Kolegji i Posaçëm i Apelimit zhvilloi më datë 04.02.2020, ora 10:00, seancën gjyqësore publike për çështjen (JR) nr.40/2018, datë 18.12.2018 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 63, datë 06.08.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Arben Dollapaj.

Duke shprehur qëndrimin e tij lidhur me materialet e prezantuara gjatë seancës paraardhëse, Komisioneri Publik deklaroi se aktet e depozituara deri në këtë fazë të procesit, në tërësinë e tyre, janë të pamjaftueshme për t’iu përgjigjur shkaqeve të ankimit.  

Subjekti i rivlerësimit u shpreh se nuk kishte prapësime lidhur me qëndrimin e Komisionerit Publik, pasi edhe sipas tij, përgjigjet e ardhura nga institucionet shtetërore nuk përmbajnë informacion provues në funksion të shkaqeve të ankimit. Subjekti i rivlerësimit u shpreh i gatshëm të sjellë informacione shtesë në këtë kuadër.   

Trupi gjykues, pasi u konsultua, vendosi të administrojë një leje ndërtimi dhe zhvillimi të një objekti në Valbonë, dokument ky i depozituar nga subjekti i rivlerësimit në funksion të shqyrtimit të çështjes.   

Trupi gjykues vendosi gjithashtu, të kërkojë informacione shtesë nga Struktura e Posaçme Antikorrupsion në kuadër të një denoncimi të ardhur për subjektin e rivlerësimit, të cilin Komisioneri Publik e ka përfshirë në shkaqet e ankimit.

Në respektim të afateve që i nevojiten institucioneve të përgjigjen zyrtarisht, trupi gjykues vendosi të shtyjë seancën gjyqësore për në datën 25.02.2020, ora 11:00. 

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on 16.01.2020, at 10:00 h, the public hearing of case (JR) no. 40/2018, dated 18.12.2018, corresponding to the appeal of the Public Commissioner against decision no. 63 dated 06.08.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Arben Dollapaj.

The chairperson stated that besides the Ministry of Tourism and Environment the other state institutions provided responses related to the additional documentation requested by the Appeal Chamber to the purpose of review of the case.

In response to the request of the adjudication panel in the previous hearing, the Public Commissioner stated his assessment on the way the public submissions were handled. The Public Commissioner considered that he has reflected in the appeal grounds the information of a part of the submissions, whereas with regard to the rest, he stated that they do not contain sufficient grounds for further investigation by the Appeal Chamber.

In response to the appeal grounds, the assessee submitted some new additional acts, which he requested the panel to be admitted as evidences.

The adjudication panel decided to make available to the parties the responses of the state institutions, whereas it shall make available to the assessee the public submissions as well.

In order to provide the necessary time to the parties to make a statement with regard to the form and content of the materials presented in this hearing, the adjudication panel decided to interrupt the hearing and resume it on 04.02.2020, at 10:00 h.

The public hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
