Kolegji i Posaçëm i Apelimit, për shkak të situatës së krijuar nga përhapja e virusit COVID-19 në vend dhe në kuadër të masave mbrojtëse për parandalimin e përhapjes së infeksionit të shkaktuar prej tij, kufizon veprimtarinë dhe shërbimet e tij.

Në bazë të Vendimit të Mbledhjes së Gjyqtarëve nr. 6, datë 11.03.2020, pika 2 e tij, seanca publike për çështjen (JD) nr. 1/2019, me kërkues Tom Dedaj përcaktuar për t’u zhvilluar ditën e martë, datë 24.03.2020, ora 10.00 do të shtyhet deri në një njoftim të dytë.

On Tuesday, 24.03.2020, at 10:00 h, the Appeal Chamber shall review in a public hearing case (JD) no. 1/2019, dated 19.12.2019, corresponding to the appeal of the Mr. Tom Dedaj against decision no. 22, dated 28.01.2019 of the High Prosecutorial Council.

Pursuant to the Meeting of Judges decision no. 6, dated 11.03.2020, paragraph 2, the public plenary session on case (JD) no. 1/2019, with petitioner Tom Dedaj, scheduled to take place on Tuesday, 24.03.2020, at 10:00 am, shall be postponed until further notice.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 19.02.2020, ora 10:00, seancën gjyqësore publike për çështjen (JR) nr. 10/2019, datë 29.02.2019, që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 86, datë 17.12.2018, të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Alma Kolgjoka.

Gjatë parashtrimit të shkaqeve të ankimit të lidhura vetëm me kriterin e pasurisë, nëpëmjet një kërkese paraprake, Komisioneri Publik i kërkoi Kolegjit të Apelimit të shprehej me vendimmarrje lidhur me cilësimin ose jo si person tjetër i lidhur, të një familjari të subjektit të rivlerësimit, dhe pasi të kishte nje vendimarrje të trupit gjykues lidhur me këtë cilësim, ai do të shprehej lidhur me kërkimet e tij për hetimet që kërkoheshin lidhur me çështjen.  Komisioneri Publik kërkoi lënien në fuqi ose ndryshimin e vendimit nr. 86, datë 17.12.2018, të Komisionit të Pavarur të Kualifikimit.

Subjekti i rivlerësimit hodhi poshtë shkaqet e ankimit të Komisionerit Publik, duke i cilësuar si të pabazuara në prova e ligj dhe kërkoi lënien në fuqi të vendimit nr. 86, datë 17.12.2018, të Komisionit të Pavarur të Kualifikimit.

Gjykata çmoi se në këtë fazë të gjykimit nuk mund të shprehej rreth çështjes së raportit juridik midis subjektit të rivlerësimit dhe familjarit të saj, si dhe cilësimit të tij si person tjetër i lidhur, pasi kjo çështje do të arsyetohet në vendimin përfundimtar.

Në vijim, Komisioneri Publik kërkoi nga trupi gjykues i Kolegjit që të kryente një analizë financiare për verifikimin e ligjshmërisë së burimit të krijimit të pasurisë, apartament banimi në Tiranë.

Në funksion të kërkimit të Komisionerit Publik për kryerjen e analizës financiare, me qëllim verifikimin e marrëdhënies që kanë patur familjarjarët e subjektit të rivlerësimit me pasurinë apartament banimi në Tiranë, trupi gjykues i Kolegjit vendosi të çelë hetimin, duke iu drejtuar për informacion shtesë dhe paraqitje aktesh mbi kontrata te lidhura dhe pagesa të kryera, ndërmarrjes së Ujësjellësit, OSHE-së, shoqërive tregtare investitore dhe sipërmarrëse për ndërtimin e këtij apartamenti, si dhe për veprime juridike të kryera, Dhomës Kombëtare të Noterisë.

Sa më sipër, trupi gjykues i kërkoi subjektit të rivlerësimit që nëse e konsideron të nevojshme, të paraqesë argumenta, prova dhe shpjegime të mundshme.

Në pritje të kthimit të përgjigjeve të mësipërme, trupi gjykues vendosi të shtyjë seancën gjyqësore për në datën 25 mars 2020, ora 10:00.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Appeal Chamber held on 19.02.2020, at 10:00 h, the public hearing of case (JR) no. 10/2019, dated 29.02.2019, corresponding to the appeal of the Public Commissioner against decision no. 86 dated 17.12.2018 of the Independent Qualification Commission related to the transitional re-evaluation of the assessee Alma Kolgjoka.

