The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process.
Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process.
The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

The Appeal Chamber held today on 02.11.2020, at 10.00 h, the public hearing on the case (JR) no. 57/2019, dated 11.11.2019, corresponding to the appeal of the Public Commissioner and the appeal and counter-appeal of the assessee Elvin Gokaj, against decision no. 187, dated 24.07.2019 of the Independent Qualification Commission.
The Public Commissioner stated that the assessee, even after the submission of the new evidences, did not manage to prove the contrary of the appeal grounds and did not manage to reliably explain the payment of the first and second installment for the Durres apartment, as well as with regard to the transactions of the joint account of the spouse of the assessee and his relatives. The Public Commissioner stated in today’s hearing only those appeal grounds he considered as essential but he stated to stand by all appeal grounds in their entirety.
After the case-rapporteur addressed to the Public Commissioner on behalf of the trial panel several clarifying questions related to the lack of lawful income on the asset “joint account” of the assessee’s spouse, included in the appeal grounds as well as in his submissions in the hearing dated 06.10.2020, but unmentioned in today’s hearing, the trial panel upon an interim decision stated its decision-making as follows:
The trial panel needs to clarify the appeal grounds to which the Public Commissioner fully stands by and his arguments with their regards, requesting him to submit in writing without distinguishing among relevant an irrelevant grounds, as to the Appeal Chamber there cannot be such division between appeal grounds insofar they are part of the appeal.
To the purpose of a complete submission of the appeal grounds, the Public Commissioner is requested to submit as well the financial analysis about the property ‘apartment’ in Durres as well the joint account of the assessee’s spouse with his parents and his mother-in-law, as the submissions in the appeal filed by the Public Commissioner on 06.10.2020, the analysis deals only with years 2011, 2012 and 2013.
The Public Commissioner shall submit these requests of the court within 4 November 2020, at 15:00 h, at the Appeal Chamber, so that these subsequently notified to the assessee prior to the next hearing to be held on 06.11.2020, at 10:00.
The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr. 3, Tirana.
The Appeal Chamber held today, on 04.11.2020, at 10:00 h, the public hearing on the case (JR) no. 40/2018, dated 04.09.2019, corresponding to the appeal of the assessee Arjana Fullani against decision no. 186, dated 23.07.2019, of the Independent Qualification Commission.
While verifying the presence of the litigants, given that the assessee, Mrs. Arjana Fullani had informed that her legal representative during the proceedings with the Appeal Chamber was going to be Mrs. Evelina Qirjako, the adjudication panel withdrew in camera to verify the act of representation by Mrs. Qirjako. On behalf of the adjudication panel, the presiding judge stated that the court legitimizes Ms. Qirjako as legal representative of Mrs. Fullani in this process.
After this procedural moment, the legal representative stated her position on the appeal regarding paragraph 2 of decision no. 186, dated 23.07.2019, of the Independent Qualification Commission, upon which “the assessee loses the right to be appointed a judge or prosecutor of any level, as member of the High Judicial Council or the High Prosecution Council, Inspector of High Judge or General Prosecutor, for a period of 15 years”.
The legal representative stated that the decision of the Independent Qualification Commission is vulnerable in its paragraph 2, rendered on evidences that do not exist, on invalid and illegal evidence and in clear violation of the procedural law and of the due legal administrative process.
Further on, the adjudication panel upon consultation on the spot, by a majority vote, decided to conclude the judicial review of the case. The presiding judge asked the assessee, Mrs. Fullani, whether as an appealing party, she was ready to state the final conclusions on today’s hearing or if she needed additional time to prepare for them. The legal representative stated that the final conclusions would add nothing more to the elaborated arguments she had stated in today’s hearing.
At the request of the presiding judge, the legal representative stated the final request, upon which the assessee asked the Appeal Chamber to amend paragraph 2 of decision no. 186, dated 23.07.2019, of the Independent Qualification Commission and the termination of adjudication for this case, given that object it was initiated has become impossible, pursuant to Article 95, of the Code of Administrative Procedure.
After hearing the final request of the assessee, the adjudication panel withdrew to make the final decision on the case, which shall be announced on 11.11.2020, at 10.00.

