The Appeal Chamber is an independent constitutional institution established to carry out the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania in reviewing appeals against the decisions of the Independent Qualification Commission. The Appeal Chamber adjudicates disciplinary misconducts of Constitutional Court judges, members of High Judicial Council, High Prosecutorial Council, the Prosecutor General and the High Justice Inspector. It reviews appeals against decisions of the High Judicial Council, the High Prosecutorial Council and the High Justice Inspectorate imposing disciplinary sanctions against judges, prosecutors and other inspectors.

May 4, 2022 The President of the Appeal Chamber, Mrs. Albana Shtylla, and the AC judges welcomed today a Moldovan delegation led by the Minister of Justice, Mr. Sergiu Litvinenco, with the goal of exchanging the best practices and learning how the vetting process works, the legal framework, the mechanisms and institutions involved, implementation results, as well as the public perception of this process. Moldova has launched an ambitious reform of the justice system aimed at fighting corruption and functioning of rule of law. One of the specially impacting reforms promised to the Moldovan public is the vetting process, the assessment of the integrity of judges and prosecutors, and ousting those judges and prosecutors who fail passing this process. The Moldovan delegation headed by the Minister of Justice included also members of the High Judicial Council, the High Prosecution Council, as well as heads and legal advisors of the departments of these institutions, who were informed about the progress of the vetting process to date as an essential part of justice reform in Albania.

    On 03.05.2023, the Appeal Chamber held the lot procedure for the replacement of judge Ardian Hajdari, appointed as panel member in case (JR) no. 37/2021, dated 07.07.2021, pertaining to the appeal of the assessee Ramazan Avdiu against decision no. 381, dated 06.05.2021, of the Independent Qualification Commission.

    The replacement of judge Ardian Hajdari was due to his suspension from office by decision no. 13, dated 07.02.2022 of the Meeting of Judges of the Appeal Chamber.

    Following the lot procedure for the appointment of the member judge, the trial panel of case (JR) no. 37/2021, dated 07.07.2021, shall consist of the following judges:

    At the conclusion of the trial in chambers, the trial panel, pursuant to Article 66, paragraph 1 (b) of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a majority vote, decided :

    1. Amendment of decision no. 367, dated 16.04.2021, of the Independent Qualification Commission and the confirmation in office of assessee Bledar Maksuti.

    2. This decision is final and effective immediately.

    Today, on 11.05.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 6/2021, dated 26.01.2021, pertaining to the appeal of the Public Commissioner and the appeal of the assessee Irena Brahimi against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission.

    The Public Commissioner submitted the appeal grounds in relation to the asset and proficiency assessment criteria, requesting the upholding, or alternatively, the amendment of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission.

    The assessee, Ms. Brahimi, provided explanations with regard to her appeal against decision no. 276, dated 21.07.2020, of the Independent Qualification Commission, and filed as well objections against to the Public Commissioner’s appeal grounds. The assessee requested the Chamber the upholding of decision no. 276, dated 21.07.2020 of the Independent Qualification Commission and confirmation in office.

    Following the court debate, in the context of the respective requests of the Public Commissioner and the assessee addressed to the AC in view of the examination of the case, after being consulted, the panel decided:

    – opening the judicial investigation of the case, accepting as evidence all the documents filed by the assessee attached to the submissions filed in today’s hearing;

    – by a majority vote, the conduct of a preliminary financial analysis related to the Public Commissioner’s appeal grounds and assessee’s claims related to the asset assessment. This financial analysis will be forwarded to the parties, for acquaintance purposes, by May 25, 2023;

    – making available to the assessee an information on a publication of a media portal, part of the Public Commissioner’s appeal within the proficiency assessment. This information will be forwarded to the assessee, Ms. Irena Brahimi, to take a stand during the next hearing, which will take place on 05.06.2023, at 10:00. In this hearing, the panel shall also make a statement regarding the information on the publication of the media portal.

    Today, on 16.05.2023, at 10:00, the Appeal Chamber held the public hearing of case (JR) 37/2022, dated 01.09.2022, pertaining to the appeal of the Public Commissioner against decision no. 535, dated 26.05.2022, of the Independent Qualification Commission, related to the assessee Bledar Bejko.

    The Public Commissioner, during the submission of the appeal, which she stated was carried out within the time limits set by law, assessed that there were deficiencies in the asset assessment criteria, issues in the background and proficiency assessment criteria, and that the IQC position, according to which the assessee has reached a reliable level for all three assessment criteria, is not supported on a fair evaluation of facts, evidence and applicable legislation.

    The Public Commissioner requested the Chamber to consider the appeal grounds and at the end of the consideration of the case in a public hearing, to decide the amendment of decision no. 535, dated 26.05.2022, of the Independent Qualification Commission and the dismissal from office of the assessee Bledar Bejko.

    The assessee requested the AC to dismiss the appeal of the Public Commissioner, claiming that it was lodged beyond the 15-day legal time limit. While contesting the appeal grounds for the three assessment criteria, the assessee stated that they do not stand and are not found on law and evidence. The assessee requested the AC to open the judicial investigation of the case, accepting as evidence the documents attached to his submissions, identified during today’s hearing. Based on the principle of equality before law, constitutionality, principles of proportionality and objectivity, the assessee requested the upholding of decision no. 535, dated 26.05.2022, of the Independent Qualification Commission.

    With regard to the public denunciations, the Public Commissioner stated that she considers unnecessary taking a stand, as the circumstances and information therein are included in the appeal grounds, which are sufficient to amend the IQC decision.

    The case rapporteur addressed several clarifying questions to the assessee with respect to the denunciations, for one of which, the latter requested sufficient time to respond.

    By an interim decision, the panel decided to open the judicial investigation of the case and to administer as evidence the acts filed by the assessee, except two acts already administered in the case file.

    The court decided to postpone the hearing to May 17, 2023, at 11:00. During this hearing, the panel shall announce the decision related to the public’s denunciations and shall make a statement regarding the request of the assessee for sufficient time related to the question of the case rapporteur.

    The public hearing will take place at the premises of the Appeal Chamber, at Boulevard “Dëshmorët e Kombit”, no. 3, Tirana.

The Appeal Chamber held today, on 30.06.2020, at 11:00 h, the session for the election of the President of the Appeal Chamber, for the period 26.07.2020 – 26.07.2023.

Upon the secret ballot which took place in the presence of international observers of the International Monitoring Operation, the candidate Albana Shtylla was elected with 7 (seven) votes in her favor.

This result was approved upon decision of the Meeting of Judges no. 12, dated 30.06.2020.

Mrs. Albana Shtylla shall take the office of the President of the Appeal Chamber, on 26.07.2020, when the office term of the incumbent President, Mrs. Natasha Mulaj shall terminate.