During the submission of the grounds of the appeal related only to asset criteria, the Public Commissioner, through a preliminary request, required the Appeal Chamber to make a decision whether a family member of the assessee was to be qualified as other related person, and once the panel made a decision with regard to this qualification, he would comment on the request concerning investigations related to the case in question. The Public Commissioner requested the upholding or amendment of decision no. 86 dated 17.12.2018 of the Independent Qualification Commission.

The assessee rejected the appeal grounds of the Public Commissioner, considering them unfounded in law and evidences and required the upholding of IQC decision no. 46, dated 17.12.2018.

The Court held that with regard to the legal relationship between the assessee and her family member, and qualification of this person as other related person it cannot not make a statement at this stage of the trial, as this matter shall be considered in the final decision.

Subsequently, the Public Commissioner requested the panel to carry out a financial analysis to verify the legitimacy of the source of creation of property residential apartment in Tirana.

In view of the request of the Public Commissioner to conduct a financial analysis, in order to verify the relationship that the family members of the assessee had with property residential apartment in Tirana, the adjudication panel of the Chamber decided to open the investigation, seeking further information and submission of acts on concluded contracts and carried out payments to Water Supply Enterprise, Power Supply Enterprise, investing commercial and undertaking companies related to the construction of this apartment, as well as the National Notary Chamber, related to legal acts drafted in this respect.

As per above, the adjudication panel requested the assessee that if she considers necessary, she may submit possible arguments, evidences and explanations.

Pending the receipt of the above responses, the adjudication panel decided to adjourn the hearing on 25.03.2020, at 10:00 h.

Kolegji i Posaçëm i Apelimit zhvilloi më datë 06.03.2020, ora 10:00, seancën gjyqësore publike për çështjen (JR) nr.44/2019, datë 18.09.2019 që i përket ankimit të paraqitur nga Komisioneri Publik kundër vendimit nr. 162, datë 19.06.2019 të Komisionit të Pavarur të Kualifikimit që lidhet me procesin e rivlerësimit kalimtar të subjektit të rivlerësimit Manjola Kajana.

Gjatë parashtrimit të shkaqeve të ankimit, Komisioneri Publik i kërkoi Kolegjit çeljen e hetimit gjyqësor dhe marrjen e provave përkatëse në funksion të ankimit. Komisioneri Publik kërkoi ndryshimin ose lënien në fuqi të vendimit nr. 162, datë 19.06.2019 të Komisionit të Pavarur të Kualifikimit.

Subjekti i rivlerësimit, znj. Kajana, paraqiti kundërshtimet e saj në përgjigje të secilit prej shkaqeve të ankimit, duke i kërkuar Kolegjit të çelë hetimin gjyqësor dhe të pranojë në cilësinë e provës disa akte shtesë të depozituara prej saj gjatë seancës së sotme gjyqësore.

Pasi dëgjoi kërkimet e palëve, trupi gjykues vendosi të çelë hetimin gjyqësor të çështjes dhe të lejojë marrjen në cilësinë e provës të akteve të depozituara nga subjekti i rivlerësimit.

Në funksion të shkaqeve të ankimit dhe hetimit gjyqësor të çështjes, trupi gjykues vendosi t’i kërkojë informacione shtesë Gjykatës së Rrethit Fier, Prokurorisë së Rrethit Gjyqësor Fier, Prokurorisë së Përgjithshme, Bashkisë Fier, si dhe Degës Tatimore Rajonale Dibër.

Në pritje të kthimit të përgjigjeve të mësipërme, trupi gjykues vendosi të shtyjë seancën gjyqësore për në datën 26 mars 2020, ora 09:30.

Seanca publike do të zhvillohet në ambientet e Kolegjit të Posaçëm të Apelimit, në adresën: Bulevardi “Dëshmorët e Kombit”, nr.3. Tiranë.

The Public Commissioner requested the amendment or upholding of decision no. 162 dated 19.06.2019 of the Independent Qualification Commission.

The assessee, Ms. Kajana, submitted her objections to each appeal ground, requesting the Chamber the opening of the judicial investigation and collection in the capacity of evidence of some acts filed by her during this hearing.

Following the submissions of the parties, the adjudication panel decided to open the judicial investigation of the case and allow the collection in the capacity of evidence of the acts filed by the assessee.

In view of the appeal grounds and judicial investigation of the case, the panel decided to request further information to the Fier District Court, Prosecution office at Fier District Court, General Prosecution office, Fier Municipality and Regional Tax Authority of Diber.
