Kolegji i Posaçëm i Apelimit zhvilloi më datë 19.06.2020, ora 12:30, seancën gjyqësore publike për çështjen (JR) nr. 10/2019, datë 29.02.2019, që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 86, datë 17.12.2018, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Alma Kolgjoka.

Gjatë seancës së sotme gjyqësore, kryesuesi citoi shkresat dhe aktet e ardhura në Kolegj në përgjigje të kërkesave të trupit gjykues për informacione shtesë në funksion të shqyrtimit të çështjes.

Krahas këtyre akteve, subjekti i rivlerësimit, znj.Kolgjoka, bashkë me prapësimet e saj, paraqiti disa akte të reja shtesë, për të cilat kërkoi administrimin në cilësinë e provës.

Komisioneri Publik në prapësimet e tij u shpreh se përgjigjet e ardhura si rezultat i hetimit të Kolegjit janë shteruese dhe plotësojnë hetimin e kryer në mënyrë jo të plotë nga KPK-ja për pasurinë apartament banimi në Tiranë, në posedim të familjarit të subjektit të rivlerësimit.

Pasi administroi provat e mbërritura në Kolegj si rrjedhojë e hetimit, si dhe provat e paraqitura nga subjekti i rivlerësimit znj.Alma Kolgjoka, trupi gjykues vendosi mbylljen e hetimit gjyqësor të çështjes dhe ftoi palët të shprehin konkluzionet përfundimtare.

Gjatë konkluzioneve përfundimtare, Komisioneri Publik u shpreh se për subjektin e rivlerësimit gjen zbatim neni 59, paragrafi i parë i ligjit nr. 84/2016 dhe për këtë arsye, kërkoi lënien në fuqi të vendimit nr.86, datë 17.12.2018 dhe konfirmimin në detyrë të subjektin të rivlerësimit.

Subjekti i rivlerësimit, znj.Kolgjoka u shpreh se nëpërmjet fakteve të reja në këtë gjykim u provua në mënyrë kategorike dhe shteruese se familjari i saj nuk mund të përkufizohet si person tjetër i lidhur. Subjekti i rivlerësimit kërkoi lënien në fuqi të vendimit nr.86, datë 17.12.2018, të Komisionit të Pavarur të Kualifikimit.

Pasi dëgjoi konkluzionet përfundimtare të palëve, trupi gjykues u tërhoq për të marrë vendimin përfundimtar për çështjen, të cilin do ta shpallë më datë 25.06.2020, ora 09.30.

Seanca publike do të zhvillohet në adresën “Pallati i Koncerteve”, Bulevardi “Dëshmorët e Kombit”, Tiranë.

The Appeal Chamber held on 19.06.2020, at 12:30 h, the public hearing on the case (JR) no. 10/2019, dated 29.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 86, dated 17.12.2018, of the Independent Qualification Commission related to the transitional re-evaluation process of the assessee Alma Kolgjoka.

During today’s public hearing, the presiding judge cited the documents and acts submitted with the Appeal Chamber in response to the requests of the adjudication panel for additional information for the purpose of the case review.

In addition to these acts, the assessee, Mrs. Kolgjoka along with her objections, submitted several new additional acts, upon which she requested to be administered as evidence.

The Public Commissioner in his objections stated that the answers resulting from the investigation of the Appeal Chamber are exhaustive and complement the non-thoroughly investigation carried out by the IQC for the apartment asset in Tirana, owned by the relative of the assessee.

After administering the evidence submitted with the Appeal Chamber as a result of the investigation, as well as the evidence submitted by the assessee, Mrs. Alma Kolgjoka, the adjudication panel decided to conclude the judicial investigation of the case and invited the parties to express their final conclusions.

During the final conclusions, the Public Commissioner stated that paragraph 1 of Article 59 of Law no. 84/2016 applies to the assessee and for this reason the PC requested the upholding of the decision no. 86, dated 17.12.2018 and the confirmation in duty of the assessee.

The assessee, Mrs. Kolgjoka, stated that upon the new facts in this proceeding, it was categorically and exhaustively proved that her relative could not be qualified as other related person. The assessee requested the upholding of decision no. 86, dated 17.12.2018, of the Independent Qualification Commission.

After hearing the final conclusions of the parties, the adjudication panel withdrew to make the final decision on the case, which shall be announced on 25.06.2020, at 09.30.

The public hearing shall take place at the premises of “Pallati i Koncerteve”, Bulevardi “Dëshmorët e Kombit”, Tirana.

Ditën e hënë, më datë 20.07.2020, ora 10:00, do të gjykohet në seancë plenare publike, çështja e Juridiksionit Disiplinor nr. 1/2019, datë 19.12.2019 me kërkues Tom Dedaj, kundër vendimit nr. 22, datë 28.01.2019 të Këshillit të Lartë të Prokurorisë.

On Monday, 20.07.2020, at 10:00 h, the Appeal Chamber shall review in public hearing the case of Disciplinary Jurisdiction no. 1/2019, dated 19.12.2019 with the petitioner Tom Dedaj, against decision no. 22, dated 28.01.2019 of the High Prosecution Council.
