The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process.
Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process.
The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

Today on 01.06.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 14/2020, dated 01.06.2020, pertaining to the appeal of the assessee Anila Guri against decision no. 184, dated 19.07.2019 of the Independent Qualification Commission.
The assessee, Mrs. Anila Guri, was heard by the trial panel as she filed her objections against decision no. 184, dated 19.07.2019 of the Independent Qualification Commission, for which, she claimed that it was made contrary to the evidence and lacks observance of the principle of proportionality.
The assessee responded to some questions of the International Observer of the International Monitoring Operation and two of the trial panel members regarding the assets criterion, in view of the consideration of the case.
Once the assessee stated that she had no other procedural requirements, the trial panel decided to close the judicial investigation of the case and invited the assesse to submit the final conclusions.
Finally, the assessee requested that the Appeal Chamber, following a complete, objective and proportional evaluation of the case, decides the amendment of decision no. 184, dated 19.07.2019 of the Independent Qualification Commission and confirmation in office of the assessee, Mrs. Anila Guri.
After hearing the final conclusions of the assessee, the trial panel withdrew to make the final decision, to be announced on June 10, 2022, at 09:30.

Today, on 07.06.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 35/2020, dated 11.09.2020, pertaining to the appeal of the Public Commissioner against decision no. 255, dated 08.06.2020, of the Independent Qualification Commission, related to the assessee Ludovik Dodaj.
The Public Commissioner, while submitting the appeal grounds, held that the assessee is found in terms of inaccurate and insufficient declaration for the asset assessment and that he fails to reach a reliable level for his confirmation in office.
The Public Commissioner stated also that as regards the proficiency assessment, from the acts administered in the IQC file, he had found some elements which he requested the Chamber to consider in the re-evaluation of the assessee Ludovik Dodaj, on the basis of the overall assessment of the proceedings, under Article 4, paragraph 2 and Article 61/5 of Law no. 84/2016.
The Public Commissioner requested the Chamber to consider the appeal grounds and at the conclusion of the trial of the case, to decide the amendment of the IQC decision no. 255, dated 8.6.2020 and dismissal from office of the assessee.
The legal representative of the assessee objected the appeal grounds, claiming that they are unfair and stated that the assessee has convincingly explained the legitimacy of his income. To support the submissions, the assessee filed several acts, which he requested the trial panel to collect them as evidence, and requested the Chamber to partially reopen the judicial investigation of the case.
After being consulted, the trial panel decided to open the judicial investigation and administer as evidence the acts listed by the legal representative of the assessee in today’s hearing. The trial panel, by a majority vote, decided also to request a case file from the Durres Judicial District Court, to the purpose of the consideration of the case.
The Public Commissioner, when asked by the presiding judge with regard to the evidence administered by the trial panel, specified that he reserved the right to make a statement after being acquainted with the case file which the interim decision of the trial panel referred to.
The trial panel, pending the administration of the case file by the Durres Judicial District Court, decided to postpone the court hearing until 27.06.2022, at 10:00, and invited the parties to prepare also for the final conclusions of the case.

The Appeal Chamber held on 08.06.2022, at 10:00, the public hearing of case (JR) 31/2020, dated 30.07.2020, pertaining to the appeal of the assessee Adnand Xhelili against decision no. 237, dated 12.02.2020 of the Independent Qualification Commission of.
During the verification of the presence of the parties, the presiding judge noticed the absence of the assessee, Mr. Adnand Xhelili, who had previously informed the Chamber that, due to health reasons, it was impossible for him to participate in the hearing and requested its adjournement, submitting the relevant medical documentation.
The trial panel, after reviewing the request and the attached documentation submitted by the assessee, decided to postpone the public hearing on July 26, 2022, at 10:00, inviting the assessee that in case of the impossibility to appear in person, to attend the hearing through a legal representative. In case the assessee or his legal representative fail to appear before this court, the trial panel shall revoke the interim decision to hold a public hearing, thus continuing the examination of the case in chambers.
The trial panel informed also that if requested by the assessee, the Appeal Chamber may hold the public hearing in other premises, appropriate to his health conditions.

