The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    Today, on 01.06.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 28/2020, dated 10.07.2020, regarding the appeal of the Public Commissioner filed against decision no. 231, dated 29.01.2020, of the Independent Qualification Commission corresponding to the assessee Anton Martini.

    While submitting the final conclusions, the Public Commissioner objected as unfounded in law, the claim of the assessee that the Public Commissioner has filed his appeal outside the legal time limits of 15 days and stated that he stands by the submitted appeal grounds and submissions presented in the preceding hearings with the Appeal Chamber regarding the asset and proficiency assessment criteria.

    The Public Commissioner stated that even after the new submitted evidence, the assessee failed to prove the opposite of the appeal grounds. With regard to the assets assessment criterion, the Public Commissioner deemed that the assessee has made inaccurate declaration and lacked full disclosure for his assets as well as lacks the lawful financial sources, while in terms of proficiency, the assessee has undermined the public trust as a prosecutor.

    Pursuant to Article F, paragraph 3 and 7 of the Annex to the Constitution, Article 61, paragraph 3, 4 and 5, as well as Article 66 of Law 84/2016, the Public Commissioner requested the amendment of decision no. 231, dated 29.01.2020, of the Independent Qualification Commission and dismissal from office of the assessee Anton Martini.

    During the submission of the final conclusions, the legal representative of the assessee objected the appeal grounds, stating that the Public Commissioner has reached incorrect and untrue conclusions. The assessee stated that through the reasoning based on the new evidence submitted during the proceedings carried out with the Appeal Chamber, he managed to prove the opposite of the appeal for both the assessment criteria; the asset and proficiency criteria. The assessee requested the Appeal Chamber to not accept the appeal of the Public Commissioner on the grounds that it was filed outside the legal time limits, as well as asked the Chamber to uphold decision no. 231, dated 29.01.2020, of the Independent Qualification Commission.

    After having heard the final conclusions of the litigants, the trial panel withdrew to make the final judgment, which shall be delivered on 10.06.2021, at 15:00.

    The public hearing shall take place at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.

    Today, on 10.06.2021, at 09:00, the Appeal Chamber held the public hearing of the case (JR) 31/2019, dated 13.06.2019 regarding the appeal of the assessee Irma Balli filed against decision no. 109, dated 19.02.2019 of the Independent Qualification Commission

    The assessee, Irma Balli, was heard by the trial panel as she submitted her objections to decision no. 109, dated 19.02.2019, according to which, “the assessee failed to reached a trustable level in the assets assessment criterion”. For the purpose of the case review, the trial panel allowed to collect as evidence the acts filed by the assessee, Mrs. Balli, in support of her claims.

    After some clarifying questions of the presiding judge and case rapporteur addressed to the assessee regarding the case and after Mrs. Balli stated that she had no other additional requests, the presiding judge declared the conclusion of the judicial trial.

    In her final request, the assessee asked the Appeal Chamber that based on the law and the submitted evidence to declare that the assessee Irma Balli passes the reliability test regarding the asset assessment criterion.

    The trial panel decided to adjourn the public hearing, in order to deliver the final judgment on the case, on 15.06.2021, at 14:00.

    Today, on 17.06.2021, at 09:00, the Appeal Chamber held the public hearing of the case (JR) 46/2019, dated 25.09.2019, corresponding to the appeal of the Public Commissioner filed against the decision no. 161, dated 18.06.2019, of the Independent Qualification Commission related to the assessee Kastriot Selita.

    The presiding judge communicated to the parties that the Appeal Chamber had received the replies from the Ministry of Finance and the General Directorate of Taxes, following the requests of the Appeal Chamber addressed to these institutions for information, on whether pursuant to the legislation in force, the monetary amounts obtained by individuals through donation have been taxed or are taxed in the Republic of Albania over the years.

