All day 2025.07.03 The Appeal Chamber opened today, on 03.07.2025, at 15:00, the public hearing of case (JR) 8/2023, dated 24.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 600, dated 19.12.2022 of the Independent Qualification Commission, related to the assessee Robert Kote. During the verification of the presence of the parties, the presiding judge ascertained the presence of the assessee and the absence of the representative of the Head of the Special Prosecution Office, Mr. Klodian Braho, and reported as follows: In the hearing dated 18.06.2025, after hearing the final conclusions of the parties, the trial panel declared the trial closed and withdrew in chambers to make the final decision on the case. During the deliberations and in their framework, the trial panel considered the final request of the appellant, the representative of the Head of the Special Prosecution office, and considered pertinent to clarify through questions that would have to be addressed him in a procedural point of view regarding the final request to the Chamber. Therefore, in the hearing in chambers dated 01.07.2025, the trial panel revoked the interim decision made in the hearing dated 18.06.2025 to close the trial and to withdraw in chambers to make the decision on the case. All day 2025.07.04 The Appeals Chamber held on 04.07.2025, at 10:00, the public hearing of case (JR) 7/2023, dated 14.02.2023, pertaining to the appeal of the Public Commissioner against decision no. 605, dated 21.12.2022 of the Independent Qualification Commission, for the assessee Armida Hamiti (Moçka). The Head of the Special Prosecution Office, Mr. Altin Dumani, stated during the submission of the appeal grounds, that the assessee, Ms. Armida Hamiti (Moçka), failed to prove the opposite of the burden of proof and that, contrary to the reasoning of the decision of the Independent Qualification Commission, the financial insufficiency of her and the persons related to her amounts to that extent that the principles of proportionality and objectivity cannot be applied. Mr. Dumani requested the amendment of decision no. 605, dated 21.12.2022 of the Independent Qualification Commission and the dismissal from office of the assessee. Disputing the appeal grounds, the assessee held that the appeal is unfounded in law, contains logical and factual inconsistencies and it is supported on formalistic and partial interpretations of the evidence. The assessee requested the reopening of the judicial investigation of the case and the admission as evidence of several new acts, which she filed in support of her claims. Ms. Hamiti also requested the dismissal of the Public Commissioner’s appeal as unfounded in law and evidence and the upholding of decision no. 605, dated 21.12.2022 of the Independent Qualification Commission that confirmed her in office. Following several clarifications that the case rapporteur requested from the assessee with respect to the formal aspect of the lodged documentation, the Head of the Special Prosecution Office stated that apart from the three acts that fail to meet the legal criteria in terms of their form, the others should be accepted as evidence, as they would serve to the objective examination of the case. Once the Head of the Special Prosecution Office addressed several questions to the assessee to the purpose of the examination of the case, the trial panel decided to reopen the judicial investigation, accepting as evidence the acts lodged by the assessee, except for the acts that turned out not to be in the form required by law. Given that the parties stated that they had no procedural requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions. In order to give the parties a necessary time to prepare their final conclusions, the hearing was postponed to 11.07.2025, at 09:00. During the verification of the presence of the parties, the presiding judge ascertained the presence of the representative of the Head of the Special Prosecution office Mr. Klodjan Braho, the assessee Mr. Kledian Llaho and of Mr. Elis Bilali, who submitted a representation act as a defense counsel for the assessee Mr. Llaho. The legal representative of Mr. Llaho requested a postponement of the hearing in order to be provided with a reasonable amount of time to be acquainted with the appeal and the case. With respect to this request, the representative of the Head of the Special Prosecution Office held that the defense counsel had sufficient time available to be acquainted with the acts and the appeal, however, for an effective defense, there were no objections to the postponement of the hearing. After being consulted, the trial panel found that it turns out from the acts of the case file that on 05.12.2022 the assessee was made available the physical and electronic documentation (CD) of the administrative investigation file at the Independent Qualification Commission. All day 2025.07.07 The Appeal Chamber held on 07.07.2025, at 10:00, the public hearing of case (JR) 43/2024, dated 05.11.2024, pertaining to the appeal of the Public Commissioner against decision no. 802, dated 23.09.2024 of the Independent Qualification Commission, related to the assessee Flora Çela. The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199, paragraph 2 of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, Mr. Altin Dumani, present at the hearing. During the submission of the appeal grounds, the Head of the Special Prosecution Office held that there are issues found with regard to the proficiency assessment criteria, such that they cannot be remedied with the training program of the School of Magistrates and that the assessee, Ms. Flora Çela, with her actions and omissions during the exercise of her office, has undermined public trust in the justice system. The Head of the Special Prosecution office requested the amendment of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Flora Çela. The assessee, during her objections, stated that the Public Commissioner’s appeal on the proficiency assessment criteria is not only unsupported on objective elements and factual data, but also contradicts the assessments that the relevant institutions of the justice system have carried out for Ms. Flora Çela regarding her professional skills. The assessee requested the dismissal of the appeal as unfounded in evidence and the upholding of decision no. 802, dated 23.09.2024 of the Independent Qualification Commission. The assessee lodged some new documents attached to the submissions, requesting the trial panel to collect them as evidence. The Head of the Special Prosecution office agreed to accepting the documents submitted as evidence. Subsequently, after the assessee heard several opinions of the International Observer