The Appeal Chamber held on 06.11.2020, at 10:00, the public hearing on the case (JR) no. 57/2019, dated 11.11.2019, corresponding to the appeal of the Public Commissioner and the appeal and counter-complaint of the assessee Elvin Gokaj, against decision no. 187, dated 24.07.2019 of the Independent Qualification Commission.
The presiding judge confirmed that the Public Commissioner had submitted with the Appeal Chamber the clarified and elaborated appeal grounds, in fulfillment of the tasks assigned by the adjudication panel upon an intermediate decision, in the hearing of 2 November 2020.
While the Public Commissioner stated that he stands by the appeal grounds elaborated by him, the legal representative of the assessee confirmed the she had gotten acquainted with these appeal grounds as the Appeal Chamber had made them available to her and she stated the position of the assessee with regard to the appeal grounds filed by the Public Commissioner.
The legal representative stated that the evidence submitted by the assessee is sufficient to dismiss the appeal grounds of the Public Commissioner and deemed that the financial analysis of the Public Commissioner is not in accordance with the law and the evidence.Following the submission of the assessee and after an extensive court debate on the appeal and financial analysis, on behalf of the adjudication panel the case rapporteur stated their decision-making, which is as follows:
Given that the adjudication panel continues to remain unclear about the appeal grounds filed by the Public Commissioner – in order to clarify them and be more specific, especially with regard to the joint bank account for which the Public Commissioner has claimed that based on the provisions of the Civil Code, the assessee’s spouse has 50% share, – the adjudication panel requests from the Public Commissioner to submit within 9 November 2020, at 15:00, the analysis on the financial capacity of the assessee and his spouse to create these accounts on the date of their creation.
This analysis has to be carried out in function of the claim of the Public Commissioner for lack of lawful sources until the creation date of these accounts and not until the end of the year of their creation, as it was carried out the financial analysis which was deliberated in today’s hearing.
The presiding judge announced that by 9 November 2020, the new financial analysis will be forwarded to the assessee, so that he can prepare to state his position regarding this analysis at the next hearing, which shall be held on 11 November 2020, at 12:00. The litigants must be prepared to state their final conclusions in this hearing.

The adjudication panel of the Appeal Chamber, composed of judges, Presiding Judge Albana Shtylla, case rapporteur Natasha Mulaj and members Ina Rama, Rezarta Schuetz, Sokol Çomo, announced today the decision on the case (JR) no. 40/2019, dated 04.09.2019, corresponding to the appeal filed by the assessee Arjana Fullani against decision no. 186, dated 23.07.2019, of the Independent Qualification Commission.
In conclusion of the adjudication, pursuant to Article G of the Annex to Constitution, Article 66 paragraph 1/a, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, upon majority votes, decided:
Upholding of decision no.186, dated 23.07.2019 of the Independent Qualification Commission, corresponding to the assessee Arjana Fullani.
On 11.11.2020 at 12:00, the Appeal Chamber held the public hearing on the case (JR) no. 57/2019, dated 11.11.2019, corresponding to the appeal of the Public Commissioner and the appeal and counter-appeal of the assessee Elvin Gokaj against decision no. 187, dated 24.07.2019 of the Independent Qualification Commission.
The presiding judge confirmed that in fulfillment of the tasks assigned by the adjudication panel, upon an interim decision in the hearing of 6 November 2020, the Public Commissioner had submitted with the Appeal Chamber the new financial analysis, and this analysis had been made available to the assessee.
The assessee confirmed that he had gotten acquainted with the financial analysis of the Public Commissioner and objected the results of this analysis, stating that his spouse was only entitled to representation in the joint bank accounts and not that of co-ownership.
After hearing the objections of the assessee and after the litigants declared that they had no further claims, the adjudication panel concluded the judicial review of the case and invited the litigants to state their final conclusions.
While putting forward the final conclusions, the Public Commissioner stated that he stands by all the appeal grounds, as the assessee failed to prove the opposite of the results. The Public Commissioner deemed that the assessee is in the conditions of lack of full disclosure regarding the assets assessment criterion and asked the Appeal Chamber to amend the decision no. 187, dated 24.07.2019 of the Independent Qualification Commission and dismiss the assessee from office.
On behalf of the assessee, the legal representative, opposed all the appeal grounds and asked the Appeal Chamber to not accept the appeal of the Public Commissioner but to confirm the assessee in office.
Following the final conclusions from the litigants, the adjudication panel withdrew to render the final decision on the case, which shall be announced on 18.11.2020, at 12.00 h.