Today, on 09.06.2021, at 09:30, the Appeal Chamber held the public hearing of case (JR) no. 19/2021, dated 19.04.2021, pertaining to the appeal of the Public Commissioner against decision no. 342, dated 02.02.2021, of the Independent Qualification Commission, related to the assessee Elbana Lluri.
Subsequent to the previous hearing, the parties confirmed the acquaintance with the acts part of the file of the case of the ex-spouse of the assessee and expressed their views on the financial analysis drafted by the Appeal Chamber, on the basis of the appeal grounds of the Public Commissioner.
The Public Commissioner stated that the financial analysis reflects all the claims raised in Public Commissioner’s appeal grounds.
The assessee, Mrs. Elbana Lluri, filed her objections regarding the financial analysis, claiming that it is an inaccurate, unfair analysis and it does not include all data on the income of persons related to the assessee. The assessee submitted several new acts attached to the objections, which she requested to be accepted as evidence by the trial panel. The assessee, Mrs. Elbana Lluri, requested the Chamber to take into account her objections to the financial analysis drafted in view of the appeal of the Public Commissioner, and the upholding of decision no. 342, dated 02.02.2021 of the Independent Qualification Commission.
In view of the consideration of the case, the assessee responded to several questions of the case rapporteur.
After being consulted, the trial panel decided to accept as evidence one document filed by the assessee, issued by the Social Insurance Institute. With regard to the public denunciations, the trial panel assessed that they do not meet the conditions of Article 53 of Law 84/2016.
Once the parties stated that they had no other procedural requests, the trial panel decided to close the judicial review of the case and invited the parties to present the final conclusions at the next hearing, on 22.06.2022, at 10:00.

Today, on 09.06.2021, at 13:00, the Appeal Chamber held the public hearing of case (JR) 40/2021, dated 23.07.2021, pertaining to the appeal of the Public Commissioner against decision no. 393, dated 03.06.2021, of the Independent Qualification Commission, related to the assessee Gerd Hoxha.
Subsequent to the previous hearing, the parties confirmed their acquaintance with the new evidence – the acts part of the case file of the former spouse of the assessee – and expressed their views on the preliminary financial analysis drafted by the Chamber, on the basis of the appeal grounds of the Public Commissioner.
The Public Commissioner, Mrs. Irena Nino, objected the claims of the assessee for her request in excess of the appeal grounds related to the asset assessment, and stated that she reserves the right to make a statement regarding the financial analysis in the submission of the final conclusions.
The assessee presented his objections with regard to the preliminary financial analysis, claiming that it is an analysis unfounded in law, does not comply with the current AC case-law, and violates the principle of legal certainty. Through a procedural request, the assessee requested the trial panel to find the financial analysis invalid or to re-conduct it, including the positions held by the assessee on the matter, during the previous hearing held at the Chamber. The trial panel, by a majority vote, decided to dismiss these requests of the assessee.
Following the hearing, the assessee reiterated his position held in the hearing dated 05.04.2022, holding that the Public Commissioner’s appeal grounds are inaccurate, unfounded in law and evidence and requested the Chamber to dismiss the appeal.
Once the parties stated that they had no further procedural requests, the trial panel decided to close the judicial review of the case and invited the parties to present the final conclusions of the case, at the next hearing, on June 22, 2022, at 14:30.

Today, on 20.06.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 55/2021, dated 04.10.2021, pertaining to the appeal of the Public Commissioner against decision no. 392, dated 28.05.2021, of the Independent Qualification Commission, related to the assessee Natasha Prifti (Shallapi).
The Public Commissioner, during the submission of the appeal grounds held that the assessee is found in terms of inaccurate, insufficient and inconsistent declaration for the asset assessment, failing to reach a reliable level for her confirmation in office. The Public Commissioner requested the Chamber to consider the grounds of the appeal and after conducting a thorough evaluation of the case, to decide the amendment of decision no. 392, dated 28.05.2021, of the Independent Qualification Commission and dismissal from office of the assessee Natasha Prifti (Shallapi).
The legal representative of the assessee objected the Public Commissioner’s appeal grounds, claiming that the assessee is not found in the conditions of insufficient declaration for the asset assessment, but reaches a reliable level for her confirmation in office. To support his claims, the legal representative included in the rebuttals a financial analysis that he submitted with the Chamber. The assessee requested the Chamber to consider fair decision no. 392, dated 28.05.2021, of the Independent Qualification Commission – according to which, the assessee reaches a reliable level for the asset and background assessee, as well as a qualifying level for the proficiency assessment – and to uphold this decision.
Once the assessee, Mrs. Prifti responded to some explanatory questions of the rapporteur to the purpose of the review of the case, and as the parties stated that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to file their final conclusions.
Given that the Public Commissioner requested additional time for the preparation of the final conclusions, the trial panel decided to postpone the hearing until 27.06.2022, at 14:00.