of the International Monitoring Operation, and responded to several questions from him and the Head of the Special Prosecution Office to the purpose of the consideration of the case, the trial panel was consulted and decided to open the judicial investigation of the case, accepting as evidence the acts filed in writing by the International Monitoring Operation on 14.11.2024, as well as the acts filed by the assessee, along with the submissions. Once the parties declared that they had no other procedural requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions. All day 2025.07.09 The Appeal Chamber held on 09.07.2025, at 09:00, the public hearing of case (JR) 39/2022, dated 07.09.2022, pertaining to the appeal of the Public Commissioner against decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, related to the assessee Elona Alvora. During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated that there are shortcomings in the proficiency assessment criterion, according to the indicators set forth in Article 73, paragraph 2 of Law no. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, but these shortcomings do not reach such extent as to have affected the investigative activity and may be remedied by the training program at the School of Magistrates. Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the amendment of the Independent Qualification Commission decision no. 538, dated 07.06.2022, the suspension from office of the assessee, Ms. Elona Alvora and the obligation to follow the training program provided by the School of Magistrates. The assessee, Ms. Elona Alvora submitted in summary her explanations regarding the circumstances of the criminal cases included in the appeal and reiterated the request addressed to the Chamber to dismiss the appeal regarding the two cases transferred to the High Inspector of Justice. Ms. Elona Alvora stated that as regards the other cases, she had the capacity to undertake logical investigative actions, in accordance with the procedural law, and that the shortcomings found are not such as to have marked issues in the investigative activity. Finally, the assessee requested the upholding of decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, which confirmed her in office. Initially, the representative of the Head of the Special Prosecution office responded to the questions that the case rapporteur had addressed in the previous hearing, dated 25.06.2025, in view of the examination of the case. Subsequently, the assessee requested the admission as evidence of a document issued by the Prosecution office at the First Instance Court of General Jurisdiction of Vlora, which was dismissed by the trial panel in the hearing dated 25.06.2025, providing the assessee the opportunity to submit it in the form required by law, if she considered it relevant for her case. The trial panel, after hearing the position of the representative of the Head of the Special Prosecution office, who agreed to subject this document to judicial debate, decided to accept it. Once the parties declared that they had no other requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions on the case. The representative of the Head of the Special Prosecution Office stated that he stands by the appeal grounds and that the assessee, Ms. Eranda Laze, is found in terms of inaccurate and insufficient declaration of assets and there is a lack of legitimate sources to justify her assets and those of the persons related to her. Mr. Adnan Xholi assessed convincing the explanations of the assessee regarding the background assessment criteria, while reiterating his position that Ms. Laze has shown deficiencies in displaying increased diligence in extrajudicial activity. Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the amendment of decision no. 811, dated 08.11.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Eranda Laze. The assessee stated that the Public Commissioner failed to argue his appeal in accordance with the law and the evidence in the case file, that this appeal is hypothetical and prejudicial in nature and as such, cannot be a ground for issuing a decision to dismiss her from office. The presiding judge announced that Article 179/b, paragraph 8 of the Constitution of the Republic of Albania and Article 199 of the Civil Procedure Code have set forth the transfer of powers from the Public Commissioner to the Head of the Special Prosecution Office, represented in this case upon special authorization by the prosecutor of the Special Prosecution Office, Mr. Adnan Xholi, present at the hearing. During the submission of the appeal grounds, the representative of the Special Prosecution Office stated that the assessee is found in terms of inaccurate and insufficient declaration and fails to cover his assets with legitimate sources. With respect to the proficiency assessment, Mr. Adnan Xholi requested the Chamber to assess the repeated shortcomings, observed during the exercise of the office by the assessee, along with the issues found in the asset assessment criterion, as they may lead to a different conclusion from the one of the Independent Qualification Commission, which has confirmed him in office. The representative of the Special Prosecution Office maintained that the assessee fails to reach a reliable level for his confirmation in office, therefore, he requested the amendment of decision no. 598, dated 13.12.2022 of the Independent Qualification Commission, related to the assessee Genci Mane and his dismissal from office. The assessee provided explanations in response to the appeal grounds, filing several new acts, which he requested the trial panel to collect them as evidence. The presiding judge informed that the parties had been provided with two complaints, regarding which the representative of the Special Prosecution Office stated that they contain no sufficient grounds for further investigation. The assessee provided his explanations regarding the complaints and filed several acts with their regard, which he requested to be admitted as evidence by the trial panel. Subsequently, the assessee also responded to several questions of the case rapporteur. After being consulted, the trial panel decided: To open the judicial investigation and to administer as evidence the acts lodged by the assessee in the submissions and in today’s hearing, as follows: With regard to the acts attached to the submissions: - Donation contracts and OSHEE’s letter, according to the extremities cited in the submissions;
- 10 purchase contracts – in terms when they are administered in the IQC case – it is not necessary their administration once more;
- The financial expertise report – to be considered as an integral part of the submissions.
