Today, on 30.09.2024, at 10:00, the Appeal Chamber held the public hearing of case (JR) no. 56/2023, dated 01.12.2023, pertaining to the appeal of the Public Commissioner against decision no. 703, dated 28.09.2023, of the Independent Qualification Commission, related to the assessee Suela Salavaçi.
During the submissions of the appeal grounds, the Public Commissioner stated that assessee, Ms. Suela Salavaçi fails to reach a reliable level for her confirmation in office with regard to the asset and proficiency assessment criteria. The Public Commissioner requested that the Chamber, following a comprehensive evaluation of the case under Article 4, paragraph 2 of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, rules on the amendment of decision no. 703, dated 28.09.2023, of the Independent Qualification Commission and the dismissal from office of the assessee.
The assessee contested the appeal grounds of the Public Commissioner and requested the Chamber to consider them inadmissible, as they ae contrary to the law and evidence. In support of her claims, the assessee, Ms. Suela Salavaçi filed several new documents, which she requested to be collected as evidence by the trial panel.
With regard to these acts, the Public Commissioner held that, in formal terms, it is up to the panel to accept them as evidence, whereas, as far as their admissibility is concerned, he would make a statement with their regard in the final conclusions.
After being consulted, the trial panel decided to open the judicial investigation of the case and to accept as evidence the documents filed during today’s hearing by the assessee.
With regard to some denunciations received after the appeal was lodged, the trial panel decided not to investigate, as they contain no sufficient causes or circumstances for further investigation.
Once the assessee responded to a series of clarifying questions of the International Observer in relation to the consideration of the case, the trial panel decided to close the judicial investigation of the case and invited the parties to submit the final conclusions.
Given that the parties requested a reasonable time for the preparation of the final conclusions, the trial panel decided to postpone the hearing to 07.10.2024, at 10:00.
The public hearing will take place in the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.
