The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Appeal Chamber informs that today, on 02.03.2021, after considering in chambers the case (JR) no.3/2021, dated 14.01.2021, which corresponds to the appeal of the assessee Bilbil Mete against decision no. 322, dated 10.12.2020 of the Independent Qualification Commission, based on Article F, paragraph 3, of the Annex of the Constitution, Article 4, paragraph 5, of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, and Article 51, paragraph 1/b, of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, decided upon a majority vote to transfer the case for review in a public hearing, in order to provide the assessee the opportunity to be heard and provide explanations with regard to his case.

    The adjudication panel of the Appeal Chamber, composed of judges, Presiding Judge Ina Rama, case rapporteur Rezarta Schuetz and members Albana Shtylla, Ardian Hajdari, Sokol Çomo, delivered the judgment on the case (JR) no. 38/2019, dated 04.09.2019, corresponding to the appeal of the assessee Idriz Mulkurti, against decision no. 159, dated 14.06.2019 of the Independent Qualification Commission.

    In conclusion of the review, pursuant to Article 66, paragraph 1, item “a”, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel unanimously, ruled on:

    1. Upholding of decision no. 159, dated 14.06.2019 of the Independent Qualification Commission, corresponding to the assessee Idriz Mulkurti.
    2. This decision is final and effective immediately.

    The Appeal Chamber held today, on 10.03.2021, at 10:00, the public hearing on the case (JR) 46/2019, dated 25.09.2019, corresponding to the appeal of the Public Commissioner against decision no. 161, dated 18.06.2019, of the Independent Qualification Commission related to the assessee Kastriot Selita.

    While verifying the presence of the parties, the presiding judge noticed that the Public Commissioner Mr. Florian Ballhysa, who has filed an appeal for the case (JR) no. 46/2019, dated 25.09.2019, was not present. Mr. Ballhysa had informed the Appeal Chamber by e-mail that, due to health reasons, he was unable to attend the hearing and requested that it be adjourned for an appropriate time.

    Given that the other Public Commissioner Mr. Darjel Sina, also due to health reasons, was unable to attend the hearing, the trial panel, based on Article 175, paragraph 2, of the Code of Civil Procedure, decided to adjourn the public hearing on 17.03.2021, at 10:00.

    The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

    Today, on 10.03.2021, the Appeal Chamber held the lot drawing for the replacement of Judge Luan Daci, assigned as member on the case (JR) no. 1/2020, dated 08.01.2020 corresponding to the appeal of the assessee Përparim Kulluri against decision no. 202, dated 06.11.2019 of the Independent Qualification Commission.

    The Appeal Chamber held today, on 11.03.2021, at 10:00, the public hearing on the case (JR no. 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

    While verifying the presence of the parties, the presiding judge noticed that the Public Commissioner Mr. Florian Ballhysa, who has filed an appeal for the case (JR) no. 55/2019, dated 29.10.2019, was not present.     The Appeal Chamber held today, on 16.03.2021, at 10:00, the public hearing on the case (JR) 3/2021, dated 14.01.2021, corresponding to the appeal lodged by the assessee Bilbil Mete against the decision of the Independent Qualification Commission no. 322, dated 10.12.2020.

    The trial panel heard the assessee Bilbil Mete as he submitted his objections to paragraph 2 of decision no. 322, dated 10.12.2020, according to which “the assessee loses the right to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or the High Prosecution Council, Senior Judicial Inspector or Prosecutor General, for a period of 15 years”.

    For the purpose of case review, the Appeal Chamber accepted in the quality of evidence the written acts submitted by the assessee attached to the appeal, to the submissions and some other acts submitted during today’s public hearing at the request of the trial panel.

    The presiding judge stated the conclusion of the judicial review by a majority vote. As a final request, the assessee, stated that he stands by all he has put forward in his appeal. The hearing was adjourned on 23.03.2021, at 13:00 when the final judgment shall be delivered.

    The Appeal Chamber held today, on 17.03.2021, at 10:00, the public hearing of the case (JR) 46/2019, dated 25.09.2019, corresponding to the appeal of the Public Commissioner against decision no. 161, dated 18.06.2019, of the Independent Qualification Commission related to the assessee Kastriot Selita.

    While verifying of the presence of the litigants, the presiding judge ascertained the presence of the Public Commissioner, Mr. Florian Ballhysa and of the assessee, Mr. Kastriot Selita, who stated that they had no claims regarding the composition of the trial panel, and confirmed that they had received the 12 denunciations filed against the assessee that had been made available to them by the Appeal Chamber.