    After the parties confirmed that they had gotten acquainted with the new documentation, the presiding judge cited the responses of the institutions, where, inter alia, mentioned that the monetary amounts obtained by individuals through donation are not taxed, and invited the parties to state their positions in this regard.

    The Public Commissioner, while stating his position, with reference to article 155 of the Constitution of the Republic of Albania and law no. 8438, dated 28.12.1998, “On income tax”, as amended, stated that he stands by the recommendation of the international observers of the International Monitoring Operation and the final statements held in this trial, upon which the monetary amounts obtained by individuals through donation, are taxed.

    The assessee objected the position of the Public Commissioner, by stating that it is a repulsive attitude towards the law, facts and evidence submitted within this process. The assessee, also in reference to law no. 8438, dated 28.12.1998, “On income tax”, as amended, stated that monetary amounts obtained by individuals through donation, are not taxed.

    The trial panel, after hearing the positions of the parties, having consulted on the spot, decided to collect as evidence the answers received from the Ministry of Finance and the General Directorate of Taxes, and withdrew to make the final judgment on the case, which shall be delivered on 18 June 2021, at 12:00.

    Today, on 21.06.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) no. 3/2020, dated 14.01.2020 corresponding to the appeal of the Public Commissioner filed against decision no. 200, dated 16.10.2019, of the Independent Qualification Commission related to the assessee Besim Hajdarmataj.

    The Public Commissioner submitted the appeal grounds regarding the two re-evaluation criteria for the assessee: the proficiency and the asset assessment criteria, as well as the overall evaluation on the case, asking the Appeal Chamber to amend the decision of the Independent Qualification Commission subject to review and dismissal of the assessee.

    The assessee and his legal representative objected the appeal grounds filed by the Public Commissioner, claiming that they were non-objective, disproportionate, unfounded in law, in evidence or the circumstances of the case. In support of these claims, in addition to some acts filed with the Appeal Chamber on 15.06.2021 – which were forwarded in advance to the Public Commissioner – the assessee filed new acts attached to objections submitted in today’s hearing, by requesting the reopening of the judicial investigation of the case.

    At the request of the presiding judge, the Public Commissioner stated his position regarding the denunciations filed in the name of the assessee, Mr. Hajdarmataj, by deeming that they contain no circumstances that should be included in the appeal grounds.

    In order for the Public Commissioner to have the appropriate time to comment on the acts filed by the assessee, the trial panel decided to adjourn the public hearing on 06.07.2021, at 12:00.

    Today, on 21.06.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 50/2019, dated 14.10.2019, corresponding to the appeal of the Public Commissioner filed against decision no. 190, dated 26.07.2019, of the Independent Qualification Commission related to the assessee Ramiz Lala.

    Following the previous hearing, the presiding judge informed the parties that the Appeal Chamber had received the responses from the First Instance Administrative Court of Gjirokastra and the Administrative Court of Appeal Tirana, following the request of the Appeal Chamber for further investigation of the case.

    After the parties confirmed that they had gotten acquainted with the new documentation as well as with the preliminary financial analysis carried out by the Legal Service Unit of the Appeal Chamber for years 2011, 2014, 2015 and 2016, the trial panel decided to accept these acts in the quality of evidence.

    While stating his position regarding the new evidence, the Public Commissioner held that pursuant to Article 72, paragraph 2, of Law 96/2016 “On the status of judges and prosecutors in the Republic of Albania, as amended, the assessee has deficiencies regarding the proficiency criterion. Based on the financial analysis, The Public Commissioner deemed that the assessee lacks the lawful financial sources regarding the asset assessment criterion.

    The assessee objected the position of the Public Commissioner on the proficiency and assets criterion and in support of his claims, in addition to the submissions, he filed a new act, which was accepted as evidence by the trial panel.

    After the parties stated that they had no additional requests or evidence, the trial panel decided to conclude the judicial investigation of the case and invited the parties to be prepared to state their final conclusions at the next hearing which shall be held on 07.07.2021, at 08:30.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
