The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

    The Appeal Chamber held on 04.03.2022, at 10:00, the public hearing of case (JR) 62/2019, dated 12.12.2019, pertaining to the appeal of the assessee Dhurata Haveri against decision no. 197, dated 27.09.2019, of the Independent Qualification Commission.

    Pursuant to Article 45 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel decided to accept as evidence the written acts submitted by the witness in the previous hearing.

    The presiding judge informed the court that based on Article 49, para 10, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the International Observer of the International Monitoring Operation had filed a finding with the Appeal Chamber, which had become part of the case file, and it has forwarded it to the assessee, Mrs. Dhurata Haveri, for which her legal representative held a position during today’s hearing.

    Pursuant to Article 47, of Law no. 49/2012 “On administrative courts and adjudication of administrative disputes”, as amended, as well as Article 49, para 6 (a), (b), (d) of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the trial panel decided to reject the request of the legal representative to accept as evidence in their entirety the acts submitted with the Appeal Chamber during the period October – December 2021.

    Once the assessee stated that there were no additional requests, the trial panel decided to terminate the judicial investigation of the case, inviting the assessee to present the final conclusions.

    In conclusion, the assessee requested the Appeal Chamber to overrule decision no. 197, dated 27.09.2019 of the Independent Qualification Commission and the continuation of the re-evaluation process for the other two criteria, the background and proficiency ones; or alternatively, to amend decision no. 197, dated 27.09.2019 of the Independent Qualification Commission and confirmation in office of the assessee, Mrs. Dhurata Haveri.

    The trial panel, after hearing the final requests of the assessee, decided to withdraw to make the final decision, to be announced on 15.03.2022, at 09:00.

    Today, on 08.03.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 42/2021, dated 27.07.2021, pertaining to the appeal of the Public Commissioner against decision no. 363, dated 01.04.2021, of the Independent Qualification Commission related to the assessee Elizabeta Imeraj.

     

    During the verification of the presence of the parties, the presiding judge ascertained the absence of the assessee, Mrs. Elizabeta Imeraj, who had officially notified the Chamber that, due to health reasons, she was unable to attend the hearing and requested its adjournment.

    Today, on 11.03.2022, at 10:00, the Appeal Chamber held the public plenary session of case (JD) no. 2/2021, dated 26.03.2021, corresponding to the appeal of the petitioner Markelian Kuqo, against decision no. 633, dated 10.12. 2020 of the High Judicial Council, “On the imposition of a disciplinary measure against Judge Markelian Kuqo”, and interested parties, the High Judicial Council and the High Inspector of Justice.

     

    Following the previous hearing, the representative of the High Judicial Council and the representatives of the High Inspector of Justice responded to the appellant’s questions concerning the circumstances that led to decision no. 633, dated 10.12.2020 of the High Judicial Council “On the imposition of the disciplinary measure against Judge Markelian Kuqo”.

     

    The appellant, Mr. Markelian Kuqo submitted his counter-arguments related only to certain responses of the interested subjects, and requested: making available the audio cd of a hearing on his account held before the High Judicial Council, on December 10, 2020, and the appropriate time to address his submissions regarding the remainder of the responses of the interested parties.

     

    After hearing the position of the interested parties, who considered inadmissible both requests of the appellant, the trial panel decided to reject the first request, considering that it is required to produce a circumstance that did not occur during the disciplinary proceedings at the HJC. The trial panel decided to reject the second request as well, inviting the appellant to take a position on the remaining responses following today’s hearing.

     

    The appellant, Mr. Markelian Kuqo refused to submit his position on the remaining responses during today’s hearing, but requested the administration as evidence of the submissions as far as he submitted already.

     

    Referring to the circumstances of the case under review, the lack of the final and complete control of the judicial system over the sole decision-making of the magistrate considered to have constituted a disciplinary misconduct, interpretation and analysis of the criminal law with respect to the case in question, in the absence of a unified case-law by the High Court, considering that a decision on the appellant’s disciplinary proceedings would be exposed without a final position of the High Court on the matter – as the competent court for matters of law – pursuant to Article 1, second paragraph of Law no. 8577, dated 10.02.2000 “On the organization and functioning of the Constitutional Court of the Republic of Albania”, as amended, and Article 297 (a) of the Civil Procedure Code, by a majority vote, the Appeal Chamber decided:

     

    • To suspend the trial of the disciplinary jurisdiction case no. 2/2021, pertaining to the appellant Markelian Kuqo, until the final resolution of the penal case related the appeal of the citizen G. Gj at the High Court.

