The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    The Meeting of Judges of the Appeal Chamber, in order to avoid the created imbalance of the workload of the judges of the Chamber in the role of case rapporteur, by its decision no. 75, dated 29.08.2024, decided to amend Article 3 of the regulation of the Appeal Chamber, “On manual lot procedures in the Appeal Chamber”, as amended.

    In this context, in the application of the amendments to the above-mentioned regulation, on 10.09.2024, the Appeal Chamber held a lot procedure for the selection of some cases for which the rapporteur judge was changed through this lot, without changing the initial composition of the trial panel members.     Today, on 12.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 8/2024, dated 06.03.2024, pertaining to the appeal of the Public Commissioner against decision no. 729, dated 10.01.2024 of the Independent Commission of Qualification, related to the assessee Zena Lila.

    The Public Commissioner, during the submission of the appeal grounds regarding the asset assessment criterion, stated that action may be taken against the decision of the Independent Qualification Commission for the confirmation in office of the assessee, as the assessee is found in terms of incorrect and insufficient declaration of assets and fails to prove the legitimate source of its creation. The Public Commissioner requested the Chamber the amendment of decision no. 729, dated 10.01.2024, of the Independent Qualification Commission and the dismissal from office of the assessee Zena Lila.

    The legal representative of the assessee filed the objections to the Public Commissioner’s appeal grounds, requesting the Chamber, based on the principle of proportionality and objectivity, to decide the upholding of decision no. 729, dated 10.01.2024 of the Independent Qualification Commission and confirmation in office of the assessee.

    Once the parties declared that they had no other procedural requests, the trial panel, advised on the spot, decided to close the judicial review of the case and withdrew in chambers to make the final decision, which it shall announce on 19.09.2024, at 14:00.

    Today, on 16.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 52/2023, dated 07.11.2023, pertaining to the appeal of the Public Commissioner against decision no. 693, dated 10.08.2023 of the Independent Qualification Commission, related to the assessee Saimir Hysa.

    The Public Commissioner, during the submission of the appeal grounds, stated that the assessee fails to prove the contrary of the burden of proof regarding his findings related to the proficiency assessment, the asset assessment, as well as a potential conflict of interest situation during the exercise of the office. The Public Commissioner requested that his appeal grounds be taken into consideration by the Chamber, deciding the amendment of decision no. 693, dated 10.08.2023, of the Independent Qualification Commission and the dismissal from office of the assessee.

    During the submission of his objections, the assessee disputed the Public Commissioner’s appeal grounds, filing several documents, which the trial panel decided to accept as evidence, after the opening of the judicial investigation of the case. The assessee requested the Chamber to dismiss the appeal of the Public Commissioner and to uphold decision no. 693, dated 10.08.2023, of the Independent Qualification Commission.

    Once the assessee responded to some questions of the International Observer of the International Monitoring Operation in the context of the review of the case, and after the parties declared that they had no additional procedural requirements, the trial panel decided to close the judicial investigation of the case and invited them to submit the final conclusions.

    Since the Public Commissioner requested a sufficient time period for the preparation of the final conclusions, the trial panel decided to postpone the hearing to 23.09.2024, at 10:00.

    Today, on 23.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 52/2023, dated 07.11.2023, pertaining to the appeal of the Public Commissioner against decision no. 693, dated 10.08.2023 of the Independent Qualification Commission, related to the assessee Saimir Hysa.

    Given that today, on 23.09.2024, there was a new denunciation lodged with the Appeal Chamber, the Public Commissioner, while addressing a clarifying question to the assessee, stated that the appeal grounds and the evidence in the file are sufficient to reach the final conclusion of the case.

    The assessee held that this denunciation does not contain any circumstances or facts to be investigated by the Chamber.

    During the submission of the final conclusions, the Public Commissioner maintained that even during the judicial proceedings at the Chamber, the assessee failed to prove the opposite of the appeal on the proficiency assessment and asset assessment criteria and finally, requested the AC that following an overall assessment of the case, decides the amendment of decision no. 693, dated 10.08.2023 of the Independent Qualification Commission, and the dismissal from office of the assessee.

