Kolegji i Posaçëm i Apelimit zhvilloi më datë 18.02.2020, ora 11:00, seancën gjyqësore publike për çështjen (JR) nr. 12/2019, datë 22.02.2019, që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 84, datë 27.11.2018, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Besnik Cani.

Gjatë kësaj séance gjyqësore, palët parashtruan konkluzionet e tyre përfundimtare. Komisioneri Publik deklaroi se i qëndron të gjitha shkaqeve të ankimit, pasi edhe me provat e reja, subjekti i rivlerësimit nuk arriti të provojë të kundërtën e shkaqeve të ankimit. Komisioneri Publik kërkoi ndryshimin e vendimit nr. 84, datë 27.11.2018 të Komisionit të Pavarur të Kualifikimit dhe shkarkimin nga detyra të subjektit të rivlerësimit.

Përfaqësuesi ligjor i subjektit të rivlerësimit i kërkoi trupit gjykues riçeljen e hetimin gjyqësor për t’i mundësuar subjektit të rivlerësimit depozitimin e një prove të re në përgjigje të shkaqeve të ankimit.

Trupi gjykues vendosi rrëzimin e kësaj kërkese, duke mos qenë në kushtet e nenit 304 të Kodit të Procedurës Civile.

Subjekti i rivlerësimit dhe përfaqësuesi i tij ligjor paraqitën kundërshtimet mbi secilin prej shkaqeve të ankimit të Komisionerit Publik, duke i konsideruar si të pabazuara në ligj e prova dhe kërkuan lënien në fuqi të vendimit nr. 84, datë 27.11.2018 të Komisionit të Pavarur të Kualifikimit.

Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues u tërhoq për të marrë vendimin përfundimtar për çështjen, të cilin do ta shpallë më datë 27.02.2020, ora 10:00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on 18.02.2020, at 11:00 h, the public hearing of case (JR) no. 12/2019, dated 22.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 84 dated 27.11.2018, of the Independent Qualification Commission, related to the transitional re-evaluation of the assessee Besnik Cani.

During this hearing the parties submitted their final conclusions. The Public Commissioner stated to stand by all appeal grounds, as even with the new evidences, the assessee failed to prove the contrary of the grounds of the appeal. The Public Commissioner requested the amendment of decision no. 84 dated 27.11.2018, of the Independent Qualification Commission and dismissal from office of the assessee.

The legal representative of the assessee requested the panel to re-open the judicial investigation to enable the assessee to file a new evidence in response to the grounds of appeal.

The adjudication panel decided to dismiss this request, as not being in terms of Article 304 of the Civil Procedure Code.

The assessee and his defense counsel submitted their objections to each ground of appeal of the Public Commissioner, considering them as unfounded in law and evidences and requested the upholding of decision no. 84 dated 27.11.2018, of the Independent Qualification Commission.

Following the hearing of the final conclusions of the parties, the adjudication panel withdrew to make the final decision on the case, to be announced on 27.02.2020, at 10:00 h.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
