The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process.
Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process.
The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

Today, on 05.10.2022, at 10:00, the Appeal Chamber held the public plenary session of case (JD) 2/2021, dated 26.03.2021, with petitioner Markelian Kuqo, against decision no. 633, dated 10.12. 2020 of the High Judicial Council “On issuing a disciplinary measures against judge Markelian Kuqo” and interested parties, the High Judicial Council and the High Inspector of Justice.
During the submission of the final conclusions, the petitioner analyzed the content of the High Court decision in reference to the disciplinary proceedings, reiterating his position that this decision fails to respond his appeal, diverts it and, consequently, does not lead to a legal resolution to the case. The petitioner Markelian Kuqo requested in conclusion that the Chamber overrules the decision of the High Judicial Council, no. 633, dated 10.12.2020 “On issuing a disciplinary measure of his dismissal from office”.
The representatives of the interested parties, the High Judicial Council and the High Inspector of Justice submitted their positions on the disciplinary violations of the petitioner in the light of the decision of the High Court, maintaining that, contrary to the claims of the petitioner, the disciplinary proceedings against him have been carried out in full compliance with the law, as well as the due legal process principles. The HJC and HJI representatives held that in committing very serious disciplinary misconducts, the judge has violated the public’s trust in justice, and requested in conclusion that the Chamber dismisses the appeal of judge Markelian Kuqo and upholds the decision of the High Judicial Council, no. 633, dated 10.12.2020 “On issuing the disciplinary measure of his dismissal from office”.
Following the hearing of the final conclusions of the parties, the trial panel shall deliberate in chambers on decision-making to the case. The date of the announcement of this decision will be notified to the parties by the AC judicial secretariat.

The Appeal Chamber announces that today, on 25.10.2022, after considering in chambers the case (JR) no. 18/2020, dated 02.06.2020, which pertains to the appeal of the assessee Hajrie Muçmata against decision no. 209, dated 11.11.2019, of the Independent Qualification Commission, pursuant to Article F, paragraph 3 of the Annex to the Constitution, Article 4, paragraph 5 of Law 84/2016, “On the Transitional re-evaluation of judges and prosecutors in the Republic of Albania”, as well as in Article 51, paragraph 1 (b) of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, it was decided to review the case in a public hearing, to take place on Wednesday, 09.11.2022, at 11:00.
The trial in a public hearing was decided in order to remedy the procedural errors committed by the Independent Qualification Commission.
On Thursday, 27.10.2022, at 10:00 a.m., the Appeal Chamber shall review in chambers case (JR) no. 38/2020, dated 18.09.2020, pertaining to the appeal of the assessee Skënder Haluci against decision no. 244, dated 05.03.2020 of the Independent Qualification Commission.

At the conclusion of the trial in chambers, the trial panel, pursuant to Article 66, paragraph 1 (a) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a majority vote, decided:
To uphold decision no. 476, dated 16.11.2021 of the Independent Qualification Commission, related to the assessee Eda Kaja.
Today, on 30.06.2023, at 11 h, was held the session for the election of the President of the Special Appeal Chamber, who shall exercise this office for a 3-year mandate, as of 27.07.2023.
Upon the secret ballot procedure, which took place in the presence of the international observers of the International Monitoring Operation, the candidate Mr. Sokol Çomo was unanimously elected.
This result was approved upon the decision of the Meeting of Judges no.60, dated 30.06.2023.
Mr. Sokol Çomo shall take the office of the President of the Appeal Chamber on 27.07.2023, when the term of the incumbent President Mrs. Albana Shtylla shall terminate.
