Kolegji i Posaçëm i Apelimit zhvilloi më datë 16.12.2019, ora 10:00, seancën gjyqësore publike për çështjen (JR) nr.40/2018, datë 18.12.2018 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 63, datë 06.08.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Arben Dollapaj.

Gjatë parashtrimit të vlerës provuese të akteve të paraqitura në seancën parardhëse nga subjekti i rivlerësimit, Komisioneri Publik i kërkoi Kolegjit çeljen e hetimit gjyqësor dhe informacione shtesë nga institucionet shtetërore, në funksion të hetimit.

Pasi u konsultua, trupi gjykues vendosi çeljen e hetimit gjyqësor dhe lejimin e marrjes së akteve të depozituara nga subjekti i rivlerësimit në seancën e mëparshme.

Trupi gjykues vendosi të kërkojë nga institucionet shtetërore dokumentacion shtesë në funksion të hetimit pasuror: nga ZVRPP Tropojë, nga Bashkia Tropojë, nga ministria përgjegjëse për Turizmin, nga Drejtoria Rajonale Tatimore Kukës, nga Ministria e Drejtësisë, nga Prokuroria pranë Gjykatës së Shkallës së Parë Tiranë, Prokuroria pranë Gjykatës së Shkallës së Parë Durrës, si dhe nga Prokuroria e Përgjithshme. Këtë dokumentacion, trupi gjykues e konsideroi të nevojshëm për çështjen.

Trupi gjykues i kërkoi Komisionerit Publik që deri në seancën e ardhshme, e cila do të zhvillohet më datë 16 janar 2020, ora 10:00, të paraqesë vlerësimin e tij, lidhur me mënyrën e trajtimit të denoncimeve të publikut. Kjo periudhë kohore iu la në dispozicion edhe subjektit të rivlerësimit të paraqesë çdo provë që e konsideron të nevojshme në funksion të shqyrtimit të çështjes.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on 16.12.2019, at 10:00 h, the public hearing of case (JR) no. 40/2018, dated 18.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 63 dated 06.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Arben Dollapaj.

During the submissions of the probative value of the documentation submitted by the assessee in the previous hearing, the Public Commissioner requested the Appeal Chamber to open the judicial hearing and to the purpose of the investigation, require additional information from the state institutions.

Following deliberations, the adjudication panel decided to open the judicial hearing and allow the collection of the documentation deposited by the assessee in the previous hearing.

The adjudication panel decided that in the view of the investigation on assets, to request additional documentation to the state institutions of Tropoja LIPRO, Tropoja Municipality, the Ministry responsible for Tourism, Regional Tax Directorate of Kukes, Ministry of Justice, the Prosecution office at First Instance Court of Tirana, the Prosecution office at First Instance Court of Durres, and the General Prosecution office. The adjudication panel considered this documentation necessary to the case.

The adjudication panel requested the Public Commissioner that by the next hearing, to be held on January 16, 2020, at 10:00 h, to submit his assessment with regard to the manner how the public denunciations should be dealt with. This period of time was also made available to the assessee to submit any piece of evidence he deems necessary to the purpose of the review of the case.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
