The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Appeal Chamber announces that today, on 03.12.2020, after reviewing  in camera the case (JR) no. 37/2019, dated 05.08.2019, corresponding to the appeal filed by the assessee Aleksandër Muskaj against decision no. 179, dated 10.07.2019 of the Independent Qualification Commission, pursuant to Article F, paragraph 3 of the Annex to the Constitution, Article 4, paragraph 5 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania, as well as in Article 51, paragraph 1, item “b” of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, the adjudication panel decided to review the case in a public hearing on Monday, 14.12.2020, at 14:00 h.

    The Appeal Chamber held today, on 14.12.2020, at 12:00, the public hearing on the case no. (JR) 17/2020, dated 02.06.2020, corresponding to the appeal filed by the assessee Arjana Liço against decision no. 247, dated 05.03.2020, of the Independent Qualification Commission.

    During her submissions, the assessee, Mrs. Arjana Liço stated that decision no. 247, dated 05.03.2020, of the Independent Qualification Commission upon which “the assessee loses the right to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or of the High Prosecution Council, High Inspector Judicial or Prosecutor General, for a period of 15 years”, is unfair, meaningless and inapplicable. The assessee, Mrs. Liço said that this sanction could not be imposed on her, as the termination of her magistrate status was due to her retirement, which is a constitutional obligation, and not due to her resignation from duty.

    For the purpose of the case review, the assessee submitted three acts, which she requested to be taken as evidence by the trial panel.

    After withdrawing for consultation, the trial panel decided to accept the acts as evidence. When asked by the presiding judge, the assessee, stated that she had no additional requests. After this procedural moment, on behalf of the trial panel, the presiding judge declared the conclusion of the judicial review of the case, and asked the assessee whether she had any final request. In conclusion, the assessee requested the trial panel to accept her appeal.

    At the end of this hearing, the presiding judge announced the adjournment of the hearing on Thursday, December 17, 2020, at 15:00 where the final decision on the case shall be announced.

    The Appeal Chamber held today, on 14.12.2020, at 14:00, the public hearing on the case (JR) 37/2020, dated 05.08.2020, corresponding to the appeal of the assessee Aleksandër Muskaj against decision no. 179, dated 10.07.2019, of the Independent Qualification Commission.

    The trial panel heard the assessee as he stated his objections to paragraph 2 of decision no. 179, dated 10.07.2019, of the Independent Qualification Commission, upon which “the assessee loses the right to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, Inspector of High Judge or General Prosecutor, for a period of 15 years”.

    For the purpose of the case review, the assessee submitted several acts, which were accepted as evidence by the trial panel.

    After the presiding judge declared the conclusion of the judicial review of the case, the assessee stated his final request: the repeal of paragraph 2 of decision no. 179, dated 10.07.2019 of the Independent Qualification Commission or annulment of paragraph 2 and the termination of the review for this part.

    The Appeal Chamber announces that today, on 17.12.2020, after having reviewed and deliberated in camera the case (JR) no.7 / 2020, dated 05.02.2020, corresponding to the appeal lodged by the assessee Astrit Haxhialushi against decision no. 225, dated 07.01.2020 of the Independent Qualification Commission, pursuant to Article F, paragraph 3 of the Annex to the Constitution, Article 4, paragraph 5 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, as well as based on Article 51, paragraph 1, item “b” of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, decided to review the case in public hearing on Monday, 28.12.2020, at 10:00.

    The decision to review the case in public hearing was made to give the assessee Astrit Haxhialushi the opportunity to be heard and defend himself regarding his case.

    The Appeal Chamber held today, on 22.12.2020, at 10:00, the public hearing on the case no. (JR) 9/2020, dated 13.02.2020, corresponding to the appeal lodged by the assessee Agim Bendo against decision no. 216, dated 04.12.2019, of the Independent Qualification Commission.

    Given that the assessee Mr. Agim Bendo was not present in the hearing, his legal representative was heard by the trial panel as he submitted his objections to paragraph 2 of decision no. 216, dated 04.12.2019, upon which “the assessee loses the right to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, Senior Judicial Inspector or Prosecutor General, for a period of 15 years”.

    For the purpose of the case review, the legal representative submitted two acts, which were accepted as evidence by the trial panel.

    After the presiding judge declared the conclusion of the judicial investigation of the case, the legal representative stated his final request, that: be reflected clearly the real ground upon which the assessee has been dismissed from office, which is that of retirement, and based on this ground, or non-application or, alternatively, restriction of the measure in accordance with the rights that the law itself grants to the assessee: the exercise of duties and functions not beyond the defined age in the law.

    At the end of this hearing, the presiding judge declared its adjournment in order to announce and deliver the final decision of the case: today, on 22 December 2020, at 13:45.

    The Appeal Chamber held today, on 23.12.2020, at 10:00 h, the public hearing of the case (JR) 39/2019, dated 04.09.2019, which corresponds to the appeal of the assessee Evelina Qirjako against decision no. 178, dated 08.07.2019, of the Independent Qualification Commission.

    The assessee, Mrs. Qirjako, submitted her preliminary request to the panel to suspend the review of her case until the final resolution of the lawsuit she filed with the Administrative Court of Appeal, as according to her, the decision that this court shall make is directly related to the review of the case in the Appeal Chamber.

    After withdrawing for consultation regarding the request of the assessee, based on Article 50 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel, by a majority vote, decided to request to the Tirana Administrative Court of Appeal information on the status of the adjudication of the case of Mrs. Evelina Qirjako and continue the examination of the case in the Appeal Chamber, after receiving this information.

    In these circumstances, the trial panel decided to adjourn the hearing until 21.01.2021, at 10:00h.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
