Trupi gjykues i Kolegjit të Posaçëm të Apelimit, i përbërë nga Ina Rama kryesuese, Rezarta Schuetz  relatore, Ardian Hajdari, Natasha Mulaj, Sokol Çomo anëtarë, shpalli vendimin për çështjen (JR) nr.56/2019, datë 07.11.2019, që lidhet me ankimin e subjektit të rivlerësimit Ardian Ylli, kundër vendimit të Komisionit të Pavarur të Kualifikimit nr. 182, datë 18.07.2019.

Në përfundim të gjykimit në dhomë këshillimi, trupi gjykues, bazuar në nenin 66, pika 1, shkronja “a” e ligjit nr.84/2016, “Për rivlerësimin kalimtar të gjyqtarëve dhe prokurorëve në Republikën e Shqipërisë”, në mënyrë unanime, vendosi:
1. Lënien në fuqi të vendimit të Komisionit të Pavarur të Kualifikimit nr. 182, datë 18.07.2019, që i përket subjektit të rivlerësimit Ardian Ylli.
2. Ky vendim është përfundimtar dhe ka efekt të menjëhershëm.
U shpall sot, në Tiranë, më datë 29.07.2021.

On Thursday, 29.09.2021, at 10:00 h, the Appeal Chamber shall review in chambers the case (JR) no. 56/2019 dated 07.12.2019, corresponding to the appeal of the assessee Ardian Ylli against decision no. 182, dated 18.07.2019, of the Independent Qualification Commission.

The trial panel for the adjudication of this case consists of judges:

The hearing in chambers will take place in the premises of the Appeal Chamber, at: Boulevard “Dëshmorët e Kombit”, no.3. Tirana.

The trial panel of the Appeal Chamber, composed of judges, Ina Rama, presiding, Rezarta Schuetz, rapporteur, Ardian Hajdari, Natasha Mulaj, Sokol Çomo members, announced the decision on case (JR) no. 56/2019, dated 07.11.2019, related to the appeal of the assessee Ardian Ylli against the decision of the Independent Qualification Commission no. 182, dated 18.07.2019.

At the end of the trial in chambers, the trial panel, pursuant to Article 66, paragraph 1/a, of Law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, unanimously decided:

1. To uphold the decision of the Independent Qualification Commission no. 182, dated 18.07.2019, related to the assessee Ardian Ylli.

2. This decision is final and effective immediately.

Announced in Tirana, today on 29.07.2021.

Today, on 29.07.2021, at 09:00h, the Appeal Chamber held the public hearing of case (JR) 3/2020, dated 14.01.2020, related to the appeal of the Public Commissioner against decision no. 200, dated 16.10.2019, of the Independent Qualification Commission related to the assessee Besim Hajdarmataj.

The presiding judge informed that after closing the main trial on 16.07.2021, the trial panel withdrew for making the decision on the case. During the deliberations, the trial panel decided to revoke the interim decision dated 16.07.2021 to close the judicial investigation and reopen it, in order to obtain information from the Independent Qualification Commission, forwarded to it by Vodafone Albania, through a letter dated 26.04.2019, in view of the judicial review of the case.

The presiding judge informed that due to this reason, the hearing will be postponed until 03.08.2021, at 9:00 h. The parties shall submit at this hearing their views on the document, if it will be made available to them in advance by the Chamber.
