Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Albana Shtylla kryesuese, Natasha Mulaj relatore, Ina Rama, Rezarta Schuetz, Sokol Çomo anëtarë, shpalli sot vendimin për çështjen (JR) nr. 40/2019, datë 04.09.2019, që i përket ankimit të paraqitur nga subjekti i rivlerësimit Arjana Fullani kundër vendimit nr. 186, datë 23.07.2019, të Komisionit të Pavarur të Kualifikimit.

Në përfundim të gjykimit, bazuar në nenin G, të Aneksit të Kushtetutës, nenin 66, pika 1, shkronja “a” e ligjit nr.84/2016 “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, trupi gjykues, me shumicë votash, vendosi:

1. Lënien në fuqi të vendimit nr.186, datë 23.07.2019 të Komisionit të Pavarur të Kualifikimit, që i përket subjektit të rivlerësimit Arjana Fullani.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm

U shpall sot, në Tiranë, më datë 11.11.2020.

The adjudication panel of the Appeal Chamber, composed of judges, Presiding Judge Albana Shtylla, case rapporteur Natasha Mulaj and members Ina Rama, Rezarta Schuetz, Sokol Çomo, announced today the decision on the case (JR) no. 40/2019, dated 04.09.2019, corresponding to the appeal filed by the assessee Arjana Fullani against decision no. 186, dated 23.07.2019, of the Independent Qualification Commission.

In conclusion of the adjudication, pursuant to Article G of the Annex to Constitution, Article 66 paragraph 1/a, of Law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, the adjudication panel, upon majority votes, decided:

1. Upholding of decision no.186, dated 23.07.2019 of the Independent Qualification Commission, corresponding to the assessee Arjana Fullani.
2. This decision is final and effective immediately

Kolegji i Posaçëm i Apelimit zhvilloi më datë 11.11.2020, ora 12:00, seancën gjyqësore publike për çështjen (JR) nr. 57/2019, datë 11.11.2019, që i përket ankimit të Komisionerit Publik dhe ankimit e kundërankimit të subjektit të rivlerësimit Elvin Gokaj, kundër vendimit nr. 187, datë 24.07.2019 të Komisionit të Pavarur të Kualifikimit.

Kryesuesja e trupit gjykues konfirmoi dërgimin pranë Kolegjit, nga Komisioneri Publik, të analizës së re financiare, në përmbushje të detyrave të lëna nga trupi gjykues, me vendim të ndërmjetëm, në seancën e datës 6 nëntor 2020 dhe vënien në dispozicion të kësaj analize, subjektit të rivlerësimit.

Subjekti i rivlerësimit konfirmoi njohjen me analizën financiare të Komisionerit Publik dhe kundërshtoi rezultatet e kësaj analize, duke deklaruar se bashkëshortja e tij kishte vetëm tagrin e përfaqësimit në depozitat dyemërore dhe jo atë të bashkëpronësisë.

Trupi gjykues, pasi dëgjoi prapësimet e subjektit të rivlerësimit dhe pasi palët deklaruan se nuk kishin kërkesa të tjera, mbylli shqyrtimin gjyqësor të cështjes dhe ftoi palët të paraqisnin konkluzionet përfundimtare.

Gjatë paraqitjes së konkluzioneve përfundimtare, Komisioneri Publik deklaroi se i qëndron të gjitha shkaqeve të ankimit, pasi subjekti i rivlerësimit nuk arriti të provojë të kundërtën e tyre. Komisioneri Publik vlerësoi se subjekti i rivlerësimit gjendet në kushtet e deklarimit të pamjaftueshëm  sa i përket kriterit të pasurisë dhe i kërkoi Kolegjit ndryshimin e vendimit nr. 187, datë 24.07.2019 të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit.

Përfaqësuesja ligjore, në emër të subjektit të rivlerësimit, hodhi poshtë të gjitha shkaqet e ankimit dhe i kërkoi Kolegjit mospranimin e ankimit të Komisionerit Publik dhe konfirmimin në detyrë të subjektit të rivlerësimit.

Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues u tërhoq për të marrë vendimin përfundimtar për çështjen, të cilin do ta shpallë më datë 18.11.2020, ora 12.00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

On 11.11.2020 at 12:00, the Appeal Chamber held the public hearing on the case (JR) no. 57/2019, dated 11.11.2019, corresponding to the appeal of the Public Commissioner and the appeal and counter-appeal of the assessee Elvin Gokaj against decision no. 187, dated 24.07.2019 of the Independent Qualification Commission.

The presiding judge confirmed that in fulfillment of the tasks assigned by the adjudication panel, upon an interim decision in the hearing of 6 November 2020, the Public Commissioner had submitted with the Appeal Chamber the new financial analysis, and this analysis had been made available to the assessee.

The assessee confirmed that he had gotten acquainted with the financial analysis of the Public Commissioner and objected the results of this analysis, stating that his spouse was only entitled to representation in the joint bank accounts and not that of co-ownership.

After hearing the objections of the assessee and after the litigants declared that they had no further claims, the adjudication panel concluded the judicial review of the case and invited the litigants to state their final conclusions.

While putting forward the final conclusions, the Public Commissioner stated that he stands by all the appeal grounds, as the assessee failed to prove the opposite of the results. The Public Commissioner deemed that the assessee is in the conditions of lack of full disclosure regarding the assets assessment criterion and asked the Appeal Chamber to amend the decision no. 187, dated 24.07.2019 of the Independent Qualification Commission and dismiss the assessee from office.

On behalf of the assessee, the legal representative, opposed all the appeal grounds and asked the Appeal Chamber to not accept the appeal of the Public Commissioner but to confirm the assessee in office.

Following the final conclusions from the litigants, the adjudication panel withdrew to render the final decision on the case, which shall be announced on 18.11.2020, at 12.00 h.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
