The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    Today, on 11.01.2021, at 12:00 h, the Appeal Chamber held the public hearing of the case (JR) no. 51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

    After being informed and consulted with regard to the preliminary request of the assessee Alaudin Malaj to not allow the participation of the media in his hearing, as well as the prohibition of its publication, the trial panel decided to dismiss the request, assessing that it is not found in any of the terms of Article 20 of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended. The object of the appeal of the assessee is the decision of the Independent Qualification Commission which is no cause related to privacy, protection of public morals, public order, national security or trade secrecy.

    The assessee was heard by the trial panel as he submitted his objections regarding the proceedings at the Independent Qualification Commission. To the purpose of the review of the case the assessee, Mr. Malaj submitted two new additional acts, one of which, the lawsuit filed by him with the Administrative Court of First Instance Tirana, against the decision of the Independent Qualification Commission, upon postal receipt dated 17 June 2020, was admitted as evidence by the trial panel. With regard to the other act, the trial panel requested the assessee to bring it back in the form required by law, as it was only an uncertified copy.

    The trial panel decided also to provide the assessee the opportunity to get acquainted with the procedural acts of the case file of the Independent Qualification Commission related to the addressing the requests of the assessee with object the recusal of the trial panel members. To this aim, the hearing was postponed to be held on January 27, 2021, at 10:00 h.

    The public hearing will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.

    The trial panel of the Appeal Chamber, composed of judges Albana Shtylla, presiding, Rezarta Schuetz, rapporteur, Ina Rama, Natasha Mulaj, Sokol Çomo members, announced the decision on case (JR) no. 34/2019, dated 18.07.2019, corresponding to the appeal of the assessee Albina Spaha, against decision no. 139, dated 15.04.2019 of the Independent Qualification Commission.

    At the termination of the adjudication in chambers, pursuant to Article 66, paragraph 1/a, of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel unanimously decided:

     

    1. To uphold decision no. 139, dated 15.04.2019 of the Independent Qualification Commission, pertainig to the assessee Albina Spaha.
    2. This decision is final and effective immediately.

    At the termination of the adjudication, pursuant to Article 66, paragraph 1/b, of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel unanimously decided:

    To amend the Independent Qualification Commission decision no. 249, dated 06.03.2020, as follows:

    1. To terminate the re-evaluation process for the assessee Piro Samara, inspector at the former High Council of Justice.
    2. To declare the forfeit of the right of the assessee to be appointed as a judge or prosecutor of any level, a member of the High Judicial Council or High Prosecutorial Council, High Inspector of Justice or Prosecutor General, for a 15-year period.
    3. This decision is final and effective immediately.

    Today, on 21.01.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) 39/2019, dated 04.09.2019, corresponding to the appeal of the assessee Evelina Qirjako against decision no.178, dated 08.07.2019, of the Independent Qualification Commission.

    The presiding judge informed that the Administrative Court of Appeal has confirmed through an official letter to the AC that it is reviewing the case pertaining to the assessee, Mrs. Evelina Qirjako.

    The assessee, Mrs. Qirjako, submitted a certificate of the Administrative Court of Appeal, through which it is confirmed that the next hearing in that court is scheduled for January 26, 2021. Requesting the trial panel to collect this act as evidence, the assessee requested the postponement of the court hearing in the Appeal Chamber for another date, upon the announcement of the decision by the Administrative Court of Appeal, on the grounds that the trials are related to each other.

    Following the deliberations, the trial panel decided to collect as evidence the letter of the Administrative Court of Appeal and the certification of this court on the status of the adjudication of the case, issued to the assessee.

    Upon a majority vote, the trial panel decided to accept the request of the assessee to postpone the hearing after January 26, 2021, deciding to hold it on 03.02.2021, at 10:00 h.

    Today on 25.01.2021 a lot was drawn at the Appeal Chamber to substitute judge Luan Daci, in his capacity as member of the trial panel of case (JR) no. 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against decision no. 173, dated 01.07.2019 of the Independent Qualification Commission related to the assessee Artan Madani.

    Today, on 27.01.2021, at 10:00 h, the Appeal Chamber held the public hearing of case (JR) no.51/2020, dated 23.11.2020, corresponding to the appeal of the assessee Alaudin Malaj against decision no. 294, dated 15.09.2020, of the Independent Qualification Commission.

    Pursuant to the interim decision of the previous hearing, the assessee confirmed being acquainted with the procedural acts of the case file of the Independent Qualification Commission set at his disposal by the Chamber and submitted further explanations with regard to the filed appeal.

    In this hearing, the trial panel considered some requests of the assessee, for which it made the relevant interim decisions announced in the public hearing.

    In terms when the trial panel rejected some of the requests of the assessee Alaudin Malaj, the latter requested the recusal of all members of the trial panel from the trial of the case. Since the request for the recusal of all members of the trial panel from the trial of this case must be reviewed by another panel of the Appeal Chamber, upon lot, the trial panel decided to adjourn the trial of the case, scheduling the next hearing on 09.02.2021, at 10:00 h.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