    After the presiding judge announced the opening of the hearing, the Public Commissioner stated the appeal grounds regarding the asset assessment criterion, and cited several legal issues that according to him, need to be evaluated and interpreted by the Appeal Chamber; he stated as well the need for further investigation. Regarding the proficiency assessment criteria, the Public Commissioner, referring to the submitted denunciations, deemed that the Independent Qualification Commission has not exhaustively investigated them. The Public Commissioner requested the Appeal Chamber to open a judicial investigation in order to investigate the appeal grounds and the eventual administration of new evidence.

    The assessee stated his elaborated objections to the appeal grounds by the Public Commissioner, considering them as unfounded in law and evidence; while referring to the denunciations addressed to him, he stated that he has avoided the conflict of interest in any case during the exercise of duty. The assessee requested the Appeal Chamber that for the purpose of the case review, to accept as evidence the new acts that the assessee submitted during today’s hearing, attached to his submissions.

    Taking into account the request of the Public Commissioner for a reasonable time to be acquainted and state his opinion regarding the content of new acts and denunciations submitted to the Appeal Chamber, the trial panel by consultation on the spot, decided to adjourn the public hearing to 01.04. 2021 at 10:00. The presiding judge stated that in the upcoming hearing, the trial panel shall as well state its opinion regarding the decision on whether to open the investigation and take as evidence the acts submitted by the assessee, or not.

    The Appeal Chamber held today, on 18.03.2021, at 10:00, the public hearing on the case (JR) no. 55/2019, dated 29.10.2019, corresponding to the appeal of the Public Commissioner against decision no. 173, dated 01.07.2019, of the Independent Qualification Commission related to the assessee Artan Madani.

    After the litigants stated that they had no prior requests, the presiding judge declared the opening of the hearing and of the judicial review.

    While submitting the appeal grounds on the asset assessment criterion, the Public Commissioner stated that pursuant to Article 61, paragraph 3 and 5, of Law 84/2016, the assessee is found in the conditions of inaccurate and lack of full disclosure regarding his assets, thus, violating the public trust. The Public Commissioner requested the Appeal Chamber to review the appeal grounds, to amend decision no. 173, dated 01.07.2019, of the Independent Qualification Commission and to dismiss from office the assessee Artan Madani.

    The assessee and his legal representative objected the appeal ground filed by the Public Commissioner and asked the Appeal Chamber to reopen the judicial investigation and to accept as evidence the new acts that they submitted in today’s hearing, attached to his submissions.

    After withdrawing for consultation, the trial panel, pursuant to Article F, paragraph 3 of the Annex to the Constitution and Article 45 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, decided to collect as evidence only a portion of the acts filed by the assessee in today’s hearing, as it deemed that the rest of the acts were not in the form as required by the law. These acts were given back to the assessee, giving him the opportunity to re-submit them in the form required by law in the following hearing that shall be held on 13.04.2021, at 10:00.

    On 30.03.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 28/2020, dated 10.07.2020, corresponding to the appeal of the Public Commissioner against decision no. 231, dated 29.01.2020, of the Independent Qualification Commission related to the assessee Anton Martini.

    Following the verification by the presiding judge of the litigants’ presence, the legal representative of assessee submitted a preliminary request, upon which he asked the trial panel to consider the dismissing of the Public Commissioner’s appeal.

    After withdrawing for consultation, the trial panel decided that the request of the assessee regarding the object of his appeal, shall be addressed and analyzed in the framework of the overall assessment of the Public Commissioner’s appeal, pursuant to the provisions of Article 450, paragraph 3 of Code of Civil Procedure.

    During the submission of the appeal grounds, the Public Commissioner deemed that the assessee fails to reach a trustable level to be confirmed in office for his assets assessment and the proficiency assessment criteria and that the decision of the Independent Qualification Commission is vulnerable in its entirety. The Public Commissioner requested the Appeal Chamber to take into consideration the appeal grounds, to amend decision no. 231, dated 29.01.2020, of the Independent Qualification Commission and dismiss from office the assessee Anton Martini.

    Initially, the legal representative of the assessee submitted his submission for the dismissal of the Public Commissioner’s appeal, claiming that this appeal was lodged outside the legal deadline of 15 days.

    Then, the legal representative and the assessee thoroughly read out loud their objections in response to the appeal of the Public Commissioner, by submitting new acts for the purpose of the case review.

    After hearing the submissions of the parties, the trial panel decided to make available to the Public Commissioner and to the assessee three public denunciations and asked them to comment on them, in formal terms, at the next hearing scheduled to be held on 01.04. 2021, at 14:00. The trial panel asked the Public Commissioner that in the same hearing, to state his position whether the new submitted acts by the assessee in today’s hearing contain all of the required formal elements.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
