The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Appeal Chamber held on 08.01.2020, at 10:00 h, the public hearing of case (JR) no. 12/2019, dated 22.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 84 dated 27.11.2018, of the Independent Qualification Commission, related to the transitional re-evaluation of the assessee Besnik Cani.

    The Chair of the adjudication panel informed the parties at trial that the assessee had filed a request requiring the adjournment of the judicial review in order to provide his defense counsel the necessary time to prepare himself.

    The assessee stated also during the hearing a family circumstance due to which he requested the adjournment of the hearing.

    The adjudication panel decided to adjourn the hearing on 20.01.2020, at 10:00 h. The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

    On 13.01.2020, at 10:00 h, the Appeal Chamber reviewed in camera case (JR) no. 9/2019, dated 12.02.2019, corresponding to the appeal of the assessee Izet Kadana against decision no. 92, dated 20.12.2018 of the Independent Qualification Commission.

    During today’s hearing the adjudication panel was informed of the request of the assessee Izet Kadana, filed with the Appeal Chamber, on the recusal of judge Luan Daci.

    Upon acquaintance with the request, the adjudication panel composed of, Chairperson Ina Rama, judge rapporteur Rezarta Schuetz, and judge members Sokol Çomo, Luan Daci and Natasha Mulaj, decided to suspend the review of case no. (JR) register 9/2019, corresponding to the appeal of the assessee Izet Kadana against decision no. 92, dated 20.12.2018, of the Independent Qualification Commission, until the review of the request of the assessee to recuse judge Luan Daci from this panel.

    At the conclusion of the adjudication in camera, pursuant to Article 66, paragraph 1, item ‘a’, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, unanimously decided:

    1. To uphold decision no. 93, dated 12.2018, of the Independent Qualification Commission related to the assessee Admir Belishta.
    2. This decision is final and effective immediately.

    The Appeal Chamber held on 16.01.2020, at 10:00 h, the public hearing of case (JR) no. 40/2018, dated 18.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 63 dated 06.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Arben Dollapaj.

    The chairperson stated that besides the Ministry of Tourism and Environment the other state institutions provided responses related to the additional documentation requested by the Appeal Chamber to the purpose of review of the case.

    In response to the request of the adjudication panel in the previous hearing, the Public Commissioner stated his assessment on the way the public submissions were handled. The Public Commissioner considered that he has reflected in the appeal grounds the information of a part of the submissions, whereas with regard to the rest, he stated that they do not contain sufficient grounds for further investigation by the Appeal Chamber.

    In response to the appeal grounds, the assessee submitted some new additional acts, which he requested the panel to be admitted as evidences.

    The adjudication panel decided to make available to the parties the responses of the state institutions, whereas it shall make available to the assessee the public submissions as well.

    The Appeal Chamber held on 20.01.2020, at 10:00 h, the public hearing of case (JR) no. 12/2019, dated 22.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 84 dated 27.11.2018, of the Independent Qualification Commission, related to the transitional re-evaluation of the assessee Besnik Cani.

    At the initiation of the hearing, the assessee, through his defense counsel, filed a preliminary request with the Appeal Chamber for the recusal from the adjudication panel of its two members, Judges Ardian Hajdari and Luan Daci.

    The Chairperson of the adjudication panel announced that the Chamber would follow the procedures for the drawing of lots, by which adjudication panels shall be selected to consider the request for the recusal of the two judges, while the proceedings shall proceed as per Article 75, last paragraph of the Civil Procedure Code.

    Subsequently, the assessee submitted two other preliminary requests:

    1. Suspension of the re-evaluation process for Mr. Besnik Cani until the end of his mandate as a member of the High Prosecutorial Council; based on Article 179/b, Annex to the Constitution in its entirety, and Article 4, paragraph 6, and Article 65 of Law no. 84/2016 and considering that it is not in accordance with Article 297 of the Civil Procedure Code, the panel decided to dismiss the request, as unfounded in law.
    2. Dismiss the Public Commissioner’s appeal regarding the 4 issues that the Independent Qualification Commission has decided to refer to the competent body for inspection of potential legal misconducts of the assessee; based on the provisions of Article 4, paragraph 6, and Article 65 of Law no. 84/2016 and Article 450, paragraph 3, of the Civil Procedure Code, the adjudication panel considered to not make a statement with this respect at this stage of the proceedings. With regard to this request, the panel reserves the right to make a statement at another stage or in the final decision.

    Following this interim decision, the Public Commissioner submitted the grounds of the appeal, requesting the amendment of decision no. 84, dated 27.11.2018, of the Independent Qualification Commission and dismissal from office of the assessee.

    The assessee submitted his objections to these grounds of appeal and in their response, filed new acts with the panel, requesting their admission as evidence.

    In order to provide the necessary time to the Public Commissioner to make a statement with respect to these acts, the adjudication panel decided to adjourn the hearing on 11.02.2020, at 10:00 h. The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
