parties stated that they had no further procedural requests, the trial panel decided to close the judicial review of the case and invited them to present their final conclusions.

    Given that the Public Commissioner asked for time to prepare the final conclusions, the trial panel decided to adjourn the public hearing on 23.04.2024, at 12:00h.

    Today, on 23.04.2024, at 10:00 a.m., the Appeal Chamber started the judicial review in a public hearing of case (JR) 20/2021, dated 21.04.2021, which pertains the appeal of the assessee Bib Ndreca filed against the decision of the Commission Independent Qualification, no. 337, dated 18.01.2021.

    Given that for the international observer of the International Monitoring Operation Ms. Maria Tuma, who had attended this case during the process developed with the Independent Qualification Commission and later on in the hearing in camera on 19.03 2024 held at the Appeal Chamber, it was objectively impossible to be present at today’s hearing, she was replaced by international observer Theo Jacobs. At the beginning of the hearing, Mr. Jacobs asked the trial panel to adjourn the hearing for a reasonable time, to give Ms. Tuma the opportunity to be present in person at the trial of the case, as he was not familiar with it.

    After having heard the assessee’s position who stated that it is in the assessment of the trial panel to accept or not this request, the trial panel decided to reschedule the hearing on 14.05.2024, at 10:00, to make it possible for the international observer Maria Tuma to be present in the judicial debate of the case.

    On 23.04.2024, at 10:00, the Appeal Chamber held the public hearing of the case with register number (JR) 42 – 17/ 2018, dated 11.04.2023, regarding the request filed by the former assessee, Mrs. Antoneta Sevdari for the review of the decision of the Special Appeal Chamber (JR) no. 6, dated 28.02.2019.

    During the presentation of the final conclusions, standing by the appeal grounds presented during the hearing of 17.04.2023, the Public Commissioner, in the end asked the Appeal Chamber the amendment of decision no. 42, dated 18.07.2018 of the Independent Qualification Commission and the dismissal from office of the applicant Antoneta Sevdari.

    The legal representative of the applicant, Antoneta Sevdari stated that, based on the evaluation of the ECtHR, the appeal grounds are disproportionate for imposing the disciplinary measure, referring to the legitimate purpose of the re-evaluation process. According to the legal representative, the conclusion of the ECtHR is mandatory for implementation and for this reason, the appeal grounds of the Public Commissioner are no longer valid, because they cannot lead to imposing any disciplinary measures against Mrs. Antoneta Sevdari.

    Eventually, Mrs. Antoneta Sevdari asked the Appeal Chamber to implement the decision of the European Court of Human Rights, by upholding the decision no. 42, dated 18.07.2018 of the Independent Qualification Commission, after it assessed that she has reached a trustable level in all three assessment criteria.

    After hearing the final conclusions of the parties, the trial panel decided to withdraw to make the final decision, which shall be announced on 10.05.2024, at 13:00.

    In conclusion of the adjudication of the case in camera, pursuant to article 66, paragraph 1, item “a” of law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel, unanimously ruled on:

    – Upholding of decision no. 469, dated 01.11.2021 of the Independent Qualification Commission, pertaining to the assessee Ardian Braho.

    – This decision is final and immediately effective.

    Today, on 29.04.2024, at 10:00, the Special Appeal Chamber held the public hearing of the case (JR) 30/2023, dated 14.07.2023, related to the appeal of the Public Commissioner filed against the decision of the Independent Commission of Qualification, no. 675, dated 16.06.2023, corresponding to the assessee Alfred Balla.

    During the presentation of the appeal grounds, the Public Commissioner assessed that the decision of the Independent Qualification Commission to declare the termination of the re-evaluation process for the assessee Mr. Alfred Balla, without a final decision, is not fair and not based on the legislation that regulates the re-evaluation process. According to the Public Commissioner, the assessee has exercised his rights, by expressing his unwavering will to terminate his re-evaluation process, choosing ipso jure the prohibition as per the provisions of Article G of the annex to the Constitution, to be appointed as a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, the High Inspectorate of Justice or the General Prosecutor for a period of 15 years.

    The assessee, together with the legal representative, objected the appeal of the Public Commissioner, stating that since Mr. Alfred Balla has not submitted his resignation, the prohibitions provided for in Article G of the Annex to the Constitution cannot be applied in his case. In support of his claims, the assessee has requested the administration of some additional acts and asked the trial panel to uphold the decision of the Independent Qualification Commission, no. 675, dated 16.6.2023.

    After being consulted, the trial panel, by majority vote, decided to open the judicial investigation of the case and to administer as evidence the documents filed by the assessee, except for those that could be accessed online, as well as the documents that were already part of the file.

    After the parties stated that they had no further procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to present their final conclusions.

    In the end, the Public Commissioner requested the amendment of decision no. 675, dated 16.6.2023, of the Independent Qualification Commission, as follows:

    1. Termination of the re-evaluation process for the assessee, Mr. Alfred Balla.

    2. Prohibition of the assessee, Mr. Alfred Balla, to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, the High Inspectorate of Justice or the General Prosecutor for a period of 15 years.

    In the end, the assessee made the same requests, upholding of decision no. 675, dated 16.6.2023, of the Independent Qualification Commission.

    After hearing the final conclusions of the parties, the trial panel withdraw to make the final decision, which will announced on 21.05.2024, at 15:00.

    The public hearing shall take place at the premises of the Special Appeal Chamber, at: Bulevardi “Dëşhmorët e Kombit”, nr. 3. Tirana.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
