Kolegji i Posaçëm i Apelimit zhvilloi më datë 11 mars 2019, seancën gjyqësore publike të radhës për çështjen (JR) nr.13/2018, datë 07.09.2018 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr.32, datë 05.07.2018 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Alma Brati.

Gjatë seancës së sotme, subjekti i rivlerësimit kërkoi të merren në cilësinë e provës dy dokumente të lëshuara nga institucione shtetërore rajonale italiane. Komisioneri Publik vlerësoi se këto akte nuk specifikojnë në detaj pjesët e burimeve të ligjshme të të ardhurave të secilit prej personave të tjerë të lidhur me subjektin e rivlerësimit. Trupi gjykues, në vijim të parashtrimeve, vendosi:

1. Të lejojë marrjen e provave, të paraqituara nga subjekti i rivlerësimit, si më poshtë: dokumente të lëshuara nga institucionet përgjegjëse, të agjencisë “Entrate” lidhur me taksat e derdhura nga shtetasja M.P. për periudhën 2010-2016, dhe aktin zyrtar të lëshuar nga përmbaruesi shtetëror datë 7.2.2019, që vërteton faktin se subjekti M.P. nuk ka asnjë detyrim ndaj shtetit dhe as të tretëve.
2. Të revokojë vendimin e ndërmjetëm të marrë nga trupi gjykues, më datë 18.12.2018, për të kërkuar aktet shkresore zyrtare për të ardhurat mujore, ku tregohen taksat e mbajtura nga shteti italian për persona të tjerë të lidhur: M.P. dhe L.P.
3. Trupi gjykues, me shumicë votash vendosi të mos çelë hetimin lidhur me tre denoncimet e paraqitura në Kolegj, nga shtetasit: C.I., M.B. dhe B.R., për arsye se rrethanat e parashtruara nuk përbëjnë prova në lidhje me kriteret e vlerësimit.

Trupi gjykues vendosi të shtyjë seancën gjyqësore publike, më datë 25.3.2019, ora 10:00, qe ta njohë subjektin e rivleresimit me rezultatet e analizës financiare që do të kryejë Njësia e Shërbimit Ligjor pranë Kolegjit të Posaçëm të Apelimit, si rrjedhojë e provave të paraqituara  nga subjekti dhe prova të tjera të marra kryesisht nga trupi gjykues. ​

Seanca do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on February 11, 2019, the consecutive hearing of case (JR) no. 13/2018, dated 07.09.2018, corresponding to the appeal of the Public Commissioner against decision no.32, dated 05.07.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Ms. Alma Brati.

During today’s hearing the assessee requested the adjudication panel to collect in the capacity of evidence two documents issued by Italian regional state authorities. The Public Commissioner held that these acts do not specify in detail the shares of the lawful sources of incomes of each related other persons to the assessee. Following the submissions, the adjudication panel decided:

1. To allow the collection of the evidences submitted by the assessee, as follows: documents issued by the respective authorities, agency “Entrate”, related to the taxes paid by citizen M.P. for the time period 2010-2016, and the official document issued by the state bailiff dated 07.02.2019, certifying the fact that the entity M.P. has no liability to the state or third parties.
2. To revoke the interim decision of the adjudication panel dated 18.12.2018 in requesting official written documentation on the monthly income, indicating taxes withheld by the Italian state for the other related persons: M.P and L.P.
3. The adjudication panel, by a majority vote, decided to not open the investigation regarding the three submissions filed with the AC by citizens: C.I., M.B. and B.R, as the submitted circumstances do not constitute evidence for the re-evaluation criteria.

The adjudication panel decided to adjourn the hearing on 25.03.2019, at 10:00 h., to inform the assessee on the results of the financial analysis to be carried out by the Legal Service Unit of the Appeal Chamber, in view of the evidences submitted by the assessee and other evidences collected ex officio by the adjudication panel.

The hearing shall be held at the premises of the Appeal Chamber, at: Bulevardi “Dëshmorët e Kombit”, nr.3. Tirana.