     

    • To notify this decision to the High Court.

    Today, on 15.03.2022, at 10:00, the Appeal Chamber held the public plenary session of case (JD) no. 3/2021, dated 30.04.2021, pertaining to the appeal of the appellant Bujar Memia against decision no. 81, dated 31.03. 2021 of the High Prosecutorial Council “On imposing a disciplinary measure against prosecutor Bujar Memia”, with interested parties, the High Inspectorate of Justice (HIJ) and the High Prosecutorial Council (HPC).

    The appellant submitted with the Chamber two preliminary requests:

    • finding the absolute partial invalidity of decision no. 3, dated 09.11.2021 of the Preliminary Review Panel for the notification of the trial in a public plenary session, related to the composition of the trial panel, of the Disciplinary Jurisdiction case no. 3/2021, at the Appeal Chamber.
    • suspension of the trial until the exercise of the constitutional review before the Constitutional Court of the phrase “for the organization and functioning of the Constitutional Court”, provided for in Article 5, paragraph 3 of Law 84/2016 and Article 6, paragraph 4 and Article 104 of Law 115/2016 “On the governing bodies of the justice system”.

    Once the interested parties argued their position on the rejection of the requests of the appellant, the trial panel, after being consulted, decided: the rejection of the first request, under Articles 133, 148/d, para 3 and 179/7 of the Constitution of the Republic of Albania, Article 5, para 3 (b) of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, Article 71, para 3, of Law 8577/2000 “On the organization and functioning of the Constitutional Court of Republic of Albania”, as amended.

    As regards the second request, the Chamber considered that it is not found in terms of Article 145, paragraph 2, of the Constitution of the Republic of Albania and in none of the cases provided for in Article 297 of the Civil Procedure Code, therefore, it decided to reject it as well.

    After the main trial of the case was opened and the Judge Rapporteur summarized the appeal of Mr. Bujar Memia, his legal representative presented in detail the objections to the decision no. 81, dated 31.03. 2021 “On imposing a disciplinary measure against prosecutor Bujar Memia”, related to the procedural features, as well as concerning the merits of the cases upon which this decision was founded.

    Due to the duration of the hearing, the trial panel decided to adjourn it, to be continued on 07.04.2022, at 09:00, with the submissions of the appellant Bujar Memia and of the interested parties at this trial.

    Today, on 23.03.2022, at 10:00, the Appeal Chamber held the public plenary session of case (JD) no. 4/2021, dated 21.05.2021, pertaining to the appeal of the appellant Enkeleida Hoxha against decision no. 92, dated 17.03.2021 of the High Judicial Council, with interested parties, the High Judicial Council (HJC) and the High Inspector of Justice (HIJ).

    Following the verification of the presence of the parties, during which it was ascertained the presence of the lawyer, and the absence of the appellant, Mrs. Enkeleida Hoxha, the presiding judge informed the parties that on March 18, 2022, Mrs. Hoxha had submitted to the Chamber a request for the postponement of the hearing or suspension of the trial on grounds that the HJC had refused to make available to her certain acts, according to her, necessary for the proceedings at the Appeal Chamber.

    The representatives of the interested parties of the High Judicial Council (HJC) and the High Inspector of Justice (HIJ) stated that all documents in view of this trial are found in the case file administered by the Chamber at the initiation of the trial and that the appellant’s request should be refuted as unfounded on reasonable grounds.

    Following the consultations, the Chamber decided to reject the request on the grounds that it failed to contain reasonable grounds for postponing the hearing. Given that the appellant had consented that the proceedings at the Appeal Chamber could take place in her presence and in her absence, the trial panel decided that the trial should continue in the presence of Ms. Enkeleida Hoxha’s lawyer, Mr. Ardian Visha.

    Once the main trial was opened and once the rapporteur – at the same time the presiding judge – submitted briefly the appeal grounds, the lawyer submitted several procedural requests, through which he requested the reopening of the judicial investigation, the collection of new evidence and the summoning of witnesses.

    Once the representatives of the interested parties stated their position on the rejection of these claims and after the trial panel withdrew for consultation, it decided:

    • Rejection of the request for summoning witnesses, as it does not meet the requirements for their identity, under Article 231 of the Civil Procedure Code. Also, the court considers that the summoning of witnesses is not necessary to clarify the facts in the case under review, in compliance with Article 41 of Law no. 8577/2000 “On the organization and functioning of the Constitutional Court of the Republic of Albania”, as amended.