    During the submission of the final conclusions, the assessee disputed the Public Commissioner’s appeal grounds, finally requesting the Chamber, based on the acts administered in the case file, to decide to uphold the decision of the Independent Qualification Commission no. 693, dated 10.08.2023, as a fair decision, supported on law and evidence.

    Today, on 26.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) 20/2024, dated 30.05.2024, pertaining to the appeal of the Public Commissioner against decision no. 757, dated 09.04.2024 of the Independent Qualification Commission, related to the assessee Erjon Shqarri.

    During the submission of the appeal ground on the proficiency assessment criteria, the Public Commissioner, Ms. Irena Nino, held that she disagrees with the Independent Qualification Commission, as she considers that the assessee fails to reach a reliable level for his confirmation in office. The Public Commissioner requested the Appeal Chamber the amendment of decision no. 757, dated 09.04.2024, of the Independent Qualification Commission, the suspension from office of the assessee for a period of one year and the obligation to follow the training program, according to the curricula approved by the School of Magistrates.

    Whereas when she was requested by the presiding judge to take a position regarding a denunciation filed with the AC, the Public Commissioner stated that she leaves it to the judgment of the trial panel, as the appeal grounds are considered sufficient for the case.

    The assessee rejected the Public Commissioner’s appeal grounds, considering them as unsupported in law and in the evidence, and requested the AC to verify the exhaustive evidence administered in the file, deciding to uphold decision no. 757, dated 09.04.2024, of the Independent Qualification Commission, which confirmed him in office.

    With respect to the denunciation, the assessee submitted two documents, inviting the trial panel to become acquainted with the legal status of the case filed by the denouncer.

    After being acquainted with the documents filed by the assessee, which showed that the case is under consideration in a court of general jurisdiction, the trial panel, pursuant to Article E of the Annex of the Constitution, decided not to investigate the denunciation under the provisions of Article 53 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.

    Subsequently, the trial panel invited the parties to submit their final conclusions.

    The Public Commissioner and the assessee requested the trial panel to consider as final conclusions the submissions filed by them during today’s hearing.

    The trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, to be announced on 03.10.2024, at 15:00.

    Today, on 30.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) no. 56/2023, dated 01.12.2023, pertaining to the appeal of the Public Commissioner against decision no. 703, dated 28.09.2023, of the Independent Qualification Commission, related to the assessee Suela Salavaçi.

    During the submissions of the appeal grounds, the Public Commissioner stated that assessee, Ms. Suela Salavaçi fails to reach a reliable level for her confirmation in office with regard to the asset and proficiency assessment criteria. The Public Commissioner requested that the Chamber, following a comprehensive evaluation of the case under Article 4, paragraph 2 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, rules on the amendment of decision no. 703, dated 28.09.2023, of the Independent Qualification Commission and the dismissal from office of the assessee.

    The assessee contested the appeal grounds of the Public Commissioner and requested the Chamber to consider them inadmissible, as they ae contrary to the law and evidence. In support of her claims, the assessee, Ms. Suela Salavaçi filed several new documents, which she requested to be collected as evidence by the trial panel.

    With regard to these acts, the Public Commissioner held that, in formal terms, it is up to the panel to accept them as evidence, whereas, as far as their admissibility is concerned, he would make a statement with their regard in the final conclusions.

    After being consulted, the trial panel decided to open the judicial investigation of the case and to accept as evidence the documents filed during today’s hearing by the assessee.

    With regard to some denunciations received after the appeal was lodged, the trial panel decided not to investigate, as they contain no sufficient causes or circumstances for further investigation.

    Once the assessee responded to a series of clarifying questions of the International Observer in relation to the consideration of the case, the trial panel decided to close the judicial investigation of the case and invited the parties to submit the final conclusions.

    Given that the parties requested a reasonable time for the preparation of the final conclusions, the trial panel decided to postpone the hearing to 07.10.2024, at 10:00.

    The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
