The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    On 04.07.2024, the Appeal Chamber held the public hearing of case (JR) 71/2021, dated 17.11.2021, pertaining to the appeal of the assessee Sali Hasa against decision no. 433, dated 03.09.2021 of the Independent Qualification Commission.

    The presiding judge informed that on 02.07.2024, the assessee had filed with the Chamber, in the form required by law, the acts refused to be accepted as evidence by the trial panel during the previous hearing, dated 24.06.2024, due to their failure of meeting the formal criteria.

    The trial panel decided to accept these acts as evidence, as well as some other acts that the assessee submitted during today’s hearing in view of the examination of the case.

    The trial panel rejected a request of the assessee, through which he requested that the Chamber proves the alleged financial circumstances of another person related to him, on grounds that in this proceedings, the burden of proof stands with the assessee who has to prove the legitimacy of the sources of income of the other related persons.

    Once the legal representative of the assessee stated that there were no other procedural requirements, the trial panel decided to close the judicial investigation of the case and invited him to submit the final conclusions on the case.

    Finally, the assessee requested the Chamber the amendment or the overruling of decision no. 433, dated 03.09.2021 of the Independent Qualification Commission, as he considers this decision unfair and in violation of constitutional and legal principles.

    The trial panel decided to close the judicial review and withdrew in chambers to make the final decision of the case, to be announced on 08.07.2024, at 15:00.

    Today, on 09.07.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 19/2023, dated 18.05.2023, pertaining to the appeal of the Public Commissioner against decision no. 632, dated 08.03.2023 of the Independent Qualification Commission, related to the assessee Laurent Fuçia.

    During the submission of the appeal grounds, the Public Commissioner stated that the assessee shows deficiencies in terms of the proficiency criteria, as he has interpreted incorrectly the criminal and civil procedural law, and delivered decisions unsupported on law and evidence that casts doubt on his integrity. Finding that these identified shortcomings cannot be remedied by training programs, the Public Commissioner requested the Chamber the amendment of decision no. 632, dated 08.03.2023 of the Independent Qualification Commission and the dismissal from office of the assessee Laurent Fuçia.

    The assessee objected the Public Commissioner’s appeal grounds as unsubstantiated on law and evidence, and submitted an overview on his overall proficiency assessment, in support of which he filed several new acts, which he requested the trial panel to accept them in the capacity of evidence. The assessee held that he reaches the qualifying level in the proficiency assessment and requested the Chamber the upholding of decision no. 632, dated 08.03.2023 of the Independent Qualification Commission.

    The trial panel decided to open the judicial investigation and administer as evidence some of the documents filed by the assessee, maintaining that the other documents could be accessed from open sources of information.

    Asked by the presiding judge if he needed additional time to take a stand regarding the new evidence, the Public Commissioner stated that he needed no additional time, as long as it was not related to the appeal grounds.

    Once the parties declared that they had no further procedural requests, the trial panel decided to close the judicial investigation of the case and invited them to submit their final conclusions.

    The Public Commissioner requested that the submissions presented in the hearing be considered as final conclusion, standing by his final request. The assessee as well stood by his objections and his request for the upholding of decision no. 632, dated 08.03.2023 of the Independent Qualification Commission.

    The trial panel, after hearing the final requests of the parties, withdrew in chambers to make the final decision, to be announced on 25.07.2024, at 15:00.

    During the submission of the appeal grounds, the Public Commissioner held that the assessee failed to prove the contrary of the investigation results on the assets, proficiency and background assessment, as well as on ascertained cases of conflict of interest. The Public Commissioner requested the trial panel the amendment of decision no. 661, dated 18.5.2023, and the dismissal from office of the assessee, Mr. Besnik Hoxha.

    The assessee, through his legal representative, objected to the Public Commissioner’s appeal grounds, considering them unsubstantiated in evidence and in the results of the administrative investigation. While claiming the opposite of the appeal grounds, the assessee filed two new documents, one of which the trial panel considered as an explanatory act in view of the submissions, while for the other, it maintained that it could be consulted online on the official website of the Supreme Court.

    Once the parties declared that they had no further procedural requests, the trial panel invited them to submit their final conclusions. In terms when the Public Commissioner requested a reasonable time limit for presenting the final conclusions, the trial panel decided to postpone the hearing to 22.07.2024, at 10:00.

    With respect to some denunciations received by the Chamber, the parties held that they contain no circumstances or facts for further investigation.     During the submission of the final conclusions, the Public Commissioner held that during the AC proceedings, the assessee, Mr. Besnik Hoxha, failed to prove the opposite of the burden of proof regarding the asset assessment criterion as well as with regard to the ascertained circumstances of the conflict of interest, that should be evaluated by the Chamber within the proficiency assessment criterion and his integrity as a judge.     The legal representative of the assessee, while objecting the appeal, stated that she stands by the arguments filed during the AC proceedings, which exhaustively prove that Mr. Besnik Hoxha reaches a reliable level in the asset assessment criterion, background assessment criterion and a qualifying score in the proficiency assessment criterion. The legal representative maintained that the assessee is no case found under conditions of conflict of interest or bias during the exercise of the office, and finally, requested the Chamber the upholding of decision no. 661, dated 18.05.2023 of the Independent Qualification Commission.

    After hearing the final conclusions of the parties, the trial panel decided to close the judicial consideration of the case and withdrew in chambers to make the final decision, which it will announce on 25.07.2024, at 16:00.

    Finally, the Public Commissioner requested the amendment of decision no. 352, dated 01.03.2021 of the Independent Qualification Commission and the dismissal from office of the assessee Iliba Bezati.

    The assessee maintained that she reaches a reliable level for the asset and background assessment, and a qualifying score in the proficiency assessment, and that the conclusions of the Independent Qualification Commission for all three criteria are fair and supported on law. The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