     

    • Rejection of the demand for requesting acts from Penitentiary Institutions and Probation Service, as it is assessed that these acts are not necessary for the review of the case, under Article 42, paragraph 1 of Law no. 8577/2000 “On the organization and functioning of the Constitutional Court of the Republic of Albania”, as amended.

    After hearing the decision of the trial panel, the lawyer requested the adjournment of the hearing, stating that at this point in the proceedings, it was required the attendance of the appellant to proceed with the submissions.

    After the representatives of the interested parties stated their position on the rejection of the request, the trial panel withdrew for consultation.

    Taking into account the specific circumstances of the appellant, her limited freedom, and the difficulty of guaranteeing an effective defense by the lawyer without the presence of the appellant, the trial panel decided to accept the request of the lawyer Ardian Visha to postpone the trial, to provide the opportunity to hear the appellant Enkeleida Hoxha in person.

    Today, on 24.03.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 26/2020, dated 01.07.2020, corresponding to the appeal of the assessee Edmond Hyka against decision no. 223, dated 20.12.2019 of the Independent Qualification Commission.

    The assessee and his legal representative were heard by the trial panel regarding the submissions on the appeal grounds filed against decision no. 223, dated 20.12.2019 of the Independent Qualification Commission.     The Public Commissioner submitted the appeal grounds related to the asset assessment, requesting the Appeal Chamber to take them into consideration, open the judicial investigation, collect relevant evidence and calculate the data in order to verify the financial sources that have served to create the assets of the assessee, according to the requests in the appeal.

    Consequently, the trial panel, upon an interim decision, by a majority vote, pursuant to Article 315 of the Civil Procedure Code, decided to revoke the interim decision to terminate the judicial investigation and reopen this investigation in order to make available to the assessee the opinion of the International Observer.

    In order to enable the assessee to be acquainted and take a position with respect to this opinion, the hearing was postponed to April 12, 2022, at 09:00.

    The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Today, on 31.03.2021, at 10:00, the Appeal Chamber held the public hearing of case (JR) 40/2021, dated 23.07.2021, pertaining to the appeal of the Public Commissioner against decision no. 393, dated 03.06.2021, of the Independent Qualification Commission, related to the assessee Gerd Hoxha.

    During the verification of the presence of the parties, the presiding judge informed the court that the Public Commissioner, Mr. Darjel Sina, had informed the Chamber that due to objective reasons it was impossible for him to attend today’s hearing.

    In his absence, the other Public Commissioner Mr. Florian Ballhysa, present at the hearing, stated that in this case, he had become part of the hearing as a representative of the institution of Public Commissioners having all the entitlements set forth by law and left the continuation of the hearing at the court discretion.

    Once the assessee expressed his position for the continuation of the hearing, the panel, after being consulted, decided by a majority vote to adjourn today’s hearing due to the incapacity of the International Observer to attend it, who had requested some additional time to get acquainted in detail with the content of the assessee’s written objections.

    The next hearing will take place on April 5, 2022, at 10:00, in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

    Today, on 31.03.2021, at 12:30, the Appeal Chamber held the public hearing of case (JR) 42/2021, dated 27.07.2021, pertaining to the appeal of the Public Commissioner against decision no. 363, dated 01.04.2021, of the Independent Qualification Commission, related to the assessee Elizabeta Imeraj.

    The lawyer of the assessee submitted his position regarding the findings of the International Observers, claiming that they do not meet the criteria to be accepted as evidence by the trial panel.

    The assessee, Mrs. Elizabeta Imeraj continued with the objections to the three evaluation criteria, referring to the appeal grounds of the Public Commissioner, requesting the Chamber to accept as evidence all the acts referred by her in support of the raised claims.

    Subsequently, the Public Commissioner responded to some questions of the lawyer of the assessee with respect to the findings of the International Observers, stating that the inclusion of the findings as evidence in the appeal is founded in Article “B” of the Annex to the Constitution, as well as Article 49, paragraph 10 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    The trial continued with a series of questions and responses between the International Observer of the International Monitoring Operation and the assessee regarding the asset and background assessment criteria.

    Due to the duration of the hearing, the trial panel decided to postpone it to the next day, on April 1, 2022, at 11:00, to follow with the responses of the Public Commissioner to the questions that the assessee and her lawyer submitted before the closure of today’s hearing.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