The trial panel also decided: - To administer as evidence the acts submitted in today’s hearing;
- To not open an investigation regarding the complaints, as the requirements of Article 53 of Law 84/2016 are not met.
- To address Tirana Universal Service Provider, the Power Supply Distribution System Operator, Fier Regional Directorate, and the Water Supply and Sewage Company Sh.A Fier for additional information and documentation to the purpose of consideration of the case.
The responses of these operators shall be made available to the parties, immediately upon their arrival at the AC. Pending these responses, the trial panel decided to postpone the hearing to 14.07.2025, at 13:00. All day 2025.07.16 The Appeal Chamber held on 09.07.2025, at 09:00, the public hearing of case (JR) 39/2022, dated 07.09.2022, pertaining to the appeal of the Public Commissioner against decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, related to the assessee Elona Alvora. During the submission of the final conclusions, the representative of the Head of the Special Prosecution Office, Mr. Adnan Xholi, stated that there are shortcomings in the proficiency assessment criterion, according to the indicators set forth in Article 73, paragraph 2 of Law no. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, but these shortcomings do not reach such extent as to have affected the investigative activity and may be remedied by the training program at the School of Magistrates. Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the amendment of the Independent Qualification Commission decision no. 538, dated 07.06.2022, the suspension from office of the assessee, Ms. Elona Alvora and the obligation to follow the training program provided by the School of Magistrates. The assessee, Ms. Elona Alvora submitted in summary her explanations regarding the circumstances of the criminal cases included in the appeal and reiterated the request addressed to the Chamber to dismiss the appeal regarding the two cases transferred to the High Inspector of Justice. Ms. Elona Alvora stated that as regards the other cases, she had the capacity to undertake logical investigative actions, in accordance with the procedural law, and that the shortcomings found are not such as to have marked issues in the investigative activity. Finally, the assessee requested the upholding of decision no. 538, dated 07.06.2022 of the Independent Qualification Commission, which confirmed her in office. After hearing the final conclusions of the parties, the trial panel decided to close the judicial review of the case and withdrew in chambers to make the final decision, which shall be announced on 16.07.2025, at 15:00. All day 2025.07.29 The Appeal Chamber held on 09.07.2025, at 11:00, the public hearing of case (JR) 56/2024, dated 27.12.2024, pertaining to the appeal of the Public Commissioner against decision no. 811, dated 08.11.2024 of the Independent Qualification Commission, related to the assessee Eranda Laze. Initially, the representative of the Head of the Special Prosecution office responded to the questions that the case rapporteur had addressed in the previous hearing, dated 25.06.2025, in view of the examination of the case. Subsequently, the assessee requested the admission as evidence of a document issued by the Prosecution office at the First Instance Court of General Jurisdiction of Vlora, which was dismissed by the trial panel in the hearing dated 25.06.2025, providing the assessee the opportunity to submit it in the form required by law, if she considered it relevant for her case. The trial panel, after hearing the position of the representative of the Head of the Special Prosecution office, who agreed to subject this document to judicial debate, decided to accept it. Once the parties declared that they had no other requests, the trial panel decided to close the judicial investigation and invited them to submit their final conclusions on the case. The representative of the Head of the Special Prosecution Office stated that he stands by the appeal grounds and that the assessee, Ms. Eranda Laze, is found in terms of inaccurate and insufficient declaration of assets and there is a lack of legitimate sources to justify her assets and those of the persons related to her. Mr. Adnan Xholi assessed convincing the explanations of the assessee regarding the background assessment criteria, while reiterating his position that Ms. Laze has shown deficiencies in displaying increased diligence in extrajudicial activity. Finally, the representative of the Head of the Special Prosecution Office requested the Chamber the amendment of decision no. 811, dated 08.11.2024 of the Independent Qualification Commission and the dismissal from office of the assessee Eranda Laze. The assessee stated that the Public Commissioner failed to argue his appeal in accordance with the law and the evidence in the case file, that this appeal is hypothetical and prejudicial in nature and as such, cannot be a ground for issuing a decision to dismiss her from office. Finally, assessee requested the trial panel to take into consideration all the evidence in the case file and, after their evaluation, decides to dismiss the Public Commissioner’s appeal as unfounded in law, as well as the upholding of decision no. 811, dated 08.11.2024 of the Independent Qualification Commission. After hearing the final conclusions of the parties, the trial panel decided to close the judicial review and withdrew in chambers to make the final decision, which it shall announce on 29.07.2025, at 15:00.