The Public Commissioner Irena Nino, in the course of the submission of the final conclusions, following the evaluation of the administered evidence, stated that the assessee failed to reach a reliable level of the asset assessment and background assessment, even though she managed to prove that she is not in found in a conflict of interest situation. In conclusion, the Public Commissioner requested the Chamber the amendment of decision no. 325, dated 14.12.2020, of the Independent Qualification Commission and the dismissal from office of the assessee Rilinda Selimi.
The assessee, during the submission of her final conclusions held that there are no factual circumstances in the Public Commissioner’s appeal upon which action would be taken against decision no. 325, dated 14.12.2020, of the Independent Qualification Commission. In the end, the assessee requested the Chamber that, on the basis of the judicially proven situations, to reject the appeal grounds and uphold decision no. 325, dated 14.12.2020, of the Independent Qualification Commission.

Today, on 27.06.2022, at 10:00, the Appeal Chamber held the public hearing of case (JR) 35/2020, dated 11.09.2020, pertaining to the appeal of the Public Commissioner against decision no. 255, dated 08.06.2020, of the Independent Qualification Commission, related to the assessee Ludovik Dodaj.
The presiding judge informed the parties at trial that following the interim decision of the trial panel of the previous hearing, the Chamber has received and forwarded to the parties the court file of the Durres Judicial District Court, to the purpose of the review of the case.
Once the parties confirmed the acquaintance with the file and after declaring that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case.
During the submission of the final conclusions, the Public Commissioner stated that the assessee, even following the filed evidence, failed to prove the opposite of the appeal on the asset assessment, being found in the conditions of insufficient declaration and lack of legitimate sources to justify the assets.
Referring to ethics and commitment to professional values, the Public Commissioner assessed that the appeal grounds about the asset assessment are sufficient to request the dismissal from office of the assessee, Mr. Ludovik Dodaj. As regards the court file of the Durres Judicial District Court, the Public Commissioner held that following its analysis, it did not appear that the assessee had been part of the prosecution body during the proceedings of the court case, which could put him in a situation of conflict of interest during the exercise of office. The Public Commissioner requested the Chamber the amendment of decision no. 255, dated 08.06.2020, of the Independent Qualification Commission and the dismissal from office of the assessee.
The legal representative of the assessee, Mr. Ludovik Dodaj, opposed the Public Commissioner’s appeal grounds related to the asset assessment, stating that the assessee has managed to prove the legitimacy of the sources for the creation of his property. With regard to court file of Durres Judicial District Court, the legal representative stated that the provided documentation proves clearly that there is no circumstance that would place the assessee in terms of conflict of interest, in reference to the proficiency assessment criterion. The assessee requested the Chamber to uphold decision no. 255, dated 08.06.2020, of the Independent Qualification Commission and his confirmation in office.

The legal representative of the assessee objected the Public Commissioner, stating that Mrs. Prifti reaches a reliable level in the asset assessment, as her financial insufficiency is at such level that constitutes no ground for dismissal. The legal representative requested the Chamber to evaluate the assessee for this criterion in the light of the principle of objectivity and proportionality, as well as to take into account the fact that Ms. Prifti achieved a reliable level in the background assessment and a good qualifying score in the proficiency assessment. The legal representative requested the Chamber to uphold decision no. 392, dated 28.05.2021, of the Independent Qualification Commission, as a fair decision and founded in law.

The rejection of the appeal of magistrate Enkeleida Hoxha, against decision no. 92, dated 17.03.2021, of the High Judicial Council “On imposing the disciplinary measure against Judge Enkeleida Hoxha”.
This decision is final, definitive and shall enter into force on the date of its publication in the Official Gazette.
The Appeal Chamber has registered the case (JR) no. 28/2022, dated 23.06.2022, pertaining to the appeal of the assessee Fida Osmani against decision no. 525, dated 27.04.2022, of the Independent Qualification Commission.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.
Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.
This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.
Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
