Today, on 02.06.2021, at 10:00, the Appeal Chamber held the public hearing of the case (JR) 50/2019, dated 14.10.2019, regarding the appeal of the Public Commissioner filed against decision no. 190, dated 26.07.2019 of the Independent Qualification Commission corresponding to the assessee Ramiz Lala.
The presiding judge informed that the assessee had submitted in advance with the Appeal Chamber his submissions regarding the appeal grounds and the new acts for the purpose of the case review, which were made available to the Public Commissioner, but due to the procedural rules of the public hearing, had not yet been reviewed by the trial panel.
While submitting his appeal grounds, the Public Commissioner asked the Appeal Chamber to open a judicial investigation regarding the two re-evaluation criteria of the assessee Ramiz Lala, that of the proficiency and the asset criteria, as he considered that the administrative investigation with the Independent Qualification Commission has not been complete.
The assessee stated his objections regarding the appeal grounds filed by the Public Commissioner and along with the objections he submitted new acts, which were accepted by the trial panel to be collected as evidence.
The Public Commissioner, after stated his position on the new evidence, asked the Appeal Chamber:
– to request additional documentation from the First Instance Administrative Court of Gjirokastra and the Administrative Court of Appeal Tirana for further investigation of the case,
– as well as to carry out the financial analysis on the financial expenses of the assessee for the years 2011, 2014, 2015 and 2016.
The trial panel, after being consulted on the request of the Public Commissioner, pursuant to Article F, paragraph 3 of the Annex to the Constitution and Articles 45 and 49 of Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by an interim decision, decided to request additional documentation from the First Instance Administrative Court of Gjirokastra and the Administrative Court of Appeal Tirana, as far as needed for further investigations on the process of transitional re-evaluation of the assessee.
The trial panel also decided to request the Legal Service Unit of the Appeal Chamber to carry out a financial analysis on the assessee for the years 2011, 2014, 2015 and 2016.
In order for this interim decision to be implemented, the trial panel decided to adjourn the public hearing on 22 June 2021, at 10:00.
The public hearing shall take place at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
