The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Appeal Chamber opened on 03.06.2024 the public hearing of case (JR) 29/2021, dated 28.05.2021, pertaining to the appeal of the Public Commissioner against decision no. 352, dated 01.03.2021, of the Independent Qualification Commission, related to the assessee Iliba Bezati.

    The presiding judge informed the court that on May 28, 2024, the International Observer of the International Monitoring Operation, Mr. Steven Kesler, had informed the Chamber of his objective incapacity to participate in today’s hearing, requesting its postponement, which would enable his presence, given his acquaintance with the case.

    The International Observer Gerrit Sprenger, attending the hearing, reconfirmed the request of the IO Steven Kesler for the postponement of today’s public hearing.

    On 12.06.2024, the Appeal Chamber opened the public hearing of case (JR) 71/2021, dated 17.11.2021, pertaining to the appeal of the assessee Sali Hasa against decision no. 433, dated 03.09.2021 of the Independent Qualification Commission.

    The presiding judge informed the court that on 29.05.2024, the International Observer of the International Monitoring Operation (IMO) assigned on the case informed the Chamber that due to objective reasons, he personally, but other IMO International Observers as well, were unable to attend today’s hearing.

    The assessee Sali Hasa, when questioned by the presiding judge, expressed his position on the continuation of the hearing without the presence of the International Observer.

    The Appeal Chamber held on 24.06.2024 the public hearing of case (JR) 71/2021, dated 17.11.2021, pertaining to the appeal of the assessee Sali Hasa against decision no. 433, dated 03.09.2021 of the Independent Qualification Commission.

    The trial panel heard the legal representative of the assessee as he presented in detail the objections against decision no. 433, dated 03.09.2021 of the Independent Qualification Commission, maintaining that this decision was made in serious violation of the due process of law, supported on inaccurate financial statements, unsubstantiated and unsupported by law and evidence.

    In support of his claims for the asset assessment, along with the submissions of today’s hearing, the assessee filed several documents, which he requested the trial panel to be accepted as evidence.

    After being consulted, the trial panel decided to open the judicial investigation of the case and accept as evidence some of the documents filed by the assessee and to dismiss the remainder of the documents, due to their failure to meet the formal criteria, or due to the fact that some of them may be accessed from open sources, or given that they are already part of the file.

    Following the interim decision, the legal representative of the assessee, finding that most of the acts dismissed by the trial panel for failure in meeting the formal criteria, were available in their original form, requested a time period to be given the opportunity to file them with the AC at a second moment.

    The trial panel decided to accept this procedural request, giving time to the assessee to lodge these acts with the Chamber within 02.07.2024, adjourning the public hearing to 04.07.2024, at 09:30.

    Today, on 25.06.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 23/2023, dated 26.05.2023, pertaining to the appeal of the Public Commissioner against decision no. 657, dated 28.04.2023 of the Independent Qualification Commission, related to the assessee Periand Teta.

    During the submission of the appeal grounds, the Public Commissioner Irena Nino held that the decision of the Independent Qualification Commission to declare complete the vetting process of the assessee Periand Teta, without a final decision, is unsupported on the legislation that regulates the vetting process. The Public Commissioner requested the Chamber the amendment of decision no. 657, dated 28.04.2023 of the Independent Qualification Commission, the termination of the transitional re-evaluation process and, according to Article G of the Annex to the Constitution, the prohibition of the assessee to be appointed a judge or prosecutor of any level, a member of the High Judicial Council or High Prosecutorial Council, High Inspectorate of Justice or Prosecutor General for a period of 15 years.

    The assessee objected the Public Commissioner’s appeal, maintaining that this appeal is unsupported by law and evidence, nor by the current jurisprudence of the Appeal Chamber. In support of his claims, the assessee filed several documents, which he requested the trial panel to accept them as evidence. The assessee requested the Chamber to alternatively decide to uphold the IQC decision, or overrule this decision and order the Independent Qualification Commission to continue the vetting process for the assessee Periand Teta, under Article 66, paragraph 1 (c), of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    After being consulted, the trial panel decided to open the judicial investigation of the case and accept as evidence the documents filed by the assessee. Once the parties declared that they had no further procedural requests, the trial panel decided to close the judicial investigation of the case and invited them to present their final conclusions.

    At the request of the Public Commissioner for reasonable time for the preparation of the final conclusions, the panel decided to postpone the hearing to 28.06.2024, at 09:00.

    On 26.06.2024, the Appeal Chamber held the public hearing of case (JR) 29/2021, dated 28.05.2021, pertaining to the appeal of the Public Commissioner against decision no. 352, dated 01.03.2021 of the Independent Qualification Commission, related to the assessee Iliba Bezati.

    The Public Commissioner submitted the appeal grounds on the asset and proficiency assessment criteria, requesting the AC to take them into consideration, ordering the opening of the judicial investigation and the collection of relevant evidence, according to the request in the appeal.

    The assessee, Mrs. Iliba Bezati, provided her explanations in view of the appeal, requesting the AC to open the investigation and collect as evidence three new acts related to her submissions, in terms of the examination of the case. The assessee held that the assessment of the Independent Qualification Commission, according to which the assessee has reached a reliable level in the asset and background assessment and a qualifying level in the proficiency assessment, is fair and substantiated on law and evidence. The assessee requested the upholding of decision no. 352, dated 01.03.2021 of the Independent Qualification Commission.

    Following some questions on the case addressed to the assessee by the International Observer of the International Monitoring Operation, the trial panel, after being consulted, decided:

    – To open the judicial investigation and pursuant to Article F, paragraph 3 of the Annex to the Constitution, and Articles 45, 49, paragraph 1 (a), of Law no. 84/2016, collect as evidence the three acts filed by the assessee.

    – Upon a majority vote, request the Public Commissioner to determine which concrete conclusions of the Independent Qualification Commission regarding the items of the financial analysis of the assessee he opposes, and the financial effect they produce in the final evaluation of this analysis.

    In order to give the necessary time to the Public Commissioner to prepare his position, the trial panel decided to adjourn the hearing to 11.07.2024, at 10:00, asking the Public Commissioner to submit the requested material with the AC within 03.07.2024, in a way that it may also be forwarded to the assessee before the next hearing.

    Finally, the assessee requested the Chamber to, alternatively, decide to uphold the IQC decision, or overrule this decision and order the Independent Qualification Commission to continue the re-evaluation process for the assessee Periand Teta, under Article 66, paragraph 1 (c), of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    After hearing the final conclusions of the parties, the trial panel withdrew to make the final decision, which it shall announce on 17.07.2024, at 14:00.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
