Kolegji i Posaçëm i Apelimit zhvilloi sot, më datë 12 dhjetor 2018, seancën gjyqësore publike për çështjen (JR) nr.10/2018, datë 31.07.2018 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 24, datë 13.06.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Bashkim Dedja.

Gjatë seancës së sotme, Komisioneri Publik parashtroi shkaqet e ankimit, ndërsa subjekti i rivlerësimit, parashtroi kundërshtitë e tij ndaj ankimit të paraqitur nga Komisioneri Publik, si dhe kërkoi marrjen në shqyrtim nga Kolegji i Posaçëm i Apelimit, me cilësinë e provës, të disa dokumenteve që i depozitoi pranë trupit gjykues.

Trupi gjykues, pasi u konsultua, i vlerësoi provat të panevojshme dhe si të tilla ia ktheu subjektit të rivlerësimit. Kryesuesi i seancës ftoi respektivisht Komisionerin Publik dhe subjektin e rivlerësimit, për kërkimet përfundimtare. Komisioneri Publik kërkoi ndryshimin e vendimit nr. 24, datë 13.06.2018 të KPK-së dhe shkarkimin nga detyra të subjektit të rivlerësimit Bashkim Dedja. Subjekti i rivlerësimit kërkoi rrëzimin e kërkesës së Komisionerit Publik dhe lënien në fuqi të vendimit nr. 24, datë 13.06.2018 të KPK-së.

Trupi gjykues u tërhoq për marrjen e vendimit, i cili do të shpallet nesër, më datë 13.12.2018, ora 15.00.

The Appeal Chamber held today, on 12.12.2018, the public hearing of case (JR) no. 10/2018, dated 31.07.2018, corresponding to the appeal of the Public Commissioner against decision no. 24, dated 13.06.2018, of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Mr. Bashkim Dedja.

During the hearing the Public Commissioner submitted the appeal grounds whereas the assessee submitted his objections to the appeal filed by the Public Commissioner and requested the Appeal Chamber to review in the capacity of evidences several documents that he filed with the adjudication panel.

Following the deliberations, the adjudication panel considered the evidences as not necessary and returned them back to the assessee. The chairperson invited the Public Commissioner and the assessee respectively for their final submissions. The Public Commissioner requested the modification of IQC decision no. 24 dated 13.06.2018 and dismissal from office of the assessee Bashkim Dedja. The assessee requested the rejection of the request of the Public Commissioner and upholding of IQC decision no. 24 dated 13.06.2018.

The adjudication panel withdrew to make the decision, to be announced tomorrow, on 13.12.2018, at 15:00 hrs.

Në Kolegjin e Posaçëm të Apelimit është regjistruar çështja (JR) nr.39/2018, datë 07.12.2018 që i përket ankimit të subjektit të rivlerësimit Sotiraq Lubonja kundër vendimit nr.68, datë 08.10.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Sotiraq Lubonja.

Sot, në datën 12.12.2018, në Kolegjin e Posaçëm të Apelimit, u hodh shorti për caktimin e trupit gjykues, kryesuesin e këtij trupi dhe relatorin e çështjes.

The Appeal Chamber has registered case no. (JR) no. 39/2018, dated 07.12.2018, corresponding to the appeal of the assessee Mr. Sotiraq Lubonja against decision no. 68, dated 08.10.2018, of the Independent Qualification Commission related to the re-evaluation of the assessee Mr. Sotiraq Lubonja.

The lot was drawn today on 12.12.2018 at the Appeal Chamber to assign the adjudication panel, the Chairperson and the Rapporteur of the case.
